I suffer from severe panick attacks, PTSD, Anxiety, and depression and my case was denied. Can I get something from him when I go out looking for a job that says "this person can't be fired for taking unscheduled breaks when she is having a severe panick attacks that feel like a heart attack etc.. and this person can't be fired for missing days from work for having to take days off when they get really bad" I am extremely disappointed. I know a few drug addicts on disability how can they get it so they can keep getting high but I am struggling with several things here and I can't?

Judge Wheatley is very nice in person but his first decision was harsh but at that time I had no insurance and therefore no personal doctors' opinions. At the second hearing with him he was again very personable but stern. He had 3 experts to testify at my hearing but once he heard the first two, together with the Soc Sec dept.'s doctors' examination reports (I did 2), all four of their doctors said I was disabled. He approved my case from the bench. He did not talk to me at all except to swear me in. So I believe once he had the actual opinions from my doctors (which I was able to get with medi-cal) and their 4, he did the right thing.

Danny Pittman has denied me twice I have worked about 30years. First denied he made a decision before more medical records came. Then they tell me I can work with limitations then I hear I can't work then they I can work. As I deal with since 2010 until this year he denied me again. Medical records and X-rays don't lie and doctors will not put their jobs on the line to lie. I am a dietbic, depression, insomnia, shoulder needs to be replace knee replacement glacoma, two disc problems in my lower back, can't sleep on my back. I feel it's discrimination because I am native Americans/African American. I wasn't treated fairly and that's not right or fair I have other medical condition but my records is on file. I been fighting to get my Disabilty since 2010.

In 2007, my ME did not have time to read my medical records, did not believe a word I had said, and stopped my W.Comp from that day forward. In 2010, one day prior to my hearing with Judge Sanya Hill Maxion, I knelt for the 2nd time ever in my life at home, and prayed to God and Jesus above, to please let my SSDI judge be a human being, be kind, caring, and loving, and be someone who would give me the judgment that HE would give to me. Whatever it would be, I would accept it. I knew in my heart that HE knew that I was truly injured and could not continue to work. The moment I entered the hearing room and saw Judge Sanya Hill Maxion, I saw the love on her face. If God was a woman, she was Him. And my Allsup representative was my guardian angel. When I go home, I cried and cried with gratefulness. I used to know OF God, but now KNOW Him. He IS love. Thank you God, and thank you, Judge Sanya Hill Maxion, and my Allsup guardian angel!

This judge did not do his Home work. the court refused to allow me to present evidence I thought important and in the letter that followed after my day in Court, I was called a liar while my disabilities are fully documented from the military. He chose to use a reference from a Doctor at VA Hospital named Dr. Martin Lauber who lied and falsified my Medical Records and He never mentioned that I said under oath that the Doctor lied and i could prove it. In my view, This Judge must get paid by Social Security to deny certain cases. I worked 40 years and paid into Social Security and when I become Disabled? I can't draw my Social Security because the social Security Administration robes us who are disabled I am 80% disabled from VA I have 50% sleeping Disorder and 30% nerve damage from active duty in the Military. I have been to 4 Physical Rehabs and over 3000 pages of medical records. The fact is I did not get my Disability because I am white and not Hispanic. Social Security you are crooks and i bet you pay an incentive to judges who deny cases too but that is my view and my right to hold it. my social security goes to social Security unions for their trips not to those who need it

He is the WORST!!!! I had private doctors do my evals as well as there retarded doctors and he only went with the retarded doctors opinion. I am not mentally disabled, I am physically disabled and all he wanted to focus on was my mental. Therefore DENIED!!! I personally thought they picked up a bumb off the streets of Stockton and told him to play judge when he walked in. Shorts, robe, long greasy straggly long hair. I felt like asking him to please take a shower when he came in. Not impressed at all. Maybe he really does need to go to law school again. At least personal hygiene and professional training. His remark in my denial letter "claimant was well dressed and put together so she can take care of herself". HELLO I am going to court, I thought I should get out of my jammies. Maybe he should take some of his own criticism.

Professional judge with solid statistics. He is not the worse judge in this office or Northern California. Yes, he's very laid-back and no, he's not coddling you. He has to decide how to use the taxpayer's money and he takes that seriously so he will question you about smoking, weight, etc... If obesity aggravates your condition or smoking, why should taxpayers pay for that? I'm not asking that but that is the question the judge will want to know. Or why should we pay this claim for a diabetic who refuses to take his insulin. So judges will ask tough questions. Judge Skarda, like most judges will go with the state's RFC if there are no opinions from treating providers OR opinion evidence from treating provider's based solely on subjective complaints or not consistent with record as a whole. Claimants will view him hardly because they've only seen him once. As an attorney, I can say he's fair and professional, and quite thorough in how he handles his cases.

ALJ Skarda apparently believes that it is his patriotic duty to save the country money by denying disability claims. I represent claimants in the Sacramento, San Raphael, Stockton, Fresno, and Redding hearing offices, and Skarda is the most conservative ALJ in Northern California. For instance, in one case my client went to hearing in a necessarily prescribed walker. Her medical records were voluminous, with many opinions from her specialists. Despite conflicting medical source statements from my clients specialists regarding her RFC, Skarda gave the VE ridiculous hypotheticals, which were answered by the VE with equally ridiculous representative jobs. In the written decision, Skarda gave controlling weight to the state agency examiner's opinions, despite overwhelming contrary evidence from the claimant's doctors. This ALJ needs to be brought to the attention of The Division of Quality Service and disciplined or removed from the bench.

1 of the top 2 judges in the Oakland ODAR. If you lose with her, then you have no case, essentially. She will ask reps to expand on any arguments they make with specific references to law, regs, rulings, or the evidence, before she considers them. Judge Hill-Maxion will give you a lot of leeway to develop cases post-hearing, to clarify negative issues, and if an ME says a listing, she'll end the hearing very quick to grant.

Christopher Trevor Skarda has let his license to practice law expire from what I saw online, so he must think he has this job for life. He does act snobby and prejudiced. He made sure to ask if I smoke. He also made a big deal of my weight, I felt shamed, then did not consider it a disabling factor or symptom of the disability. Yes, I saw that look of contempt on his face several times during the hearing. A good piece of my disability, mentally and physically, was from physically violent domestic abuse, which was never considered or discussed in my decision letter. I seriously question his ability to decided anything fairly because he seemed more interested in his own biases in the decision letter.

Beware of so-called "credibility determinations" made by ALJs, who are also found to be "less than credible". Administrative Law Judge William C Thompson, Jr., has been found to substitute his own medical opinion for that of qualified physicians. Further, ALJ Thompson has been found to refuse to follow instructions of the Appeals Council when a case is remanded to him. In 2012, Federal Magistrate Judge Carolyn Delaney cited numerous errors and abuses of power by ALJ Thompson in John Oliveri v. Michael J. Astrue (Case Number 2:11-1634 CKD; see http://ca.findacase.com/research/wfrmDocViewer.aspx/xq/fac.20121030_0014845.ECA.htm/qx). The actions of ALJ Thompson were found to be so egregious that when Judge Delaney remanded the case to SSA, she ordered that it be sent to another Administrative Law Judge- a vote of “no confidence” in William C Thompson, Jr.

20 Code of Federal Regulations § 404.941(b): “We may conduct a pre-hearing case review if- (1) Additional evidence is submitted; (2) There is an indication that additional evidence is available; (3) There is a change in the law or regulation; or (4) There is an error in the file or some other indication that the prior determination may be revised.” Administrative Law Judge William C Thompson, Jr., uses the Initial Agency Examinations to characterize the non-severity of claimants' stated impairments. Then, upon receipt of claimants' medical records from claimant treating physicians, the ALJ uses said medical records to mischaracterize the claimant, based on the Initial Agency Examination. By so doing, it becomes clear that the ALJ makes such determinations in the absence of [C]urrent medical records. The [C]urrent medical records are not reviewed by the same Agency Physicians. Rather, ALJ Thompson argues that he reviewed the medical records and found them to be lacking. The determination process appears to be flawed, where there is [I]nsufficient time for an ALJ to receive additional medical record evidence, either during or after the Hearing, and where the process itself is used to "lock in" a sequence of events where the initial finding of "non-disability diagnosis" from the Initial Examining Physicians becomes immune from scrutiny and comparison through “legal trickery" where the ALJ "uses the inefficiency of their own internal process to hamper 3rd party medical record opinion and declare the Initial Examining Physician determinations to be [S]ubstantial Evidence for which the claimant is denied disability status." This has national implications due to the number of disability applications filed with the Agency each year, and is a possible Constitutional violation of the 14th Amendment that guarantees all citizens the right to Due Process and Equal Protection Under the Law.

I filed an original application for Social Security Disability Insurance benefits on January 14, 2005. Two years later, the SSA requested medical documentation and received over 200 pages of medical records from the Department of Veterans Affairs. These records were supposed to be processed by the medical doctors of the Social Security Disability Determination Service (DDS). Instead, the records were mishandled by SSA employee T. Rupp on February 8, 2007, by marking the records "No DDS Development of the Medical Record is Necessary", which meant that the records were sent to the Adjudication Unit without qualified physician review, opinion, and updating of SSA’s internal claimant process files and agency client tracking database claim for benefits, and a hearing was held six weeks later on March 23, 2007 in the absence of any medical certification by DDS (the SSA Determination Unit) of the required second set of claimant’s treating physician records (2 years’ worth of claimant’s treating physicians VA medical records) for adjudication and evaluation by Administrative Law Judge William C Thompson, Jr., who did not request a continuance so that the medical records could be properly evaluated, but instead took it upon himself, who is not a physician, to make a determination without qualifying physician opinions regarding the records (in effect, practicing medicine without a license). On appeal in federal district court, Daniel P. Talbert, a Social Security Attorney, further concealed the fact that the required second set of claimant’s treating physician medical records were never processed and reviewed by qualified SSA medical staff. ALJ Thompson and Daniel Talbert both mischaracterized my actions in filing a claim for benefits, and both sought to juxtapose the initial medical record (initial 15-minute consultative exam by Social Security contract physicians) and reports from the DDS medical records in place of qualified physician opinions by SSA Determination Unit for the second set of required reports (2 years’ worth of claimant’s treating physicians VA medical records) to be created and provided to the Adjudication Unit for opinion and a decision. The second set of records and reports are absent, and in the absence of these reports, the ALJ STEPPED INTO THE SHOES OF THE DETERMINATION UNIT (DDS) WITHOUT AUTHORIZATION, COMPLETING THEIR WORK AND IN SO DOING, CRAFTED HIS OWN RECORD REPORTS, THEN EVALUATED THEM FOR FAIRNESS, THEN, BASED ON THE NOW “COMPLETE” RECORD, DECIDED THAT THE CLAIMANT DID NOT MEET THE STANDARD FOR DISABILITY BASED ON THE SUBJECTIVE REPORTS HE CREATED AND LATER DETERMINED WERE DEFECTIVE OR INCONGRUANT, E.G., NOT MEETING THE QUALIFICATIONS FOR DISABILITY STATUS, THEN LATER RULING ON HIS OWN MEDICAL OPINION- DENYING THE CLAIMANT DISABILITY BENEFITS. T. Rupp, ALJ Thompson, and Daniel Talbert are all SSA employees who caused or contributed to the mishandling of my medical records, and the act of publicly humiliating me by posting my private, sensitive, and confidential medical record data on the Internet, which is now prominently displayed upon typing my name in a search engine. These abuses occurred at the Office of Adjudication in Stockton, California, Office of the General Counsel in San Francisco, California, and at the United States District Court for the Eastern District of California in Fresno, California.

Even though his approval ratings have improved since he worked in San Jose(70% denied), this is not a judge you want to appear before. Most of his opinion is based on the Social Security doctor's evaluations and not the overall medical record. The problem I see with this is that the Social Security doctors only see the patient once and their opinions are obviously swayed to the benefit of their employer and not the patient.

Judge Thompson is the worst in the system. When a case is remanded back to him by the Appeals Panel because his decision is not supported by the evidence, he searches for information on his own and submits inaccurate information as if it is a fact, when it is not. I have several severe disabilities and Judge Thompson has made biased remarks in his decisions regarding some of my doctors, and also said he doesn't give any weight to the reports of my neurosurgeon, who just happens to be the Chief of Surgery at one of our local hospitals, and is well respected throughout California. Who is Judge Thompson that he can just disregard medical evidence and reports at his own whim? Then after introducing his own evidence, after we already had the hearing, denied us the right to dispute what he said.

Although, I do not know the outcome of my hearing just yet, I must say this Judge made my hearing so easy, so stress free. Very pleasant, and I felt very fair. Sweet, seemed to care.
