Schizophrenic claimant with 3 suicide attempts- the last of which involved stabbing herself in the chest and then throwing herself from the third story window of her apartment complex. All doctors document multiple marked limitations, including the post-hearing CE. All opinions rejected. This judge found this woman not disabled and perfectly capable of working.

ALJ Norman Buls ruled unfavorably against my Pro se appeal of improperly denied benefits. I was totally disabled 3 years due to misdiagnosed Lyme disease, then was enrolled in Medicare. I chose a Medicare-contracting HMO where my personal physician was a provider. There, as my PCP, he rejected a Lyme disease diagnosis made by an out of area non Medicare Lyme literate physician. The PCP rejected and refused care for Lyme, saying that the HMO would not treat Lyme or accept it as a diagnosis! I was stunned, but wish to push back. After an unsuccessful In-house appeal, I was scheduled for a Medicare benefits denial hearing to be conducted by Judge Buls. At the hearing the HMO was represented only by a letter that its Medical Director had sent to ALJ Buls. The letter was a deliberate effort to uphold Plan denials by untruthful spin. Without stating WHY, ALJ Buls rejected expert physician testimony affirming my Lyme diagnosis and exposing the HMO's lack of physicians trained to competently diagnose and treat Lyme. ALJ Buls shunned evidence that my Medicare HMO was unwilling to diagnose or treat Lyme. When I tried to refute and expose the HMO's lies against me ALJ Buls ignored or quashed my sworn testimony. His Decision against me used the HMO's proffered falsehood and twisted half-truths as boilerplate for "Findings of a fact." To me the forum was adversarial, the deck stacked, the playing field non-level, the outcome threatening to public health. Many suffer much, or die or suicide due to Lyme. The CDC now estimates ~300,000 new US Lyme cases each year: a hidden epidemic downplayed by public health authorities, shunned by insurers and advanced behind failed judicial safeguards.

Just received my unfavorable decision from Judge Elias. Her decision process was erratic and biased without any consideration for the actual medical diagnosis. She used the opinions of doctors who have no actual medical experiance in the field of medicine needed to make a proper diagnosis. She used 2 medical opinions from two M.D.s who never actualy met me or knew any thing about me other than my name. She stated in her opinion that the medical evidence provided by 2 specialist in the field of medicine specifically related to my disease were " we will not defer or give any specific evidentiary weight to any prior adminstrative medical findings or medical opinions from your medical sources." She then claims that the 2 doctors with zero expertise, one an opthamologis or an eye docter and two, a G.P who was reprimanded by the Arizona medical board for Failing to recognise a Tachycardia event in a patient. Or laymens term a heart attack. So the expert medical opinions of 2 doctors with Zero eperience in making medical decisions on disease or disabilities they have no experiance in, out weighs the medical experiance of doctors who have dedicate there lives to specializing in.. These specialists i had to see to get the medical tests from, were requested by ssa to substantiate my medical condition in order to file my claim for disability. Her decision to ignore actual evidence and make an opinion using failed logic is disturbing. If a judge used this same logic path in a criminal trial the legal system would protect the accused. But it seems in a hearing for disability there is no form of protection or law that states all evidence provided must be used and that any expert testimony must come from an actual doctor who specializes in the field of medicine required to make an actual diagnosis. As it is today ill be requesting an appeal through my attourney as well as contacting my state representative to investigate Judge Elias and her opinions over the last few years to determine weather there is any bias or discriminatory practices . I followed the leter of the law in starting the disability claim, i followed the requested visitations and appointments with the specialists required by the SSA to show medical evidence of my disability , and when the medical evidence showed the diagnosis for the disease stated in the claim for disability She chose it ignore it and discard it an myself without any thought to my situation.

It is very hard to tell what Judge Reyes was thinking at my hearing. I was in there for about 15-20 minutes and he never even asked the VE any questions. Reyes asked about my education. He made a comment "you were making good money"....I said yes sir. He asked how heavy the field scope tri-pod was, when I was assisting in the field with a designer and I guessed about 30#? My atty made some medical statements regarding a couple appts the SSA sent me to, but did not understand any of it. THEN IT WAS DONE. He was polite. My anxiety was off the chart. It's hard to rate him under my circumstances.

Judge Elias used many partial statements so it would appear to mean the opposite of what the actual full event was so it could be used against me. If the entire statement was used in context, it would have been in my favor. She did this several times throughout the decision process. She said I had therapy that I did not. Medical records verify that. Even omitted statements from the vocational expert that were in my favor. Obviously my case was denied because of her false statements and half assed statements. Why have a vocational expert if you're going to ignore him. He said there was no jobs for me given my conditions when my lawyer asked. She must of had a hearing problem during that moment.

Beware if you have a mental disability. She will look for ANY reason to deny you. Like if you have agoraphobia and went to ONE football game because you never went, it was your life long beloved team, you got free amazing seats, had to have many drinks before hand and was scared as hell but wanted to try to give myself one day of happiness in a lifetime of hell, and made the mistake of telling one of my monthly changing therapists that I had a good time. She placed a lot of weight on this one day in my life when my friends were trying to make me happy, in my hometown, from which I am displaced. I get that she's paid to try hard to deny people but beware if you have any intelligence whatsoever. Apparently you need to be psycho, drooling or suicidal to be considered mentally ill in her eyes. Glad to see mental illness awareness is alive and well in AZ. (NOT)! Can I give zero stars?????

Hi i recently had a hearing with diane tin chen. When i left the court room i was in more physical mental pain , i could not beleive what i went threw it felt like i was not able to focus with breathing issues and a migraine. I understand that the judges have a job to do . I have paid into my social security many years and i am not looking for a free ride .if i was physically and mentally able i would have not gone threw this .My experience with this day is speechless i will leave this situation in Gods hands. I went before judge Baum back in 2011 and he granted me 100 percent disability with bk pay and than I was denied because my roommate started getting his Soc.security someone filled us a married couple so I was cut off and had to reapply again fo disability and was supposed to get bk 4years of bk pay when I was approved again and judge C.Davis only granted me 1 1/2 years bk pay when I was determined 100 0/0 bk in 2012 by judge Baum now I feel discriminated by judge Davis so I plan to appeal his dicission to get all my bk pay I deserve from 2012 to the present time no better judge than Peter Baum god bless him

I feel very fortunate to have had Judge Charles Davis hear my case. He paid close attention to detail. My employment history was unusual. My job duties were sometimes different than the normal. He seemed to ask all of the right questions for someone who was really trying to understand my situation. This experience was great.

Charles Davis doesn't deserve the title of Judge. He is corrupt abs doesn't care about the American people. I am a dialed Veteran at 100% I suffer from PTSD with memory loss, TBI with Migraines, depression, anxiety, insomnia, fractured neck pains, DDD in the lower back, shoulder pains after surgery, and knew pains. I walk with a cane and he feels as though i can work. This man is a danger behind that desk!

Judge Johnson allowed me to fill in the blanks between health issues, testing being done, and let me tell my story as when it started to present day. Just remember to stick to the major points that got you where you are don't waste time going on and on about one thing. It's your life make sure you know the laws search SSA guide lines as to whats considered disabled. I would say once you have an attorney you must feed them information such as anytime your medication is changed, you have a test done at the hospital, and/or what your PCP pushes you to do such as physical therapy, see a pain management doctor, and if any of these doctors doesn't believe you are in pain or have limitations change doctors we have to have a PCP in your corner. ASK QUESTIONS !!! KEEP RECORDS !!! EMAIL OR FAX EVERYTHING TO YOUR ATTORNEY ASK THEM QUESTIONS !!! Remember it's your life you need to or your wife or your parent has to lead your case to the winner circle. I found Judge Johnson to be fair. Good Luck !!

Judge Charles Davis is an overtly corrupt judge due to the fact that he is not thee least bit impartial. He clearly cherry picks what evidence he can to deny claims and blatantly disregards strong pieces of evidence to ensure he can deny people of the benefits that they deserve. Judge Davis is a disgrace to the Social Security Administration and the principles of the United States of America. Hopefully Social Security will realize that this judge is problem and address the issue.

I have nothing good to say about judge Reyes, my wife tried to get disability he was the judge he barely gave her the time of day he turned her away so fast it wasn't even funny, as a matter of fact he had a cut her hearing short because the person behind her who could not speak English her interpreter had an emergency so he had to get to her as soon as possible. How does a woman who can't even speak English get this far for getting disability. Judge Reyes should be ashamed of himself for not giving my wife the proper time needed! My wife still cannot work to this day she still has all the same problems that she's had for the last 4 years and now since she can't work we are financially strapped. Mater of fact we are at the emergency room right now.

I am outraged at how low life criminals with prison and drug records who fake schizophrenia to get a free check that goes to the dope man on the first of every month. Check out 17th Street and Imperial Avenue near St Vincent De Paul-Father Joe Villages. When honest people have paid into the system and honestly need help they are continuously denied. I often wonder about people in high positions.

I was denied disability because of my attorney's failure to represent me properly. He didn't bother to obtain my medical records until one month before hearing. He didn't want to meet with me to discuss what to expect. I sat there like a fool while being thrown under the bus. There was no vocational expert at hearing. I was told by judge that "I looked to good to be 60 ". I have a bladder condition called interstitial cystitis or painful bladder syndrome. I was basically called a hypochondriac. My bladder recently ruptured during a cyscosopy procedure. I came home with a catheter. I am unable to stand, lift or twist. Judge Johnson found me capable of being a cashier. I am devastated by the misrepresentation. I worked very hard during my life and now at 62, I am financially ruined and no possibility of ever working again. The system has once again failed. **

And I still give her a good rating.. why..because she gave me a good caring vibe.. This judge is one of those people that use the truth your swore to tell against you in every possible way. It seems that she has a personal vendetta against disabled people. After doing some searching, I found that she has one of the lowest approval rates in the COUNTRY. Like the person above mentioned, she cuts people off in the middle of their answers and is just plain mean to the disabled and their attorney. I've spoken to several people after their hearings and kept in contact with them after their hearings just to hear about the decision. Out of 8 people, 8 were denied. This woman is viciously biased against people with disabilities and all who represent them.

This judge denied my claim twice. All he knows how to do is try and find one little thing to give him an excuse to deny people's claims. He completely disregarded all the favorable supporting medical evidence going back 12 or 13 years and even his own ordered evaluation, which was favorable. I don't know what is so miserable in his life that he feels he needs to take it out on deserving individuals but it is a horrible injustice. He has no business being a judge with his personality. My lawyer even said he should have never been appointed a judge. Currently my claim is back at the appeals board. Since this judge didn't do what the appeals council ordered him to do the first time it was remanded back to him, I don't think they are going to be too happy. God I feel for anyone who is assigned this miserable old man as a judge.

I hope that all the judges take into consideration that some of us might look healthy but in reality are not and there isn't any medical help for single adults in Arizona. Judge Buls I am asking for more consideration, than just your Doctors evaluation which he was more concerned that me teeth were still there, would not listen to anything I had to say and I could not perform most of what he asked and wrote something different. At consideration level I should have been sent to another Doctor for my new illness Calcified Menginoma and it was not considered. Please look at all the facts.

My best friend went before this Judge. J. Mathon told my friend, if she didn't stop crying and being so emotional the judge was goiong to make her come back another time. My friend was there for emotional disorders ~and has knee & back problems~ The Judge kept cutting her AND her attorney off while they were trying to answer questions. Mathon didn't believe that my friend actually doesn't do or go anywhere unless it ABSOLUTELY has to be done. She washes under garments out in the sink and Mathon said, "So, you DO, do laundry. You just told me you didn't!". There's much more to say but not enough room. The lawyer even came out and apologized several times for the way my friend was treated.People who scam the system seem to get help but not those who are in desperate need of it. How sad. Since there's more room to write, I just want you to beware and be prepared if this is the judge you have to go up to. Good luck to you, cause we didn't have any.

It should be known that Judge Johnson saved a life recently. By way of his diligence and willingness to consider records spanning close to three decades, Judge Johnson saved the life of a woman who was at risk of otherwise falling through the gaps. She was also at her wits end, and reports she would have killed herself if she had not received this help as she was unable to pay for the care she needs, and was unable to make the simplist arrangements to seek help for herself.

I was surprised to see that ALJ Johnson has better stats than the other 5 Tucson ALJs for 2012. Although this ALJ was a likeable guy at the hearing, his decision had very little to do with the evidence presented. He completely disregarded the testimony from his own vocational expert. He discounted ALL favorable medical opinion and ALL lay witness testimony for the flimsiest of reasons. Many of his finding of facts were inaccurate or simply made up of whole cloth. My conclusion: this ALJ is just plain lazy (which, I suppose, is still better than "evil").
