Judge Palenske has been the recipient of some incredibly false and ridiculous critiques on this board. Firstly, her award rate is in line with the national average, which would itself indicate that she is applying the law faithfully and fairly. As a highly successful SSDI attorney, I have appeared before her many times. She rightly expects lawyers to fully and thoroughly present their cases. She listens more than she talks, and many of her colleagues on the Bench could learn from the thoughtful way in which she conducts her hearings. She is always respectful and courteous to each and every claimant, and always arrives at well reasoned legal conclusions regardless of whether the outcome is an award or a denial. If you have a good lawyer who follows Judge Palenske's specific pre-hearing instructions, and takes the time to carefully develop your testimony in court, this judge will award your case, provided that the medical evidence supports the severity of your allegations. ALJ McGrath went above and beyond recently, and by his efforts, allowed my client her hearing when there had been a serious miscommunication regarding my client's file (it had been sent to another hearing office by mistake, and the hearing cancelled - all without notice to myself or my client). Another ALJ might have shrugged their shoulders and said nothing could be done, so sorry; ALJ McGrath instead tracked the file down, had it sent back to North, and worked the hearing into his already scheduled docket. While we are still awaiting results, we are grateful to have been able to conduct the hearing as we had planned, especially since my client traveled from TN to Athens for the hearing. Thank you Judge McGrath!

One of the worst judges in this office. Doesn't use vocational experts. Forgets to swear in witnesses. Sits on denials for months at a time. Will find the dumbest reasons to hold the record open in cases. For people that have waited years to have their cases heard, be prepared to wait even longer to hear back from her. URGENT JUDGE AND NEEDS ATTENTION IN THE WORST WAY. WHAT DO I DO ..I was found disabled back in dec last year. ssi is with holding my monthly check from me that i use to live on. they made a mistake on what to pay my attorney and are now withhoding my ssi because Judge John E. Case re-opened my case after finding i was disabled and added more back-pay. I am about to be evicted because I havent been able to pay my rent on disablity alone which is only $375. my rent is $600 a month and my only source of income is social security. shouldnt that amount that my attorney was owed come from my back pay and not my monthly check im suposed to live on. i called both local and main social security offCie and they tell me there is nothing they can do to help me. Judge if you read this please I beg you to respond to me. I asked my attorney for help and they tell me my case is done and theres nothing they can do either. PLEASE HELP ME. my first claim was DENIED by this alj, even though he stated in his decision that i did in fact have two severe impairments.. of course the AC kept his ruling intact and my atty filed in federal court. well here it is 6 1/2 yrs from initial filing and 3 yrs after it was denied at appeals council and taken to fdc, my claim was remanded due to ERROR by the alj for NOT giving my treating doctors RFC any weight and going by what the ssa med examiner (which i never saw to begin with)said at some point before my initial denial (which only took a few months to get)..my hearing was NOT that quick, and also we waited for at least 15-20 minutes before hearing started as the VE was LATE. mind you judge started without the VE, and he finally arrived about 10 minutes before my hearing was over..he heard me answer the last 2 question is all. yet the judge took his opinion that there were thousands of jobs in the national economy within our region that i could do?? i am like the rest of you, i believe he has his mind made up before you go in the door...well, he messed up on this one and now i get a new hearing and hopefully with another judge

Our office has had numerous hearings with Judge McGrath. He has a reputation for scheduling several hearings at the same time and taking them on a first come/first served basis; will start early if you get there early; does NOT like submission of medical records on the day of the hearing. Generally does not ask for opening; lets rep do most of questioning and just cuts in when he has a question. I think he often has a good idea of how he feels about a case and uses the hearing to see if it changes his mind. His award rate is not out of line, so he's not denying everything that comes through the room. (Claimants need to understand it isn't the number of pages of records you have, but how well the opinions are supported by clinical evidence, diagnositic testing and your own credibility).

I have heard complaints about this ALJ being intoxicated in the past; my understanding is that this situation is under control now. I've had a number of hearings with her in the past couple of years and she always seemed fine and well prepared. She doesn't usually ask for opening or closing statements. She will cover most of the important stuff in a general way and then let rep follow up on specifics. She will award a solid case. She does often run late in starting hearings.

Judge Frederick McGrath claimed he could not read the RFC filled out by my doctor because "the doctor's handwriting was not completely legible and his signature was indistinguishable." There were approximately 30 cases he ruled on before he saw me the day of my hearing and it seemed like he had already made up his mind on each case before the people even entered the courtroom. He wrote about my mental health in his official ruling even though my claim was entirely a physical case with all of my mental health issues (depression because I am unable to work) being a direct result of my physical disability.

I was denied even though I have more than 4,000 pages of medical records, dozens of doctors supporting my claim and submitting written statements, and the court-appointed vocational expert testified that there was not a job I was suitable to do. Mcgrath ruled against this suggestion and said I could do a job that did not require standing, sitting, working with my hands, concentration, memory, interaction with people, and would allow me to lie down for extended periods of time each hour. I also require a caretaker (who is writing this message as I am unable to do so) on a fulltime basis to feed, cloth, bathe, drive, make appointments and manage my dr. schedule, clean, cook, and take care of basically all of my needs/activities of daily living. He made the decision in less than 5 minutes and asked me less than 10 quick questions. His decision was overturned on appeal and has been sent back to be heard in court for a second time. I first applied for disability in 1999 and have spent the last 6 years appealing his ruling. I am going back to court in the next 6 months or so and will let you know who I get and the judgement.

Personality-wise, she is incredibly rude, interrupts and is argumentative, even catty over things, such as semantics during questioning, and anything petty. She loves to show whose in control. I respect her position but not people who act like this. She even tried to say my client needed to lose weight! My client was barely 10 or 15 lbs overweight--- and behind the bench, she looks at least 50 lbs overweight. with that fat rosy face of hers She's one of those people who use their power to be mean because they are powerless and feel worthless in their personal life.

I requested that the Appeals Council reopen a case where an unrepresented client went before her. They agreed!! The Judge said that the client was a secretary and performed someother job that she never did. Also, the client was 3 months away from turning 55, and she would have grided out with the light RFC that the Judge gave her. However, the Judge in her discreation found her to be 54, and denied her case. Also, the Judge never considered several of the claimant's medically determinable impairments.

This Judge really doesn't need to be doing Hearings. I never had a Representative but the Representative that was with her before me laughed on the Hearing date about how the Judge had been drinking. I do not drink but I really don't know why our SSA allows a Judge under the infulence to listen to cases.. This Judge was literally falling on the desk, speach slurred and I was amazed this woman was going to make a decision on me that would affect the rest of my life. Of course I got denied but she had no clue what was going on that day and I get a denial because of her inability to even stay focused on my Hearing...
