    Now at Dep’t of Labor OALJ addressing disability and death cases under the Longshore Act and its extensions. Biased against claimants; ignorant, impatient, and dismissive; definitively non-judicial temperament — what could go wrong?

    She despises disabled individuals. She has nothing but contempt for them. As someone noted earlier, it appears she doesn’t read her files. She’s gone from the DC OHO so she’s no longer causing damage there. She wreaked havoc on the lives of the people who appeared before her. Very sad.

    I DON’T HAVE ANY PROBLEM WTIH HER WORK SHE IS A VERY GOOD JUDGE. I JUST NEED HER TO RELEASE MY ATTORNY’S FEE BACK TO ME, ALL RELATED DOCUMENTATION WAS SUBMITTED 6 MONTHS AGO. THIS PROCESS SHOULD NOT TAKE THIS LONG PERIOD OF TIME. THANKING YOU IN ADVANCE FOR YOUR HELP JUDGE APPLEWHITE.

    I have known this Judge for several years now, first when she was in Baltimore and now that they are in DC. The only good thing about Judge Applewhite is that she appears to do few hearings. If you are unfortunate enough to be in front of her be aware of the following. 1) Judge Applewhite is extremely unprofessional both to attorney’s and to claimants. When I first went in front of her when she was in Baltimore I in normal course waived reading of the issues. She completely lost her mind at this and started ranting that she was the Judge and she does not accept my waiver and then proceeded to go through the entire issue process. During my closing at that hearing I argued a listing and she again started ranting that she was the Judge and would decide if a listing was met. I told her I know that and this is just my argument during the closing. She did not seem to understand this and kept stating that SHE was the JUDGE and would decide the case not me.

    2) Judge Applewhite does not understand the medical records. Her ignorance in this regard is startling. When arguing a listing in front of her (a fairly common listing at that) during a recent hearing, it was clear she did not understand the medical terms involved. At one point she misread an imaging study, and at another she stated that a listing required an extra element that it did not require. When I tried to explain the terms involved she told me to “move on” and that she “would not hear anymore on this matter.” I wish this was an anomaly but it is pretty standard for her. It is not terribly uncommon for a Judge to not be medical experts on every issue, but to also refuse to hear an explanation of the existing medical documentation is absolutely ridiculous and something that so far has been unique to Judge Applewhite.

    3) Judge Applewhite approves few cases. Statistically she is pretty low and from what I can tell she is one of those Judge’s who actively dislikes representatives being in cases.

    The fact that Judge Applewhite is an ALJ is probably the strongest argument currently existing for a change up in ALJ accountability.

    She doesn’t read her cases. She mixes information up about the people she is seeing and does not listen to what is told to her. Mixed up case information causing immense suffering both financial and emotional. Should honestly be removed from this position. Bad judge.

    I went before judge applewhite my attorney said she was tough and to keep quite I spoke my mine and was approved she is a tough judge
