This judge is horrible, he never takes any of his cases seriously hes very judgemental and has never approved any African American person. I know him very well. Its just sad I dont see how hes a judge

The more "desirable" comments left below were obviously fabricated, most likely by Judge Gilbert himself. I've worked in close proximity to Mr. Gilbert on many occasions, and can attest to the fact that he is no longer competent enough to perform his duties. I feel bad for him but he is currently a danger to the community and should be evaluated immediately. If you're certain you've enough evidence for a favorable decision, I recommend contacting the Appeals Council directly upon receiving a denial from Judge Gilbert. They are aware of his conduct.

Hi, I want to say that the judge my mother had on 8/1/2014 was a blessing. Finally someone listened, and heard the cries of my mothers pain of all that has happened to her in life. Her anxiety,depression,PTSD,Abuse,and other health issues. My NANA went with her that day, and they just prayed for farines, being on the negative that was being said about judges not caring. Well my mother said the judge, and the staff treated them well, and that was a shock for her. My mother told me the judge listened to her, and showed he was a human being with care. My mother just prayed,and gave it to God. She said the lord knows the truth, and will be on her side. Her verse Psalms 7 she just kept saying it. My sister, and I feel a little better going off to college know. My mother wants to thank Judge Gary Elliott and staff for letting her speak, and her approval. She will never be the same, but a least this part of the system showed her they care about mental illness. The lord is watching over her, and my NaNa and PaPa. Helping my mother with paper work. We needed location for address. She came across of some scary reviews that people wrote. They wasn't treated fairly, and was judge by them not caring. We came across one that said that one of the judges did care. To see her go in to anxiety attack again scared me. She has been a fighter all her life, and worked hard. My mom is not the same. We lost her years ago. She always kept putting the strong face on. My sister, and grandparents would hear her cry at night, and break down. I'm praying that the Judge is honest, and fair. My mother has been through a lot with sickness, and other health issues for years. This VA scandal with high ups not protecting people, and helping is sad. They end up hurting people, and they die. Mental illness is serious, anxiety, PTSD, Depression, being abuse, and other chronic medical issues. My mother worked hard in life, and did everything right. What happened to her in life still hunts her. People deserve their disability. Nobody understands until you have the issues. Mental issues is serious. My mom covered hers up for years when bad was being doing to her for us. Until you have a panic attack, anxiety, depression or see it happens to your love one. It's hard. He was very understanding and nice. Allowed me to enter the court room with my husband and got straight to the point so we were not in there for ever. Almost like he took his time reviewing the case file before hand and already had his decision made.

This judge saved a life on Wednesday. She undertook an extensive review of a huge paper file, conducted a thorough and difficult hearing and helped everyone in the room better understand this very troubled and injured person who told me in tears after the hearing that the benefits were her last hope. She saved a life on Wednesday.

Just wanted to say that after reading all the negative stuff about judge Hyatt, I was terrified to go to hearing. Anyway, the first hearing, my lawyer got us kicked of within five minutes, so the judge rescheduled me. My second hearing we had a snow storm and i was having a bad panic attack so i was late. Judge Hyatt could have easily dismissed my case for that but he didn't, he rescheduled me yet again. I went to this hearing and everything went well. He apologized for everything taking so long and was a very nice person. So i just want anyone who has a hearing with Judge Hyatt to please dont pay to much attention to the negative comments. He was very proffessional and helpful. If all those comments were true i dont't think he would be allowed to be a judge. Thank you Judge Hyatt for being patient with me and giving me the chance to have you hear my case.

He lied on over half my claim, now my points will be up in September and I'm told a revue would be 15 to 18 months out !! Its so unfair that people like this can lie so much about you knowing theres nothing you can do to them ! Its really sad !! Its really sad that these judges don't take more time to see just how bad a persons health really is. I had my hearing last October and just now got a letter. I've been trying to get on SSI disability for 4 years now. With letters from my doctors for the last 2 years. I have peripheral neuropathy from my nees down and in my wrists and hands. Copd, Asthma, sincopes, and type 2 diabetes uncontrollable. I take 22 pills a day ( 16 for pain alone ) 3 inhalors, 112 to 120 units of insulin a day. I can't sit or stand for very long without a lot of pain. Its hard to breath around a lot of things, I'm on oxygen at night for sleep apnea. First thing out of the judges mouth was I know your health is very bad that's why we don't have a doctor here with us today. But I'm sure there is some kind of job out there for you !! Well he kept me there for 2 hours trying to find a job for me with no luck. And now once again kicked aside from another worthless person ! I mean come on, if there is a job out there that will let me sit down and rest evry hour or two, pop my vicodin evry 4 hours, use my cane on bad days, Take your cape off, get your butt from behind that desk, and find me that job ! I worked my butt off all my life and my government took money from my pay check just in case I was to get sick like this to help me. So now I have to fight to pay my bills and put food on my table for my wife and me because YOU don't feel I'm to sick not to work now. Well its to bad I can't put your feet in my shoe's for a day to really see how I feel. I honestly feel that some one like you should not have the power you have to be able to abuse it the way you do. Good luck down the road because I'm a firm its going to come back to bite you in the butt !!!

THESE JUDGES BETTER THINK LONG AND HARD BEFORE CONTINUING TO DENY VALID MENTAL HEALTH CASES SO QUICKLY THESE DAYS. THERE'S AN UNPRECEDENTED NEW AMOUNT OF UNSTABLE INDIVIDUALS ON THE NEWS EVERY NIGHT, FOR DOING SOMETHING HORRENDOUS BECAUSE OF THEIR MENTAL HEALTH ISSUES. MANY OF THEM WERE DENIED SSI. Another Bernath Sock-puppet raging on Judge Hyatt's comments page. It diesnt matter Bernath, you have been barred from being a representative by Social Security because of over 50 examples of misconduct with the courts and dealing with clients. Probably cashing and taking their settlement checks like you did in California. You cant even get licensed by the Oregon bar because they refuse to give you one because of your record as a thief and liar in Ca.

I used MR. Bernath to fight for me in receiving SSDI. With his kind help I was Awarded SSDI in the shortest time possible. I actually had SSDI check in my hand 6 months after my very first phone call to the BEST and most honest attorney in Oregon-Daniel A. Bernath. I fired Schnieder in a work comp case, they won't work for you but for themselves. Use Bernath, call him and you talk to HIM e mail him and he'll respond that day or the next, just emailed him on a Sunday, he responded the same day.......a half hour later. What other attorney in the U.S. would do that? He is with out a doubt "the" Attorney for SSDI. TFS

Reading through these comments it is very apparent that The Judge's page has been "spammed" with negative comments. This is probably the action of one Daniel A Bernath, a shady "attorney" who was denied clearance to practice state law by the Oregon Bar due to "low moral Character" while an attorney while a member of the California State Bar, due to failure to support his children, forging and cashing his clients checks without their knowledge and destroying his legal files. This same Bernath crashed his private plane due to him not putting gas in it, and is now trying to sue several companies for millions of dollars because " he wasn't informed" that the plane could have problems with little or no fuel. He has published a long boring list of accomplishments that are emblellished or unverifible. He claims to be a 90% disabled PTSD from Vietnam, while his service consisted of being a photographer aboard a ship. He photo shopped his face on the picture of a Navy Chief Petty Officer and says he was made an "honorary CPO" when that title can only be given by the US Navy. In summarizing I am posting this to simply ask that the people who want a review of Judge Hyatt disregard the negative posts by Bernath and his sock-puppets. A simple google search will link you to news articles that give a balanced account of the interaction between Bernath and Judge Hyatt. As a side note I am also a retired veteran who draws a 100% VA pension and SSDI, so I understand the concerns of anyone going through the process.

Before my hearing last month, I made the mistake of coming on here and reading these reviews. My panic attacks started increasing the closer it got to my hearing date. After a childhood and life of being abused, I thought, I can't take one more person being cruel to me. I had a vision of a horrible person in my head. I was expecting the worse. I was shaking, scared of what I was about to have to talk about, and scared to death of this judge. But yet he was kind to me. I felt like he was genuinely interested in what I had experienced as a kid, and what it has left me dealing with on a day to day basis. Not one time did he make me feel bad, belittle me or do anything that is stated here. The first words he said to me where, "I can see you are really nervous, and I want you to know it's going to be okay." I won't ever forget that he said that to me. He did dig into my life big time, but I felt like he needed to, not only to understand me, but to understand what I have experienced and how it affects me each day. I honestly felt compassion from him, and maybe that's because I was horribly abused as a child, and he could connect with that somehow. I obviously don't know him personally, so I can only guess. But I had to come on here and say my piece, because I appreciated that he was kind to me. At one point, I broke down sobbing, and they even got me some water to drink. My honest opinion/feeling is that Judge Gilbert's no nonsense approach may be misinterpreted as meanness. All I can say is that my personal experience with him, I did not see this mean person that everyone has talked about here. I experienced a judge who had taken the time to read my case, and find out who I was and what had happened to me as a kid. I appreciated that in itself. I have not received my decision yet, and no matter what it is, I still stand by what my experience was. I also have a rule that I don't write bad reviews online about anyone. There's enough meanness in the world without me adding to it.

I waited from 1999 to 2011 to have my story finally heard, & when I received my paperwork I cried for over a week straight. She not only turned info about me into bold face lies, but also based my entire 12yr struggle on a Drs opinion that I saw one time! I've had to live in poverty, since my disease makes having kids a huge problem, but if I would have had them if be able to receive benefits. Me attending college & being misdiagnosed for 5yrs cost me everything. I think she's extremely unkind, uncaring, & doesn't take each case into consideration. She saw a young woman, who doesn't look disabled, & wrote up a denial letter that only the most heartless person could ever write. She's the reason I will remain w/out finances to even purchase my 8 meds monthly.

The judge made a point from the onset of the hearing to ensure comfortable and open dialogue. He researched our situation and respected our intentions for the hearing. He gave us a list of items he wished to see before he would make a final decision. His willingness to hold off on making a final determination until all fact were reviewed, ensured that his final determination was accurate and fair.

Judge means well, however, in the end he still has no control over disability. They don't care what he does or says. Federal judges have the final say, I don't think so. Very disappointed, his failure to stand his ground or hold his authority, whatever, cost us everything.

My Hearing was on 12/21/2012. The Court completely ignored medical records submitted after the Hearing (by extension of time) from a major stroke incident which would prove that the claim was within the time limits required and ignored extensive medical records from the Veterans Administration claiming that they did not receive them even though my attorney provided me with proof that not only were they sent, but also received by the office. The VA records show that the claimant has: Aortic Valve Disease, chronic PTSD (from the Vietnam war and from another source), Tachycardia, Sinus Nerve, Injury to the peroneal nerve, uncontrollable Hypertension, Inververtebral Disk Desease, Depressive Disorder, and is partially paralysed. Any one of these would result in a disability award except the Judge decided that he wanted to dwell of the Claimants recently deceased life partner of 32 years with questions about homosexual issues such as what illnesses my partner had. A detailed appeal was made to the Office of Disability Adjudication and Review and the claimant has requested a copy of the audio transcript however thus far they seem to be avoiding providing that to me. This tranascript is needed for a future Federal Lawsuit against the Social Security Administration as this current appeal is the last required stop before being permitted to file in the Court. Is there a personal Judge bias here or just how disabled do you need to be to claim?

Well, the good news about losing a case is that you have one more appeal then you get to cost the U.S. Government big money as you take your case to Federal Court. I would recomend that those doing so carefully review the transcript and also get an audio copy. If you can prove malice, you can get the sky's the limit money when you sue. I have known that some of these Judges disregard medical reports and statements without providing an opposing professional opinion. Nice kangeroo court tactic.

Dan R Hyatt, admin law judge attacks helpless lawyer on crutches. Sworn declaration for Restraining Order issued against Dan R Hyatt. During my hearing on March 31, 2010 the administrative law judge wore a black robe and sat elevated from me. The judge was Riley Atkins and he had curly black hair. 2. He said to my lawyer “this is a case only about whether or not the time period is up and extension. I rule that she is past that time and therefore I will rule against her. As that is the only thing we are here for I will not take evidence about her disability.” 3. My lawyer said, “Wait, let’s not go so fast. Let me see the Notice. I didn’t get a copy” 4. Atkins said, “You had the chance to look at it before. Did you make an appointment to come and see the file?” 5. My lawyer said, “No, let me look at it now.” 6. Atkins then handed it to my lawyer (by handing it first to the vocational expert). 7. After my lawyer read of the file and his long discussion with the judge my lawyer turned to me and said, “claimant…” 8. The judge interrupted my lawyer and said, “Show some decorum. Her name is Mrs. Johnston.” My lawyer said that he was making the record clear after the long discussion with the judge so the record would know that he has stopped talking to the judge and was now talking to me, the Claimant. 9. My lawyer read to himself, the Notice and my Request for Hearing before an ALJ. He then asked me some questions and then the ALJ interrupted him again to stop him before my lawyer could complete what he was doing. 10. My lawyer said that he was not “going to close any doors” and that he believed that because of my mental condition that there was “good cause” to extend any deadlines and to deem the Request for Hearing to be a new application at the very least. (That was what I believed I had been doing when I wrote the Request for a Hearing-requesting a new application). 11. My lawyer refused to give up any of my rights and demanded that I be approved to be back on disability today. 12. The judge said the case wasn’t “worked up” and some other things. 13. The judge then said to me, “madam you have to go to the field office and file a new application.” 14. My lawyer said, “She should take advice from her lawyer and not from the guy who is throwing her out of court.” 15. Atkins then said, “Ma’am you should file a new application in Beaverton…” 16. My lawyer then said “Don’t give my client legal advise. I’ve already instructed you on that once. It isn’t your role.” 17. At all times my lawyer acted calm, professional and civil. If he didn’t act that way then I would have had to flee him (because of my severe mental illness). My lawyer acted calm, quiet, professional and civil at all times and that was how I could attend the stressful hearing. 18. My lawyer was not loud or argumentative. He made his objection heard and then made it again as I expect a lawyer to do in a courtroom setting. 19. My lawyer at no time was threatening or intimidating. 20. I then went into the lobby of ODAR with my lawyer where my husband was sitting. My lawyer Daniel A. Bernath looked at my husband and I and said, “let’s get out of here and we’ll talk outside.” 21. Dan then led the way, holding his black cane/crutch in his right hand, pulling his big box of books with wheels with his right hand and wearing a homburg hat. He was looking very dashing. 22. Dan was leading. My husband was following him and I was following my husband when we turned the corner to the elevator lobby of the 4th floor. 23. I saw an old short man wearing a brown colored outfit in blue jeans with silver hair already inside an elevator. Except for him the elevator was empty. 24. When we approached the elevator to get in, the old man quickly ran forward from the back of the elevator and stood at the front of the elevator and shouted “No” “You’re not riding on that elevator” “No”! 25. The old man alone in the elevator was very belligerent and confrontational. 26. My lawyer did not enter the elevator because the old man blocked him. 27. My lawyer never said a word to the old man. 28. The man then bumped my lawyer with his chest. 29. I saw my lawyer kind-of step back from the force of the blow but my lawyer couldn’t back up because the wheels of the box stopped him and there was me and about 4 people trying to get on the elevator and they were right behind him. 30. The man then hit my lawyer a second time but this time with much more power and with his chest and his stomach this time. 31. My lawyer had to work to get his balance after being knocked off his feet. 32. The man then said “call the police. I want him arrested for assault. He just bumped me.” 33. My husband Roman Johnston said in a quiet voice, “no he didn’t. You bumped him.” 34. The man then got a very wild look on his face and was very aggressive and said to Roman, “what’s your name!” 35. The man alone in the elevator became even more aggressive and offensive. He had a very wild look in his eyes. 36. That was the only time my lawyer spoke and he gave legal advice to his client Roman and said, “Don’t answer that.” 37. The security guards came. 38. That man was taken around the corner away from us. I later found out that the old man’s name is Dan R. Hyatt. 39. At no time did my lawyer’s hands leave the box handle or his cane/crutch. At no time did his cane/crutch or box leave the floor. At no time did my lawyer come in contact with that man except when that man hit my lawyer with first his chest and then with his stomach and his chest to knock my lawyer on the floor or back. No part of my lawyer’s body entered the elevator. Dan R. Hyatt used his chest and stomach to repeatedly batter my lawyer who stood out in the hallway. 40. Hyatt didn’t want my lawyer in that elevator at all even though it was completely empty and even though there were 3 to 4 elevators on one side and 3 to 4 elevators on the other side of the hallway. 41. The security guards came and blocked us from leaving and my lawyer asked “am I under arrest” and they said “no but you can’t leave.” He said “then I’m leaving now” and tried to push the button for an elevator but they blocked him from leaving. 42. The federal police came and they roughly grabbed my lawyer’s hands behind him and put handcuffs on him. As they were leading him back to the Social Security Court with his hands tightly cuffed behind him I heard my lawyer say to them “on advice of counsel I have nothing to say.” 43. The federal police asked me if I saw what happened. They took my license information but didn’t write down what I was saying. There was a second policeman and when they confirmed that I had made a statement then said I could leave (but could not talk to my lawyer). 44. I haven’t left my house since that traumatic event in watching my lawyer get assaulted and battered and arrested nearly a week ago. 45. Seeing your lawyer get arrested is like seeing your Father get arrested and hauled away. I trust my lawyer and it was all extremely traumatic to me to see my lawyer get beaten and then get arrested and handcuffed and taken away to who-knows-where. 46. I have been before Judge Michael Gilbert 2 times. I found he I believe purposely went outside the guidelines of Law several times with regards to the scope of his questions. I don't know whether to believe the statistics. however my experience has not conformed to the numbers be represented. the time it took to get my case before this judge was extreme. my case was even delayed further because judge Gilbert stated he had a conflict in his scheduling. I am a disabled veteran on state pension. I have to tumors in my liver and blindness in my left eye as well as degenerative disc disease in all but 1 disc in my neck I was sole provider for my 3 girls when I was injured on the job in nursing. that was March of 2005. I have yet to receive my hearing information. the last of the hearings was held September 18th 2012. it is now the last day of January 2013. I had to sue the last judge I sure hope this time is different. this is the worst system I have ever been exposed to in government

Judge Gilbert is a hacket man; he does not follow the law. He is rude and insensitve. He acts as an advocate not as a judge. He is a prosecutor of anyone who believes he or she is disabled. He will tear you apart as a prosecutor and minimized any problem you may have. Every person appearing before him should contact their congressman and complain about his confusion. He prosecutes you for your impairments and highlights anything to destroy your credibility.

Judge Hyatt is the kindest ALJ I have ever met. He is truly a compassionate Judge who takes a wholistic approach when holding his hearings. He doesn't just deny or allow benefits he tries to make sure claimants needs are met emotionally, physically, medically, and mental health care! The hog wash others spread about Judge Hyatt is just lies spread by terrible attorneys who don't like his rulings!!

I'm assuming you appeal the decisions you disagree with. I have appealed more than one decision in front of this ALJ and each time they were remanded back.

Judge Gilbert was not a "good Judge." and I am using the politically correct terms in order to keep my temper. He was very unethical in terms about asking in the beginning of the proceedings about my marriage falling apart and if that had anything to do with my mental state, who was getting custody of my daughter in which there was complications that obviously he was aware of that not I nor my attorney was aware that he knew of, and a CPS investigation concerning my now ex-husband that was involving my divorce that was completely separate from my medical portion of my procedings. I am a disabled veteran. I felt attacked in every way, shape, and form. I suffer from PTSD, brain lesions, asthma, a pseduotumor that has made me 80% disabled with individual unemployability through the VA. He asked about my "stressors" and when it was told to him about my events overseas, his comments were less than favorable - "Is that it???" I have been in school before getting diagnosed with my psuedotumor and because of a misdiagnosis of migraines in which are now combined with the pseudotumor to date. He over-analysed everything and even asked for extra things such as letters from my instructors concerning the provisions that they had given me in order to stay in school to graduate so I wouldn't incur a debt to the VA and be successfull in graduating. According to his extenuating notes, he stated that I appeared, "normal" as if that I am supposed to be in some sort of state when I have made provisions to get better when my sight was going to go and much worse, being a single parent with two children to care for. He questioned my integrity as a parent, a female and a veteran. After all of this, I was not surprised that he denied my social security benefits for being honest and putting me through the worst 90 minutes that no one should have to endure. If my opinion, Judge Gilbert is a sniper when it comes to compassion and I have every right to file a formal complaint for the injustice that he had put upon me. Not for just his findings, but for how his process is. And hopefully, with my complaint on record, no matter what, it may help towards not having someone else go through this for them or their family.

I must disagree with the prior poster. Judge Dantonio's opinions are well thought out and well reasoned. I rarely appeal her decisions as a result. Although I may not always agree with her decisions, the clients are treated fairly and I know that she will consider all of the evidence in an impartial manner.

This is an excellent ALJ. I'm sure his denial rate will go up at some point a little but he will show compassion and treat everyone fairly.
