I read all the comments fearing a denial given my young age. I prayed for a year or more that I would have my case seen by a judge who would offer compassion and understanding to my circumstances.
I was surprised that when I dissociated in the first few minutes in front of the judge, even with my service dog with me tasking, I was so nervous and upset he was kind and offered if I wanted my support person to come into the hearing. He then explained he read my file and saw that I’d been through a criminal trial recently as a victim and not to worry, this was not nearly as formal. I was so unbelievably grateful he actually even read any my 1600 pg file as the judge in the criminal trial completely dismissed my Victim’s Impact Statement & was devastated in our system walking into this hearing. Through all the tears I explained how I was completely okay until being assaulted a few years ago.
My attorney really helped in asking questions to prompt where my daily struggles were and how it impacted my inability to work. The vocational expert suggested 3 positions that were very unrealistic for my circumstances. The judge seemed to acknowledge that and thus my attorney backed off at the end of the hearing & I was surprised that it was over and there was no rebuttal to the suggested jobs.
As I got up to leave as I walked out the door the judge said “Take it Easy.” It truly sounded sincere. I looked back at him and said “I truly wish I didn’t have to, but thank you.”
This judge was an an answer to my prayers as I got word this week my case got a fully favorable decision. My next prayer is that in a few years, I continue to recover and someday can go back to work and then somehow thank this judge and tell him he was an answer to my prayers for God to provide when I needed it most.
No one e has a positive comment about this judge, even past workers in office. These workers told me to withdraw my application and file a new one. Since there is no decision, they can use records prior to withdrawal. The states DDS approval is twice his percentage. I should have listened. He makes quick decisions, if you receive a notice within 2 weeks it is a denial. His mind is made up prior to hearing. The only records he reviews is the ones from their paid for doctors and vocational expert’s first jobs you can perform. Most vocational experts magically find these jobs you can do even though they are not within your restrictions. He gives not weight to specialist in their field, especially ones you were referred to. New regulations allow such behaviors, but Appeals Council remands most of his denials, but you will have to wait around a year. Again once you see he is assigned your ALJ, withdraw and refile. His office’s wait for a hearing has decreased drastically, some within 5 months. Another tactic I was told to avoid ODARS with low approval is get a mail box at a place like Mail Box Ect that have a physical address. Provide this address to SSA. Sign up for USPS informed delivery, once you see mail from SSA go pick it up.
*********** ****** ***** is an awful adjudicator. Does not even look at doctor’s info or statements. He ******* *****. Can only hope that one day his *** becomes disabled and knows what it is like. ****.
This *********** ****** **** does not know how to interpret disability law. He approved 22% only thus far in 2018. My advice, apply in a different county or state. Interrupts, and is not personable. Unprofessional
I have a hearing on Friday the 13th with this judge, I feel like I will not be approved because my disability is not obvious. Can I get some “pointers” or does anyone have any helpful suggestions for me?
Thanks,
A
Here it is in a “nutshell”…this judge has a terrible approval rating….it is crystal clear to me that he does not listen to any witness testimony at all…he disregards all medical records, he disregards your lawyer testimony, he disregards his own disability doctors, he disregards all the claimants doctors and his own vocational expert…with that being said…how could anyone win a case that is brought before him?…it is clear to me that he already decided on a “denial” before the hearing started…In my humble opinion, his top priority is denying claims no matter what and that is SAD….so very sad that this is how our country and lawmakers treat people who have become medically disabled…the only witness he found credible was the insurance/disability doctor that looked at the records before the hearing (never examined me at all) and stated “that I am not disabled at all and can return to my previous job”…..wow…..really? Funny how he listened to her testimony huh? Talk about a scam…..yup that’s right….A SCAM
Judge has a “God complex”. You sir are charged with administering the LAW. YOU do not hold a MEDICAL license. YOU have no right to discredit what a doctor or several doctors state is a real disability to the point where someone is disabled. When a medical team including the IME’s state a person is disabled what right does this idiot have to say a client is not? He is a joke and a discredit to anyone who rightfully administers the law. He is not concerned with protecting and upholding the law. He is focused on denying claims (see this clowns track record). When a judge dismisses 49% of all claims halfway through the year (2014) it should be an alarm to the court system that he is corrupt and should be investigated. He is completely clueless on how to do his job and should be disbarred and tried for his dis-service to the American people.
Awful adjudicator with a very poor knowledge of the Rulings and Regulations. His decisions are easy to appeal: they are so full of holes you could drive a Mack truck through them. My advice to you is if you are given a video hearing with this judge, OBJECT. Ask for an in-person hearing at your local ODAR because this man will do you no favors.
Tells you to “present your case” and then interrupts, interjects, cross examines and humiliates the claimant. If claimant’s treating source has the audacity to charge a fee for a medical source statement, this judge will use it to discredit the opinions of the treating physician.
Disregarded the opinions of my medical professionals, also no regard for the social security doctors opinions and denied disability. This judge gave no weight to overwhelming evidence proving disability. It is shameful and unprofessional. Looking at his track record he denied almost half of all claims.
