POS. I had a heart attack in June. This so called judge actually cited my missing of appointments in June as a reason to stop my benefits. All was based on a 5 minute quiz by some shrink I have never seen before or since. Railroaded. Kay's is either incompetent, or simply has bad judgement. He is horrible.

I had my hearing on 02/19/2020 with Judge Markiewicz. He was kind, respectful, and pleasant. He smiled, laughed and made you feel comfortable. He spoke clearly and knew the facts of my case. I felt he listened and paid attention when I spoke. He seems to be a just and fair Judge.

With all due respect, she is a terrible Judge. I agree that she failed to properly look at obvious medical evidence that was provided for my mom’s case. It shows when a person has had little experience truly understanding medical evidence (I worked in the medical field for seven years and dealt with enough of these people to understand this). She asked my mom what she did all day. My mom kindly responded, “Not much.” This response made perfect sense considering my mom is DISABLED you asshole. She thought it was proper to respond, “That sounds like a long day.” NO SHIT. When we have multiple sources of evidence from multiple doctors saying she CANNOT WORK, any other response from her would have negated all the evidence. She is the reason people like me have no faith in the “system.”

This judge is a liberal feminist with absolutely zero sympathy for Veterans I am a 100 percent service connected combat war veteran with mental and physical injuries sustained from my time in Iraq. I have major depressive disorder, anxiety, ptsd, depression and a whole list of other serious debilitating issues. You think a judge would be sympathetic to this but no. She denied my appeal and my last shot at getting disability. And they wonder why 24 veterans a day commit suicide. She is a coward with no heart. If you find yourself in the unfortunate position with her as your judge, be forewarned. She will deny you benefits and make your suffering permanent. She should be locked up for treason. I have no respect for her and I hope she get's what she deserves which is everlasting suffering in hell!

The last comment is completely understandable. I had judge Harrell and the whole process took about 15 minutes. The judge did not ask the vocational expert any questions and he may have asked to verify the medical expert special codes my Ssdi Lawyer had brought up. After all the questions were asked he asked me a few questions about my daily life, then asked my attorney if he had any questions and the attorney said no and that was it. With all that said I got a fully favorable consideration. I think if your attorney comes in really prepared and gives a pre-briefing that is perfect for the judge everything will go fine. I just got a fully favorable consideration today ( July 10 19). So for the last comment I really would not have anything to worry about. My Attorney said that case couldn't have gone any better. And just to bring up one thing he did say that the reason why the judge did not ask questions to the vocational rehabilitation expert is why he predicted that my case was basically going to win ( and he was right ). So if you have any worries please know, that judge does not really speak too much and if he does I think that’s where you have the problems, Because he is looking for reasons to deny you. So if I were a betting man, you have nothing to worry about other than maybe getting a fully favorable consideration, thanks

I felt judge Harrell did his duties as a judge quite fair. However, he did not ask opinions from my medical expert or vocational expert which has me a little worried. Other than that I felt for my first time at a hearing I felt relaxed and calm.

This judge is a tool. Rude. Condescending. Horrible. Didn’t help my advocate was his twin lost at birth. I have 2 brain tumors, severe anxiety & depression, and this “judge” denied my claim because I was “calm and collected” in his courtroom. No lies! I was diagnosed in 2012 and this is a chronic disease I’ll die from. I’m now filing bankruptcy and have nerve damage now in my feet. THIS TOOL SAID I COULD BE A GROCERY STORE BAGGER.

She is a total nightmare. She wasn't fair, nor courteous. She was actually downright rude. She barely allowed me to speak. She interrupted me consistently. I was in horrific pain that day and she yelled at me by saying (and I quote) "What is wrong with you, I don't understand!" I'm disabled. That's what was wrong! She is completely unprofessional and emotionally abusive. I felt worse after our hearing. I actually had to go to the ER after that hearing. Thank the Heavens I was a blessed with a sympathetic judge at my Remanded Appeal Hearing afterwards. KERINS MADE ME WAIT AN ADDITIONAL TWO YEARS on top of the one and a half years I had already been waiting. If your case is to be heard before this woman... Be prepared to wait another 2-3 years. Run for the hills. Request another ALJ. It may be time for Kerins to retire. Someone in upper management or government needs to take a serious look at how she handles her cases. This judge will smile, act pleasant, then deny you. He will give zero weight to your Dr, and all credibility goes to a medical expert (who's never seen you). He also thinks someone with serious back conditions can lift, squat,bend, stoop and crawl. He will give no weight to how you suffer on a daily basis, making it impossible to work. It's no wonder his denials are so high.....

He has no grasp on reality. He cares more about a lawyer's foot than you. Over 20 doctors and 6 year's and he still says no. He is politically bias and discriminates. He shouldn't even be on the bench. He doesn't look at any evidence. He will lpoker back at pass cases all doctors saying I can't work and scratched his stupid head and just says uh wow all three are stage 4 which means no work possible but somehow goes to the last case and goes off that. Not anything new. We all know these judge's are corrupt. Dope heads get it with ease. A guy said he heard voices and got it. Guess the only way to win is huff air, do drugs and say you hear voices. 20 doctors and a NO. It's because of my age and sex.Only and his ****** STATS HE HAS TO KEEP ON CHECK FOR THE FISCAL YEAR. He is new to Santa Barbara and scratched his head about paper's saying I'm stage 4 which means 85% of the time of anything I can't do. I don't get why that's a head scratcher. He is a nice man. Seems arrogant and you will have to wait 90 to 120 day's before you get a decision. All evidence says NO. But expect a NO. New and doesn't seem to get medical records at all. Still waiting and hope he makes the right decision but you know SSI judges. They go off statistics for the fiscal year and have to keep a average or don't give a **** at all. Also political bias and age discriminate happens in SSI. THAT'S NOT THIS JUDGE'S PROBLEM that I know of. Just new, make you wait forever and is nice in the court room. Can also be funny. But doesn't seem to get anything. He asked the man can he work the 3 bad job's SSI said I can and they had to say NO. 20 doctor's say NO. Stage 4 on everything. Kinda a EASY decision but have to see. SSI will never care about the disabled or there problems period.

I went before judge Ball and in the past eight years has been a rollercoaster ride with social security. I just couldn't understand why they are fighting me I had breast cancer along with bad doctors and surgeon's and hard to get a job with medical. Judge Ball is the only Judge that was fair and listened to my story and then I listened to him and his questions and I found he spent time to explain my case to me and no other judge ever did this. I have a hard time understanding legal and reading with seventh grade education and I found judge Ball to be fair and honest with me. As one human to another that's all we can ask for in life just be fair. Even if I am right or wrong. Thank you for your time to read.

I felt that he was very fair. When I walked out I felt like he wasn't looking for a reason to deny my claim but more so a reason to approve it. He was a bit standoffish but all in all I felt that he gave my case a fair look. The VE was another story. She was clueless rude and lacking in every area. But the Judge Wojciechowski was a respectable fair man, at least in my hearing.

In my case, it was already decided and it was in my favor, but when he wanted to see my medical file to check on some notes, it was not in the hearing to begin with, and he postponed a month for the file to be ordered for a decision in the following month. It has been going for almost (4) without any results. My attorney fault for not being prepared at the hearing.

MY ADVICE: DO NOT GO INTO HER COURTROOM. Reschedule, find a new lawyer, whatever, but avoid her at all costs. Horrible, absolutely horrible. She breaks rules, the law, and still the appeal council does nothing. A useless parasite on the system. She ignores anything that any doctor you have ever seen has said, any claim of pain is "you're a liar", puts you into job categories you've never done and can't do because of your sciatic lumbar pain and arthritic knees, and literally fabricates testimony and evidence so that she can deny your claim. I've been through many custody hearings and by far Sharilyn Hopson is by far *the worst* judge/administrator I have ever come across.

This is a terrible judge. He will not believe your testimony of disability, even when you have extensive medical records and proof that even working part-time is too much to handle. I would not give him even one star. He has no understanding of the struggles of a person with chronic medical conditions that taxes your energy and makes you tired even after modest activity. She conducts her hearings in a very unfair manner. She will spend an hour grilling the client and then tell his attorney, who has just started his/her examination, that there is a shortage of time. Her mind is made up prior to the first word of testimony, and this is reflected in her attitude and questioning. Judges decisions are slanted with the negative highlighted and the positive ignored. This is a an ALJ to avoid.

Do not look at the comments for an understanding of the law. It seems many of the commenters are very misinformed about the hearing process. Very rude, patronizing, unethical and cold-hearted. Worst judge I have yet to app[ear before. Does not have any empathy or compassion whatsoever. Claimant is clearly disabled due to his mental disability of bi-polar and social anxiety. He overlooks the whole thing and finishes hearing swiftly denying him. If you appear before him for a mental disability, tough luck. Claimant is currently being evicted due to an unethical judge. He lacks knowledge in the mental health department. Why is he a SSI judge for the disabled?

Judge John Kays was the worst experience I have ever had with our legal system. He did not allow me to explain my situation, in fact the only thing he said to me "on the record" was "good morning". He then went on to converse with my attorney and inform her that he had one report from an urgent care doctor that SS sent me to for evaluation in which he was referencing..out of 8 doctors and 1 of them a specialist at a very well known Clinic, he was going to make his decision off of that one doctor and deny my claim, because as he said "It's his job and he can review the entire case if he wants too and that's what he was going to do". It seemed this judge had made up his mind before even seeing me, wasting my gas, and time. As soon as I walked in the room he stared me down and continued to stare at me during the entire 3 minutes of my "hearing", in which he did not hear me or talk to me at all. In my opinion, this was a waste of time and this judge is NOT fair,and seems to have a "God" complex. He never asked me any questions or allowed ME to explain my case, cause he was gonna do what he wanted to because he could and that was that. Terrible experience. I feel bad for anyone who gets this judge. Beware!!

Even if he denies my case, I feel that he was a fair judge. He took the time to listen to what you had to say, and like everyone says, he allows you to make an opening and ending statement, which I feel like I should have done, but I had my attorney with me. You can't take his decision personally, even if this site says that he denies most of his cases, his job is on a level that many of us will never understand. The system works slow, but it does work.

Andeer seems to have a good professional relationship with his assistant and the VE. I just had my hearing and my attorney said it can go either way. I now wait impatiently and pray for a positive outcome in a timely manner. All in all, it was uncomfortable, as anticipated, but not unpleasant.

I have been seeing my doctors for over 15 years. One of my doctors sent in 4 letters explaining my condition and how it renders me "totally disabled". My other doctor sent in 2 letters saying that in his opinion I am "totally disabled". SSA sent me to 3 of their doctors and all 3 of them said I am "totally disabled". There's 34 medical exihibits in my SS file containing almost 900 pages of medical reports. 8 months after my hearing, I get a decision denying my case! In the decision, this so-called judge actually states that she did not give much, if any, weight to the letters from my doctors because she did not understand what the term "totally disabled" means! I've asked 7 of my grandson's friends if they know what "totally disabled" means and all 7 of them knew exactly what it means and they are all only in the forth grade. It is absurd that a well educated so-called disability judge who is probably being paid over $100,000 per year with tax payer dollars, doesn't know what "totally disabled" means. I don't even know how such a thing is possible. She also said that I didn't have any muscle atrophy but she never got closer than 15 feet to me and as far as I know she isn't a doctor so how could she say I don't have muscle atrophy? That woman doesn't know what totally disabled means but yet she can diagnose whether a person has muscle atrophy without ever examining me or seeing my body. My lawyer appealed my case but he told me that it would take the appeals court over a year to decide my appeal and, get this, if the appeals court agrees with my appeal, they are going to send my case back to the same judge and instruct her to hold another hearing and issue a new decision! Why would they send my case back to the same judge who doesn't even know what the term "totally disabled" means?My lawyer said that even after the appeals court sends my case back to the same judge that it will take this judge another year or more to hold another hearing. So, if my appeal is successful, I will have to wait more than two more years before I have another hearing and then when I do, I will have to go back in front of this same stupid woman so she can just deny my case again. This is so absurd that I cannot even believe it is happening for real. It's like something out of a weird movie or something. SSA is a rip off. I wish I had done like so many and just worked under the table. That my health and well being as well as my life in general is in the hands of such blatant incompetence and stupidity is for me, a death sentence. My own government is spending hundreds of thousands of tax payer dollars to deny me from simply getting back my own money that I paid into SSA for the past 34 years is nothing short of a crime, especially when the person deciding my case has already admitted in writing that she doesn't understand a term that any 4th grader comprehends fully. What's really scary is that I am only one of millions of Americans who are subjected to this kind of inexcusable incompetence from our own government, a government we are paying for. The judge is no better than me. Her income comes from the same place my benefits would come from - the US taxpayer. Except, I paid for my benefits - it's my own money for God's sake!

I applied for Social Security Disability September 2011, I worked 32 years. I have had Epilepsy since age 11. My epilepsy consist of Grand and petite Mal seizures, i have rheumatoid arthritis for the last 8 years in my spine and my hips. and i was diagnosed with spinal stenosis back in April of this year 2013 i have been taking epidural shots and I'm in a scooter wheel chair. My disability hearing was August 5th, 2013 location Social security administration building in Phoenix, AZ decision was decided October the 1st 2013. My case was finally closed December 24th, 2013. My case was denied by Claudia Rosen-Underwood. During my hearing the judge asked a Vocational rehab specialist can Tammy work 9 different jobs-each time the Vocation rehab Specialist said I was not able to work, and my Neurologist said I was no longer able to work and my family doctor said I was not able to work both doctors sent social security and my lawyer letters stating I'm no longer able to work. Claudia Rosen-Underwood stated in my social security denial letter she questioned both of my Doctors credibility! ..and she questioned my fathers, who is 78, credibility and said me and my Husband were Lying about my epilepsy and me of lying about me having a Stroke in 2005..and Doctor Shaw) sent me to have a. Cat Scan and MRI both test show Siezure Activity, Even though My Past Doctors and present Doctors have sent all my past medical records to show everything is 100% true

This judge gave great weight to the testimony of the experts who did not have a face-to-face interview with me and little weight to the doctors who had a personal face-to-face interview with me. Judge Harrell's final determination was filled with subjective inconsistency and relied on his on medical reasoning. Judge Harrell played doctor with my case. Of course, I appealed to the board in Virginia who discovered that the audio tapes of the medical doctor and vocational experts were missing and remanded my case for a new hearing in front of a different judge. Judge Harrell definitely needs a refresher course in ethical behavior.

She is so unprofessional. She discredits every doctor you have even if they are the treating physician. She outright states that there is a disability, but doesn't believe the doctors, even when there is FDA evidence of the challenges one faces. Distorts information and twists the hearing so it is not in favor of the person to receive the disability payments. She will even discredit their own doctors and not accept their evidence. She places so called experts on the stand that know nothing about the disabling conditions, than uses their testimonies.

She and her team of consultants not only ignore the medical evidence of disability, they outright state that there is none, making her decision so obviously biased.

Judge Harrell is very intimidating. In addition, he broke Social Security laws when I had to see him more than once, and he referred to my previous hearing when I had no legal representation. By SSA law, he was not allowed to review my previous hearing because I did not have legal representation. SSA law also states that once a judge had denied your case, you will not see that judge again. Further, he intimidated the Occupational Expert when she said there was no job I could do. He basically forced her to change her decision. To cover his errors, he claimed that he audio portion was distorted, and I had to return again. All in all, I had to see him three times and he broke at least 3 laws. He is the head of the judges in the San Bernardino area. AWFUL JUDGE!

He is very nice, calm and pleasant in the court room, but has no clue how to make a descision! He contradicted him self in my denial letter, stating I was extremely symptomatic when in hot environments, and is unable to stay standing for longer than 10 mins. THen he says the job I can do is a Parking lot attendant. Come on man it is 115 degrees in arizona how can I be a prking lot attendant! No CLue!!!!! I have now started a new claim and am already on my redecision. THey said they have to uphold his decision. Hello

He is nice at the hearings but it looks denies a lot of his cases. He will allow you to make and opening/closing.

She is a friendly judge at the hearings. You want to make sure you prepare your client to explain their limitations well. Because answers like "a while" or "not to long" is not going to work. She does tend to use ME especiall in psych cases.

When I went into my hearing with Judge Wynne O'brien Perdons I was happy to hear that I was going before a new judge. I have never in my life been before any type of judge or any law enforcement, so to hear she was new put me a little at ease, since this whole disability world is new to me. God knows, I would much rather be able to work then go through all of the chronic pain and suffering that I go through every single day and every night, as I am sure many other people out there who are truly disabled would agree. Looking back at the day of my hearing I was so nervous I couldn't think straight. For me; It was like going to a doctor and having so many questions for them, and wanting to tell them all of the things that I battled physically during the month, but my mind goes completly blank at that presice moment of course. When leaving my appointment all of the questions I wanted to ask comes back to me like a flood, and I would think to myself "I forgot to tell him/her this or that". Unfortuntely, my case was denied, I think because of my own testimony and other reasons. When my hearing was over and I walked out the door, all of things I wanted to tell her came back like a flood, and all I wanted to do was go back in there and cry out for mercy because the pain I am in all the time, and I know I cant work, but I didn't. After reading her desision all I did was cry for days. I felt her jugement of me was so unfair because things were taken out of content, and I truly have alot of pain, how can chronic pain even be measured? I have worked hard all of my life, until I finally had to admit to myself that I am disabled. This was a very hard thing for me to come to terms with. After reading some of the reviews regarding the other judges, I was glad that I went before Judge Wynne O'brien Persons. Best of luck to all of the people who are truly disabled, but were denied.

Judge Shave seems very nice. I do not approve of comments that she made about my case. She got information about me that when she blerted out a question about something I said to a Disability Psych. that did a interview with me was way not correct. I feel that she should not attack someone in that way. What was said is Depervation of Character and was way out of line. I would like to see that report and set the Record Straight. She took 3 different accurances and 3 different people and combined it into one incident with 1 person. Which leads me to believe that she was either fed the wrong information by someone that was not listening completely or she intentional did it. I would like to think she would not do that. She stated that she was not medicaly qualified to look at pictures that go with the report made by a Qualifed Phyician and Surgion who took the pictures of my insides, So my question would be how can you be qualified to do a Medical judgment as to if a person is truly in pain or disabled. I feel that judges that sit on this panel should have a medical background in order to get the right decision. Other wise this is a true injustice to the persons she or any other judge that has the authority to make the decision as to how much pain or the nature of the persons true disability.
