The chances of getting a fair hearing before this Judge are not good. It almost appears he has a bias toward injured claimants. Any adverse medical opinion will be adopted in his decision. If there is not an adverse opinion in the record, he will send out for one. He is very courteous as he guts your case.

I just had a hearing in front of him and he approved me on the spot! Remember if necessary, you can appeal the judges decision. I found the Judge to be rather caring and he took the time to listen and read the brief and any other information as he saw fit.

I had a hearing with Him and he was extremely caring and really put my anxiety at ease to where I was able to explain myself and go into great detail of how bad my physical and psychological disabilities are. I was so scared for months before my hearing. I was mentally and physically exhausted. He took the time to listen to me and was so sweet to me. Thank you your Honor I now feel like a big heavy weight has been lifted off of my chest. God bless you!

I was very surprised with the judge, after reading these comments I'll admit I was worried about nothing. I found Judge Alexander to be very nice and seemed to really listen to what I had to say. He was pressed for time, but allowed my attorney to present the particulars about my case. After testifying and answering the questions he had, I was approved. Part of my case was not even presented due to missing doctor notes! I can only say to be prepared to testify. It's not just about a diagnosis but how the diagnosis affects you and your ability to work. A vocational expert will be there to testify about any work you may be able to do despite your disability. Make sure you have proper documentation also. You need to be under a doctors care, and not just go in with an opinion from a doctor.

Hi, I would like to say that I consider Judge Alexander to be a fair Judge. He asked detailed questions and actually listened to what I had to say. I thank him for approving my case. My only problem is that now that I'm approved, why is it taking so long to get the process started. I have been waiting over 2 1/2 years. My lawyer, Deborah Grossman, has expedited my case and we still have no results. I have lost everything I have waiting. I am single and have no one to help me. My mom has been doing her best but she only gets 969.00 a month in SS. She can no longer help. I can't afford to go see my doctor or the specialists. I can't afford to get my medication. I am in so much pain. I need to see my ENT because I'm afraid the cancer is back in my mouth , I have been suspecting it for about 6 months.

Judge Alexander saw me & immediately made the comment that he read what the Doctors said, but I was too young to be having all the problems I was. He then sent me to his Dr. who even said that I would not be able to lift over 20lbs, stand too much, squat, bend, put my arms above my head, climb stairs, and yet I was still denied. He had the date of my Disability incur switched to when I filed, even though I only was working because SS said I needed to work another year in order to even file, because I was short credits. I have General Anxiety Disorder, Hypothyroidism, Hypoglycemia, Hypertension, MVP, a partially paralyzed vocal chord, Tendonitis in both Wrist & Elbows, Tarsal tunnel in both Ankles, Arthritis in both knees, Scoliosis with Herrington rods, Degenerative disc Disease in my lower n upper Back & Cervical Lordosis, Bulging disc in my lower spine. I can not talk for more than 20 minutes or I will lose my voice. I can't walk for more than 30 minutes without hurting, I have to sit in a lounge position and even then my bottom falls asleep & hurts. I take medicine for my Pain, stay fatigued, trouble with my Memory & Hair loss, constipation, weight gain, mood swings. According to the Judge & the Vocational Rehabilitation rep. that called into my 2nd Appeal I can work certain jobs, mind you I have a High School education and my job experience is in Child care & retail, 2 jobs I can't do again. All I can say for certain is that I am a Christian and I know that God has me facing All of this for a reason. The Judge had a Chance to be fair, but he wasn't, but I am not going to hold it against him. I forgive him, after all he will have to stand before the Lord one day & will have to answer for the Judging he does.

Thank you Judge for approving my case after it was denied twice and gave me the chance to tell my story to you and how this injury have affected me and my wife life. I am vey grateful to you for helping me receive my benefits. This shows me that the SSA system is fair if you have your medical records and a SSA attorney with you when you go to a hearing. Great Judge to have to tell your truth to him. And you do not have to be nervous at the hearing.

Judge Kyle C Alexander, You gave me a few off the wall jobs that your Specialist said I could do. I'm asking you to help me find one of them, mind you one that I don't have to talk too much, because as I stated in my previous message I sent and as you well know, I lose my voice because of a partially paralyzed vocal chord. You said in your Denial I refused to get surgery to correct it, but what you didn't ask is why I didn't want to get the surgery. If I had the surgery there were risks not worth taking....I need you to show me the job, where I don't have to worry about my Back, knees, or feet hurting and burning from just daily living.... I want you to please remember that I am Human. I didn't ask for all the health issues I have, that when compacted together cause more pain that I Pray you or a Loved one ever has to face. If you can find me one of those jobs I can do with all of the daily obstacles I face, then please let me know what it is.

Ju Judge : Kyle C Alexander. 04/11/19 6:12 pm I have been in front of this judge, for one he's very rude doesn't listen actually I couldn't even talk I'm 57 years old and I have serious neck (already had one surgery) repair disc degeneration didn't go that well more degeneration in my spine and couple other things that has caused me not to work, anyway denied 2 time same thing 3 time same thing happened should not even be on the bored to hold folks future in his hands it you get this judge good luck because your probably not going to get approved I think all the disability lawyers need to do what ever it takes to get him off the board and hope he never has something as painful as we are going through,he will meet his maker and I hope he as hard on him as he is us that really need disability, he doesn't need to be in this position.

I've worked for a law firm that has done Social Security law for 20+ years and who won't take a claim unless he feels the person is disabled. He's had a 95% record of favorable decisions until Fayetteville ODAR opened up. What a train wreck! I really feel for the claimant's who desperately deserve to be on disability and are denied. They then go to the Appeals Council where they sit for another 12 - 18 months while the claimant's lose everything they've worked for.

Very disappointed in him. My son went before him and was in their 15 minutes. He never asked him one question. My son was denied. My son is 24, neat in appearance, doesn't abuse his medication (vicotin, xanex, cymbaltra) and has a college degree (college accommodated his disability). I believe this is what he based his decision on. It was never taken into consideration that my son has the body of an 80 year old. He had a double spinal fusion. Has a metal rod from his neck to his butt with about 8 screws 6 inches long in his spine. Doesn't bend, lift or twist. Lives in constant pain. I could go on and on, like how SS's dr said he is the worse case they have ever seen. He has now been denied twice. Maybe he should say he is by-polar and he can be approved like half of the other people around here. It's disgusting.

This Judge has a reputation for being an extremely compassionate but fair Judge. He is known for holding crisp and to the point hearings; it is acknowledged by attorneys and other participants in his hearings that he does not allow "smoke and mirror" type presentations during the hearing process.

Will hardly grant any SSI claims, or even SSD claims with expired DLIs. Has HUGE respect for folks with great earnings records. Will probably approve on an AC remand. If you present a fair argument (and you're not SSI, or expired DLI) he'll probably pay- and he'll tell you that at the hearing. If he goes tot he VE and talks about the claimant's capabilities as opposed to what they are NOT capable of- he's going to deny. Ever since I figured out his pattern, I like him. I just don't like how I don't know if I'm going to have him before the hearing!

I am an attorney who regularly appears before Judge Amos. I am pleased every time my client gets this Judge because I know we will be given a fair hearing. He relies on the testimony to the extent that it is substantiated by the medical evidence of record. He gives great credence to a client who is up front and truthful, not given to histrionics and embellishment. I don't win every case with this Judge, but I always feel he is fair and well versed in each case.

This is, without a doubt, the best Judge before whom I have presented cases. His hearings are crisp and to the point. He holds no-nonsense hearings and wants only that you fill in the blanks..he knows the file backwards and forwards and wants you to focus on material not covered or on discrepancies in the record. Word to those interested in what he is looking for: your client need not go in and tell a lie. This is one of his pet peeves. Be up front with him, and don't annoy him by allowing your client to exaggerate his/her condition. If the medical evidence supports the client's testimony and meets the letter of the law regarding disability he will issue an award; otherwise, he will not.

Agree with the previous comments. I think they are right on point. Keep in mind that this ALJ is not alone. There are many more like him and in fact many that are worse than him. Despite contrary belief no one believes everyone is disabled and that someone should get something for free. However, something needs to change within the system. There are judges who pay consistently 10-20 percent of their cases. The system needs to change.

This judge runs a great hearing with no nonsense, though he cherry picks to the extreme in his decisions. He's not the worst judge you can get in St Pete, but you could definitely do better.

I had this judge in 2015. While my lawyer was asking me questions about my disability, Judge Amos would glance my way without staring me down. He was obviously observing my demeanor, proper attire, age, and work history. The vocational expert seemed to agree with my answers. After my lawyer, one of the best in the state, and I left the courtroom, he told me that the judge was impressed. About three weeks later, I was approved.

She admitted that she did not review my records and she needed time. She was so pleasant but she did not listen to the VE or my doctors. What do you do when you don't qualify for SSA,( productive US citizen who worked since 15) medicaid (and you have a daughter) or food stamps? What are you supposed to do when the system, and the process turns their back on you and drags out the process until you give up or die? How are you supposed to see a doctor when you can't afford "Obama care" and you can't work bc you don't have feeling on your left side of your body? I understand some people don't deserve or have earned assistance! But what about the people who do? What about the people who paid into a system that abandons us? What about us and our children? I waited for my day patiently and at the end of this day I'm crushed! If you have her for a judge please please reschedule or ask for another judge. It's not worth your time or energy to go in front of her.

Judge Bedell was compassionate, understanding and made me and my witness feel comfortable talking with her. As many of the previous comments posted here are not favorable to Judge Bedell, it is of my opinion, if they had legal counsel representing them, maybe their representative was not as thorough as they could have been on legitimate claims. My reason for stating this is because Judge Bedell seemed very pleased with the amount of information and how it was presented in the overview of my claim by my representative. I have not been fond of the legal system for quite some time but Judge Bedell gave me hope that there are Judges who care about following the law and the legal guidelines they are given. My experience was very positive and I have heard others state the same. I thank Judge Bedell for her professional and compassionate approach in my case and I thank the transponder for her friendly demeanor and the Vocational Expert for her thoroughness of the job market.

Buckle your seatbelts for this one had court with Judge Bivins today very thourough and she goes by her script she will try to find the most easiest job for you to prove her case against even having a listing that should automatically qualify you for disability. She will cross examine you like a prosecutor so good luck and she is new to Covington Ga

Judge Bivins is not a fair Judge, she picks one line out of the full medical report from 13 doctors that says you are disabled and denies your case saying that there has to be a job that you are able to do out there that will allow to to take breaks every thirty minutes to lay down for thirty minutes. I'm sorry but common sense says that no employer is going to allow you to do that. For a Judge , she's the dumbest i have ever seen and needs to be replaced instead of our tax dollars paying her , ( to obliviously lay down when ever she wants)

Judge Renita K Bivins Is very investigative and comprehensive. She is fair if the evidence and testimony match. She is very concerned about doing her job by the book.

I understand that in this day and time there is abuse to the system. I'm all for fairness and people not abusing the system. But Judge Bivins is ALL ABOUT the numbers so she can look good. She is the most uncompassionate person. She should take time to dive into people's lives and situations because she wants to deny on anything even if you can wash your own hair. She has no idea about mental concerns when a person has worked their whole life and they had a severe traumatic event happen to them that has left them barely surviving. I've been seen by the same doctor since my tragedy everything documented but Judge Bivins doesn't care that she is dealing with people's lives that are really in need and can ruin their life forever.

This woman does not understand the most basic aspects of disability law. Her 10% approval rate is so far outside the national bell curve that SSA needs to investigate why she is so far outside the national average - to be approving no more than 10% of cases assigned to her when the national average for approvals is a bit over 50% should make it clear that something is terribly wrong with the way this woman adjudicates cases. Recently, she demanded that a dead claimant (died in 2014 and it took SSA until March 2016 to hold the hearing) amend his alleged onset date to the following year simply because the claimant had earned SGA prior to his alleged onset date! She seems to be under the impression that if a person earns more than the SGA threshold amount in a given year then that person cannot be found disabled at any time in that year! It is inexcusable that SSA would allow someone who lacks understanding of one of the most fundamental aspects of disability law to work as a judge and pay them over $160K a year to improperly deny meritorious cases up to 90% of the time. If your case is assigned to this judge, you need to move into another jurisdiction so you can transfer your file out from under this judge before your hearing takes place.

Judge Bivins seem to be fair, from previous comments I was expecting a totally different person, she asked question and listen to my response, was rather nice, VE seem to be a little confused from the judge question, my case, my problem was the vocational so called expert, not an expert at all, hopefully he didn't hurt my case :(

Renita K Bivins seems like a nice judge when you first go in there but beware because she is a ******** *****. There is a reason her approval rating is so low. She would not let me bring a family member in for emotional support, and she barely asked me any questions so it seemed she had her mind made up against me before my time to plead my case had even came. I knew enough to know to start volunteering information that I wanted the SSA to know because she wasn't asking. She didn't care that my doctor has been seeing me for years and the testimonials of my family members who know me best. She twisted anything I actually did say into a reason why I am able to work. If you drive then you comprehend the law and can follow direction so beware of that and god forbid you feed yourself. If you are unlucky enough to get this judge then I recommend you moving to another district or starting over with a new case because she will not approve you. She should not be a judge at all. Don't let her polite exterior fool you she is a *****.

Before my appearance I got the ALJ's name, so figure I would look into her stats and reviews. LoL as you can read above my comment it didn't look all that promising. But I saw a few favorable comments. Hmmm maybe there might just be a FAIR shot at justice. BRRRRR WRONG!! I am not sure how my fellow claimants court procedure went but here is mine. Not knowing what to expect I read up asked my lawyer and youtube videos. 45min an 1hr max was the common answer. 2.5 hrs it lasted and then to be gaveled with a 75day continuous( that was 97 days actually). Asked my lawyer what happened. He seemed a little stumped but said he thought it went good. Oh and the VE didn't show so they did a call in, but never made it that far. A little info... Medical records were up to Par and diagnosis was written out and it fell in the SSD BLUE BOOK. Had a Functional Capacity Evaluation test done by the most reputable facility in Cincinnati/Dayton area- failed it most miserably. Well on the return which lasted 15min and that was with the VE and the Judges hypotheticals for work. The VE reply to all was No Jobs. Arrival of decision letter Denied. The FCE test was not considered or mentioned. She over ruled the VE of no jobs. Stated I worked after the date I had Actually stopped. She asked well why do you have an earning of $3g after. When my short term stopped and work said I had to return. But my neurosurgeon was not gonna sign a letter to return. I couldn't walk, stand balance just to name a few obvious one. So when let go I had 4wks unused vacation and 4 sick days that got cashed in plus a flex account non used and returned. She had I stated one thing and had another job after. Lies. She asked did I drive? I can't turn my neck one direction and I had not even had licenses they expired. Stated I drove and grocery shop. Wtf!! I never grocery shopped when I was handi-capable. Lie after Lie. So council review here I come. She kind if makes you feel like a dirt bag. Like what you doing trying to get over on me. I feel like $h!t all the time so why not. Do yourself a favor. Look at her Southern approval rating Vs. her Northern approval rating

Hi my name is Angela Marie Green and I applied for disibility benifits after I had a injury that left me in tremendous pain! I finally found out that I had degenerate **** disorder and herniation, in which I had surgery! I have had like for steriod shots and tryed different pain medications and still in a lot of pain! I cannot sleep and maintain the activities that I use to do without subjecting myself from the agany! This has caused me to be very depressed and overwhelmed. I have been waiting a long time for a hearing and have been feeling scared for my three children! I love them very much and feel like they are going without! I have a attorney but haven't heard anything! I can't even keep my lights on at my house. I know there are others waiting as well; I just wish I didn't have to stand in the dark! If there is anything you can do to help I would kindly appreciate it. Thank You

I was very nervous at my hearing and couldn't explain all my problems but with Sarcoidosis it takes no activities at all to suffer day in and day out with severe pains and pulmonary problems of abnormal breathing.I didn't get a chance to explain the muscle discomfort with numbness throughout my body caused by sarcoids scaring between my soft tissue and bones which causes severe aches and pain..polyarthritis causing swelling and severe pain in my foot, ankle, knees, shoulders and elbows, that also causes me shortness of breath cause the pain are so severe.. I deal with skin rashes and scabies on my face, chest, back and legs that burns and itches.. I also have a high Gout level in my foot that causes me not to be able to where laced shoes and pain and stiffness in my shoulder... the fact that it cause no activities to suffer from these symptoms causes depression that adds on to my fatigue and causes chaos in concentration.. As one of my physicians stated; I'm all around screwed...

I see that she is very biased and needs to be moved to another dept due to the jobs she makes up.

I feared that i would say to much, so i paraphrased how i felt to keep it short and to the point and i feel like he heard what i was trying to convey...if i am denied i hope that i feel the same way, but at that point nothing will really matter, because i tried, and i am running out of energy. A previous judge instructed me i could do my old job (HVAC) with 5 debilitating conditions in my back..a TOTAL *****! My latest hearing was March 2017 before Judge Donaldson. After a brief hearing (15 minutes) and a short meeting between the Judge, and my Attorney, I was instructed by my Attorney, the judge was ruling in my favor. 6 weeks later, the approval letter arrives, after fighting this typical government BS since November 2010!

I have done disability battle with this judge for 7 straight years now. I was denied by her in 2011. I appealed and won the appeal by being remanded back in front of in 2014. She denied me again in 2014 and I appealed again and won my appeal. But on a second remand you are assigned to a different judge. I know it is proper to respect a judfes decision but in both of her written decisions her denial bordered on a personal attack. All this and I can't even hardly walk. This judge does not follow the law or pay much attention to medical evidence. I feel sorry for anyone who has to go in front of her. Fortunately her denials are often successfully appealed so don't lose hope.

Wished she hadn’t been the judge I was assigned to. I did not feel comfortable in front of her at all. I had to see her twice. Very sad I went through four years of this mental misery with the whole process but honestly do not think she really paid close attention to detail of my case. I’m more depressed. I did not care for her and for obvious reasons.... I did not get disability. Of course I’m going to feel mad and frustrated, who wouldn’t. 4 YEARS OF HELL I WENT THROUGH ... UGH!!! My rating is -1 star.

This is my second post about this judge. To this day I cry a few times a week thinking about how much I needed to get approved. I have depression, bipolar, suffer from debilitating headaches at least three times a week. My whole life I haven’t been able to hold a job for very long because I would have to go home sick or call in. I’m so extremely sensitive and I don’t like to be around too many people. There is more but too long to list. I don’t know how they come up with “jobs” they think I can do. How the **** do they know that? They don’t know me. I know I can “do” some jobs but it’s keeping them that’s the problem. I try looking online for something but I get severe anxiety attacks when I think about even applying. My whole life I’ve had this and have been hospitalized for it. SHE looked right over that. I can’t reapply because it’s been too long and ssd only goes back ten years which they wasted four of those. I also got a lawyer online which didn’t help me but it’s too late. No hope left for me. I cannot see a light at the end of the tunnel. ZERO STARS. Very very very depressing:(

She is an extremely fair Judge. She goes over your doctors records with a fine tooth comb. If you don't deserve to be on disability you wont be. Just the way it should be.

I find it hysterical when people who get approvals think they know everything regarding the ALJ. Please don't say if you deserve it you'll get it because that was your experience. I dealt with this woman for 9 years from a denial to a federal judge remand to finally having the remanded hearing then she sat on the case for 10 months and decided I needed a follow up hearing that was 13 months after the remanded hearing. It seems she has a reputation for holding grudges if your case is remanded... She can be very verbally mean and aggressive. You dont want this angry, unfit judge.

Hey GOD BLESS, are you her spokesperson or are you statements based on your specific perceived experience? A quick Google search and an ounce of common sense says the exact opposite. How in the world would you know if she goes over my (or anyone else's) records with a "fine tooth comb"?

Judge Foley: Arrogant, condescending, rude, smart ***. Treats claimants as if they are on trial for horrendous crimes. Fails to allow claimant to thoroughly defend case. When trying to explain illnesses, etc., he will cut you off and tell you how wrong you are. Makes pre-judgments without hearing sufficient evidence or allowing claimant to demonstrate when needed. Makes unrealistic judgments as to claimant's health, without requiring proof while claimant is right there in front of him. Hesitant to interview witnesses and get the whole picture.

This so called Judge is just that, he judges you even before the case starts, he uses half of what you say against you and doesn't listen to anything you have to say, I'm a smoker so he judged me as unfit for benefits I worked and paid in for, he used only parts of my statements to rule against me in my claim not even caring that I haven't been able to work, do yard work or have any kind of a meaningful life since my health has went down so much, I tried to go back to work and found out that my legs, heart and back would not allow me to do so, but this a$$ thinks I should sell off my bought and paid for home and take a chance on a job hundreds of miles from where I live and that the jobs I can do are plentiful outside of my county! He doesn't care that if I was able to find a sit down only job that I could do that if the company decided I wasn't able to do it later on that me and my family would join the ranks of homeless street people that are gathering in this country.

Wow! the previous comments are in contrast to my experience with Judge Foley. I felt his questioning of my case was reasonable and I did not feel that he was being disrespectful at any time during the hearing. I am not just saying this to earn brownie points. Regardless of the outcome of my claim I did not find him to be unreasonable. I feel if I were in his position I would want to know the same things he wanted to know about my claim. The part of this process I have a problem with is not the judge. I may not understand every aspect of the process but I do know I waited nearly three years for this hearing and now I am waiting another 90-120 days for a decision on my appeal. I don't think this wait time is reasonable, especially after waiting so long for a hearing. What's the point of having a hearing if the judge or any other decision making person gets an additional 3 -4 months to pick apart the claim. The playing field is certainly not level. I didn't get an additional 3-4 months to explain or prove my case further. I want the people making the decisions to understand it is pure torture to make people wait and wait and wait on an answer that should have been given at the time of the hearing. I submitted evidence to support my claim and I don't know why that is not sufficient to have made a decision at the time of my hearing. If my claim is denied I think I should be able to skip any further processes with this office and appeal directly to the US Supreme court level with a valid argument that my claim was handled unfairly. If ODAR gets additional time to try to prove me able to work. I should be awarded the same amount of time to show why I am unable to work. It's sad that this system is broken there are people who don't need benefits that are approved automatically and people who really need it cant get it and pay the price for the ones taking advantage of the system. I'm tired of not knowing where my next meal is coming from and if you have to endure this for three years you would be too. please make a decision on my case, "reasonable" left the building the moment the hearing was over without a decision being made. I have lost everything due to my medical condition and I just want to recover some of what has been lost and survive as best as I can. If there is not a case out there that has been approved on less than what I submitted than I won't complain but I know better and I am just as entitled if not more entitled to my benefits as some people who have been approved for benefits but are able to work. I wish I could work, I could make more monety.. and those people taking advantage of disability need to either pay back the benefits or go to jail. If my claim is denied or my back pay altered there is no way at this point for anyone at Social Security Administration to argue that this is NOT a matter of discrimination.

I had heard negative comments about this judge before going into my hearing, but I didn't find them to be true. He made me feel comfortable and was very pleasant. He did ask questions, but nothing that I felt was out of line, condescending or inappropriate. I felt he paid attention to my responses and understood my condition.

I found Judge Foley very polite and seemed to be very knowledgeable about some of my medical conditions. He did however seemed upset with the lack information in the medical records sent from numerous doctors. I would hope that none of this would be held against me, as I have no control of what is in the medical reports. He also seemed concerned that after I had been denied previously twice and was financially suffering and tried to return to work but only made it 4 months before being terminated for to much time missed for hospital stays but made a substantial amount of money during that time before I refiled for disability. I hope he does not hold this against me because I want to work but just am not able anymore with numerous health problems. He seemed fair and I certainly hope so because I am at the end of my financial means.

Just so some of you know, these judges work for the same government you're try to get your benefits from and as so will almost always rule against you no matter what kind of medical problems you have, they don't care about you or your families. I have been denied my claims since 2007 and was grilled not about my health problems by this judge but how I could afford to see a heart specialist when I had no income, didn't even get a chance to properly address his question because he cut me off very rudely. Another thing you need to take into consideration is that ALL of these judges have already reviewed your case long before you get into their so called courtroom and have already made their decisions!

I was insulted and laughed at by kevin foley. He is not fit to be called a judge. He said he didn't understand why I have problems holding my urine due to spinal injuries. He doesn't have MD after his name. He was very condescending to me and my injuries. He even questioned my mri disc that clearly showed the extent of my injuries. I have been out of work for three years due to my injuries. I had to move in with my Dad, who has retired and is now living on a fixed income. I am not as mobile because of the pain and depression. I have since gained about 60 lbs. Kevin foley feels my disability is mostly due to obesity. I had returned back to work for six months until I could no longer bare the pain. No one should be treated this way.

I'd like to thank all of these judges for taking the time to hear the people's cases. As I'm sure it's a tough job, somebody has to do it, and I appreciate and respect them all for all they do. My case was heard in July and I received my decision in August. While I still do not fully understand the process of it all, I am saddened for those who are ultimately judged by the lives they've had to live , versus the disabilities they have to live with by no fault of their own. I could only hope that one day, life can be tolerable whereas it has been unbearable. Being born with something you have no control over is a fight within itself. Normal has never been a word in the vocabulary of my life. Without going into detail, I was denied..again. The fact that I keep getting denied isn't what hurts most, it's watching people abuse and lie to the same system that could look at my case/disability and say I don't believe you deserve it although your disability is "severe." I will continue to pray for all the others who struggle with life everyday, and have to prove their cases in court, and for the ones such as myself who lose their cases with good cause, good luck in the future.

I must admit that I went before this judge with overwhelming feelings of anxiety but just hoped and prayed for the best outcome based on my truth. Though her statistics show her to be tough, I think it's more that she is a no non sense judge. I found her to be very compassionate as if she was hearing someone like me for the first time ever; I had her undivided attention. She was making reference to my records so that I knew she'd read them. She challenged some of the contents in my records but I never felt bullied. She made me feel that she cared and I honestly believed that she did and could relate to my circumstances and how those circumstances led me to require assistance. I use to say that I want my life back however I have come to accept that it may not even be possible so now I just pray for a normal life again. I'm more than grateful for her professionalism and compassion.

This Judge gets zero stars. This approval rate of 24% says it all. Her goal is not to weigh the facts or consider the evidence in an impartial fashion, but it is to scour the record for anything to defeat the claim. What is most objectionable about this Judge is that she takes so long in handing down her decisions. Twelve months is not unusual for this Judge. Claimants who wait two years and more to get his hearing, have to wait close to another year. There is no excuse for this. The average wait to get a decision is three months. Not for this Judge. If you draw this Judge good luck. You will need it.

1000 pages from doctors and ER visits, documented heavily. clearly shows progression of heart and mental issues. judge dinged me for shaving and dressing appropriately...I did not take my mental meds to be clear headed as I could be for the hearing at the direction of my attorney, that counted against me. My suicidal and severe depression and severe anxiety due to health issues and declining health were ruled mild, even though the psychiatrist rated me severe. He does not see look at your illness and see progression. He called my hematologist a liar because her paperwork said i was disabled. the cardiologist i had last year that was a horrible cardiologist that missed all my heart warning signs, he used his documents over the docs that implanted a pacemaker and that are currently treating me. this judge and several others in the hattiesburg office have the lowest approval; rating IN THE COUNTRY. more claimants need to stand up and try to get these hanging biased judges out of their offices. if you get michael harbart you might as well kill yourself, it will be more humane and quicker than waiting for the slow death they sentence you to.

I was told by AN officer he sends police survellance to watch you while you wait for a decision. And by golly there was one watching me as I checked the mailbox that was overflowing because I couldn't get out there earlier. Another person who had him never left the house so the cop came to the door saying they are doing a survey of their performance in the neighborhood. As he was talking and disabled person was trying to get inside to sit down. The officer asked Are you ok? To be nice (because cop didn't know this person much less persons story of being disabled) the disabled person said yes to get him gone in order to sit down and catch their breath. Im doing this because we all have good and bad days. Getting things done as much on the few good days compared to the bad should not say you are NOT disabled. Yes both were denied by Michael HARDbart.

I had my hearing in January of 2017. Although I am still waiting on Judge Hart to write up her decision, she ruled in my favor. I have nothing but great things to say. I was very nervous, anxious, embarrassed and depressed about my situation. Judge Hart was very kind and compassionate. She listened to my attorney as well as myself and took the time to really hear us. In no way did I feel rushed. The hard part now is waiting since I am 5 months in to the year with no healthcare or income and many cancelled doctor appointments. Thank you Judge Hart for helping to make this day go a little easier for me and showing me that there are still compassionate people out there.

Had my hearing Aug.2020and Thank God I got Judge Hart as my ALJ. She was so caring, thoughtful and very easy to talk to. I’ve been fighting for disability for the last 4 years with no luck feeling really helpless and hopeless and on top of that I wasn’t able to get a lawyer so that was scary in itself. But with GOD for you who can be against you is my moto!!!! But here it is October and just found out that she completed her decision on the 7th and it was a FULLY FAVORABLE DECISION!!!! She granted me back pay for the last 4 years. I’m so thankful to her this gave me so much relief now I can financially care for my children it breaks my heart every single day that I cannot take care of the physically and emotionally but at least I can financially now!!! THANK YOU SO MUCH JUDGE HART!!!! MAY GOD BLESS YOU AND YOUR FAMILY!!!! Words can’t express how thankful I am for you!!!! Please keep being the god sent human being that you are ??

Asked me to describe my typical day. Cut me off before I even finished describing my mornings. Two medical professionals declared me disabled. The vocational expert declared there are no jobs for someone with health issues as serious as mine. But this judge says 3 life-threatening conditions aren't disabling! Pray you don't get this heartless jerk as your judge.

The vocational expert when asked by this judge if there was any job that I would be able to do? The expert stated "NO your honor, there is no job that I know of that he would be able to do". But in my decision letter it states that the expert stated that there were several jobs that I would be able to do. Now why is something that was not stated in court, in my decision letter and their for leading to me being denied or as the letter states "Notice of Decision-Unfavorable"

As a very successful SSDI attorney, who has been before this judge many times, I want to assure every claimant that Judge McDonald is the consummate professional. He is well-prepared, very fair, and invariably courteous. If the Social Security Administration were smart, they would consider him a model for other ALJs to emulate. He's central casting in every way. Unlike other judges, he never gives the impression that he's already made up his mind. He also never cuts off attorneys or claimants, and does everything possible to put all parties at ease. That said, he rightly expects attorneys to know the file as thoroughly as he does, and to present their best theory of a case, even when the evidence is shaky. To the above poster, the vocational expert would have been asked more than the one question whose answer you liked. I'm guessing your decision was unfavorable because Judge McDonald adopted the Vocational Expert's response to ANOTHER question that assumed LESS than disabling physical and/or mental limitations. With more conservative limitations, there would still be jobs you could theoretically perform. In deciding your case, the judge would have assumed restrictions compatible with work activity (vs. disabling restrictions) because your doctors apparently failed to establish the legal severity of your allegations. This judge is neither pro-claimant nor anti-claimant. He simply applies complex federal regulations with honesty, precision and integrity. That said, quality representation is essential at any SSDI hearing. It's unwise to have poor representation, and absolutely foolish for a claimant to represent him or herself.

As an SSDI attorney representative, I echo the praise and endorsement of Judge McDonald. In my experience before this Judge, he is thoroughly familiar with the record, focused, and knows all the nuances and key pivotal issues within a claimant's record and smoothly directs the inquiry towards those issues. Throughout the hearing, he is exceptionally courteous, compassionate and treats everyone with the utmost respect and dignity.

She was respectful during the hearing and only asked me a few questions briefly the whole time which leads me to believe their mind was made up before I ever got there(her and the vocational "expert". It was determined I could no longer do my old work and at the same time I am supposedly not disabled either because Mr. "Expert" says I can either be a kitchen helper now or a dining room attendant...both with 30% restrictions to bending and lifting and even going so far as to say there were thousands of local jobs doing these things. First of all no one will hire or keep you working with any restrictions and second I can't do them anyway and third...I live in a small town and there aren't thousands of jobs combined anywhere around me. I am very disappointed in the double standard used in the decision. Make up your mind. You say I can't stand or lift and do my old job but I can stand all day and lift in the job you say I should or could have. What a crock. If I could do my old job I could be making 1 to 2 thousand a week on very good weeks. I would have to be crazy to not do that... Maybe I am crazy for thinking I could get a fair shot after all the grief and ginancial upheaval I've been through with this.

I would like to just say she is a fair and just judge she truly listen and provide fair decisions based on the evidence if more judges were this unbiased and did everything on a case by case basis and not under any preconceived stereotype this world would be a better place

The disability rules, law, I should of got my disability, but this judge denied me my disability. I am a very sick person, there is days I can barely walk, I honestly don't know if I am going to make it some days.. I have so much pain , so forgetful, the social security doctor said I was disable to work, because of my disease. She mention of me being obesity, and lack of education. It never stopped me working before. I have worked ever since I was 12 years old, worked hard for over 40 years. I have worked for everything I have, and now I am not able to work and about to lose everything I have ever worked for, because I am not able to work, and this Judge made this unfair and inhumane decision, on behalf I felt she is a prejudge Person. It is such a shame that a judge can make this kind of decision, because they don't like a person. What has our country become to. So sad that's it's become that such cases are treated like this. God be with us all.

Benefits are essentially available for the asking with this judge, who rarely lets the record get in the way of a claimant's payday.

Judge Washington has that rare capacity to discern the human heart. He is compassionate, but not a bleeding heart. He tolerates no BS. I respect him greatly.

I have a rare muscle disease known as Myasthenia Gravis that can actually kill me. I had proof of doctor statements stating I couldn’t work. I lost insurance in the process of me fighting disability and couldn’t afford my meds, part of my denial was because I wasn’t taking my medications! She faulted me for everything that’s out of my control. Now a year later and I’m stuck using a walker at 26. Still no medicine , no insurance, no nothing. Just a single mom trying to pave a path for her kids. I felt defeated after sitting in front of this judge !
