I have read his book and appeared before him many times. There are some postings that say his book and,in fact,Judge Marks is anti-lawyer. I am from Youngstown where he lives and I can tell you that nothing is further from the truth. He is a true lawyer’s Judge. Your clients might be underserving now and then but you are going to get a fair shake and then some from him.
I was not happy with my client’s outcome but he provided an interesting hearing, lots of questions on esoteric matters. I thought a real jurist but sometimes a little odd.
Late note:I just got a response to my post hearing memo and he reversed himself. He communicated with me by email and said he was impressed with my memo and reconsidered, giving the benefit of the doubt to the claimant. Go figure.
I agree, very professional, very fair and has had a higher than most pay rate.
I note that Judge Marks numbers for 2010 were only for 10 months as he retired at the end of October. On that basis his numbers don’t look too good for claimants but if you look at his numbers in Cleveland where was the HOCALJ, his favorables were significantly higher.
