I had a great experience with Judge Smith! I waited 7 years to get my disability and just happened to have he hardest judge the first time. With Smith he listened to me very intently and he was Curtious and fair. He approved me right there but did not want to step on the previous judges toes so he gave me 32 months backpay with full benefits. He’s ranked right in the middle of being a fair judge and that he is! Thank you Judge Smith for everything. I know your job is hard and I appreciate how you handled my case. People you better have your doctors on top of all of their paperwork and you better have a darn good reason for coming to see him for disability.

He scares me, but I trust him at the same time. I just Hope he doesn't believe what the medical expert wrote in my interrogratoy! The medicaid doctors at the beginning thought i was crazy, and i became very upset when one of them said I was just looking for drugs, I cursed at her and said no i want to go back to work so i can support my family! With a few F words, so of course the medical expert blew that up out of proportion.

I concur. He seems to have a problem accepting VA opinions. Will often send out interrogatories and ask questions like- does claimant's impairment meet a listing. If they did meet a listing , most cases would not be at ODAR.

Comes from somewhere in Kentucky (I think)- has the cutest Southern accent and he's sweet as pie. Don't be fooled: he'll deny for reasons completely foreign to me. He almost always send claimant to pre-hearing consultative exams, or send for medical interrogs. Sometimes he uses them; sometimes he doesn't. I have not seen any particular M.O. with him. Just watch out....
