I am shocked! THSI JUDGE is making prejudice decisions that have no basis and should be fired on the spot. her approval numbers are the lowest in her ODAR office out of 13 judges and the judges number of approval are less than national averages. She is disapproving Approvable claimants. This Judge put no weight on all of the doctors that actually have diagnosed me as totally disabled including the state doctor. Let me quote her in section 2 of the 14 page disapproval letter, section 2 - "2) the claimant did not engage in substantial gainful activity during the period. Of note, the claimant alleged he suffered a concussion in May 2010, though he continued to work until april 2011; his 2011 earnings totaled 6580$ .considering his 4 months of work activity in 2011, this amount represents earnings of $1645 per month:for the year 2011, earnings over 1000$ per month usually represent engagement in a substantial gainful activity. However, even if the claimant were engaged in substantial gainful activity during these 4 months, this work predated the alledged disability onset date. NONETHELESSTHE UNDERSAIGNED FINDS SUCH WORK ACTIVITY REVEALS AN ABILITY TO WORK DESPITE RESIDUALS FOM THE CLAIMANT'S MAY 2010 CONCUSSION" how CAN SHE DETERMINE AN ABILITY TO WORK AND MAKE THOSE STATEMENTS!!!!!! I also do not know what rom she was in during the hearing because she got soooo many things literally backwards. for example, she writes that my brother goes shopping with me. NO HE GOES SHOPPING FOR ME. This judge needs to be resigned. she is by FAR the lowest approval allowing Judge. she is below national averages and is has the lowest approval numbers is the south NJ ODAR office. Now I have to wait another year and a half to get this thing through an appeal! This should have been an easy favorable decision and this judge made a bias prejudice decision citing "the claimant was making sandwiches" as a reason for discrediting the doctors writings. she makes credibility jabs that have no basis. she literally gets information backwards to support her denial of benefits. She makes references saying the claimant not taking Ritalin regularly was a reason for a disapproval bc claimant did not follow doctors orders which is totally wrong. Her 14 page denial letter of david Hubert is an injustice supported by nonsense! SHe should be reprimanded. There is no reason to give no controlling weight by al the doctor that examined and treated and saw the claimant! THIS IS SUCH A BAD DECISION and even worse 14 page WRITING BY THE JUDGE. Its a travesty because she is prejudice and not putting weight where it should be and makes many many misstatements and exaggerations to support this truly moronic decision that she directed. The claimant was struck in the head with a deadly weapon by a 7th round NFL x pro football player and she refers to it as simply a hit with a fist. She also refers to claimant having wrote the words "makes sandwiches" as reason for no weight on what my doctor wrote on claimants behalf. SHE IS A JOKE to this system and she is causing unnecessary suffering of disabled workers. And her low numbers of approval are the lowest in her ODAR office and below national approval percentages as well. what a bad draw getting this prejudice fool who does not listen to what doctors say and literally flip flops words from hearing. there is no support for her decision. The vocational expert said claimant could not do old work but came up with some jobs he thought the claimant could do, however, the judge wrote that she did agree with doctor that claimant should not be around machines that can cut, or crush claimant is her decision, yet the judge did not tell the Vocational expert that there are limits on work environments for the claimant before Vocational expert made his testimony. The jobs that are listed are jobs that have these restrictions. It would be nice if this judge could somehow admit her wrong doing and make this thing right! this is not right the way it stands and the appeal has been filed.

I only just had my hearing for ssd this morning but I have to say that regardless of the outcome, I found Judge Kearney to be a very pleasant and likeable man. He made me feel very comfortable and at ease throughout my hearing. If I was given the choice of judges I wouldn't think twice in choosing Judge Kearney.

I think Judge Kearney is a very nice compassionate man. I do not know the outcome of my hearing yet but that's okay for now. I was so nervous and tried my best to not get too emotional and he understood.

I didn't think it was possible to feel more depressed, anxious, sad, panicked, and sick. Thank you for proving me wrong Ms. Collins. I was a tax-paying citizen for 16 years before becoming ill. I told Ms. Collins of my plan of action to get well in the not-to-distant future. I told the truth as nervous as I was. What I received in return was an unfavorable decision in which 2 things were stated that I never said (and I am sure I didn't say them because they are just plain untrue) and most of what I did say was omitted or ignored. This has been such a heavy, dejecting process. I am sad, but I am also so angry that this woman who knows nothing about me (and has the facts wrong about what she thinks she does know) gets to decide if I am sick enough to use the Social Security that I have paid into my whole life for what it is intended for. I understand that many do take advantage of the system. I told the truth and had all my ducks in a row. So, why am I sitting here worrying about how I am going to tell my kids that we have to move our of the only home they have ever lived in?

Judge Robert C King is one of the worst judges in all of the entire United States of America. let alone "Akron, OH". He is very rude and very uncompassionate to peoples conditions. I know his job is to Deny, Deny, Deny as much as humanly possible and his record shows that. His demeanor is he is sick and tired of hearing people basicly whine and complain, but you are there for that reason to just get your point/disease across. But that is "His Job"! He needs to retire and let someone else move up in that office who can give a Fresh perspective on cases. My opinion only. Thank You for your time.

WE have people out here that get SSD and work full time and only have fibromyalgia n depression. I go to work fighting my pain with my back swelling back and hips and legs. I have gone to doctors after doctors and they can not find what the cause is, while that I fight to work to keep a roof over my head 21 hours a week. I go to school to keep my mind going and fight sitting and standing. This lawyer denied me for that. But orhter people get it for easy things. this is a shame people fighting for the pain they can not tolerate. I will fight more. it is that days i dont even want to be here because of the pain.

I don't understand how come it takes so long to make decisions on cases. I fight my pain everyday, wake up every day n go to sleep in pain. There are times after working i want to go the ER because i hurt so much. No medicine will help my pain Dr.s have tried everything. I work go to work n fight my pain just to keep a roof over my head. I go to school to keep my mind going n better myself and fight pain walking, sitting and standing. I have a feeling it will be denied and I'll have to start all over again. These doctors out here really don't want to help you if your on medicaid and it is a shame.

I have read his book and appeared before him many times. There are some postings that say his book and,in fact,Judge Marks is anti-lawyer. I am from Youngstown where he lives and I can tell you that nothing is further from the truth. He is a true lawyer's Judge. Your clients might be underserving now and then but you are going to get a fair shake and then some from him.

I was not happy with my client's outcome but he provided an interesting hearing, lots of questions on esoteric matters. I thought a real jurist but sometimes a little odd. Late note:I just got a response to my post hearing memo and he reversed himself. He communicated with me by email and said he was impressed with my memo and reconsidered, giving the benefit of the doubt to the claimant. Go figure.

I note that Judge Marks numbers for 2010 were only for 10 months as he retired at the end of October. On that basis his numbers don't look too good for claimants but if you look at his numbers in Cleveland where was the HOCALJ, his favorables were significantly higher.
