I had my hearing with LR Bailey Smith recently and instead of asking appropriate questions pertaining to my physical and mental health, she proceeded to pass judgement and berate me about something she doesn't know the factors and schedules are about,I couldn't give the details because she made her mind up by the time I left the hearing.She is rude and condisending. My faith is in God Almighty and he will shine through the darkness. Rating is a -0 Stars

Had my hearing with Judge LR Bailey Smith today. Not sure how it will turn out but she seemed professional and well spoken. I was uncomfortable and in a little pain but she was patient with me even when I accidentally interrupted her. I have no idea how my case will be decided but I think she gave me a fair shot at presenting my case. It's in God's hands now. I have to trust in that.

Ju Judge : Kyle C Alexander. 04/11/19 6:12 pm I have been in front of this judge,for one he's very rude doesn't listen actually I couldn't even talk I'm 57 years old and I have serious neck (already had one surgery) repair disc degeneration didn't go that well more degeneration in my spine and couple other things that has caused me not to work, anyway denied 2 time same thing 3 time same thing happened should not even be on the bored to hold folks future in his hands it you get this judge good luck because your probably not going to get approved I think all the disability lawyers need to do what ever it takes to get him off the board and hope he never has something as painful as we are going through,he will meet his maker and I hope he as hard on him as he is us that really need disability, he doesn't need to be in this position.

Our family is personally devastated by Judge Bennett's ruling. He ruled against our daughter's disability hearing. Our daughter is 23 years old, has schizophrenia, has an IQ of 78 and is at the developmental level of an 11-year old. She works part-time at a school cafeteria with help from kind staff. At home we help her wash her hair and with dressing appropriately.Today a dental hygienist was upset because we weren't helping her enough with her teeth cleaning and she had black substances and tartar on her teeth. We have an older child with Aspergers that we have not sought disability for as she is able to work. We also rehabilitated another child with Tourette's and our youngest with ADD. Out of our 5 children only 1 is free of neurological challenges and yet we have only sought disability benefits for our most severely affected child. I work as an RN and my husband is a PA. Every day we see people more capable than our daughter who are receiving disability benefits and it is appalling to us the irony of the whole situation. I think judge Bennett needs to spend a day at our house washing our daughters hair, brushing her teeth and driving her to and from work. 11 year olds don't drive. And if she truly is at the developmental age of 11 arent there laws against child labor? Maybe we should just have her quit her job too.

Very unfair judge. Did not ask me any questions about my condition, yelled at my lawyer for simply asking me a question, she had her mind made up before I ever went to the hearing. She said she puts no weight in the doctors opinions that have been treating me for over five years. This judge went out of her way to twist the truth and hurt me. I'm 100% disabled and will be homeless because of this nasty woman. This system needs to be overhauled. If you're a white man you don't have a chance of getting disability with this judge.

I had Judge Annos twice and he found me unfavorable both times, the last time 2/14/18 and I just rcvd my decision last wk....Judge Annos does not have a heart and he is not fair. If you have him as a judge, you are doomed!!!! I have bipolar I, PTSD, agoraphobia , and take 5 meds for my mental disorder. I have been fighting for my disability for over 4 yrs and I will never get it with these judges as I am called a liar and they feel my testimony does not match my dr notes bc they say I am considerate and polite. I dont go to the drs office punching walls or barking like a dog. Also they say I can no longer be a Case Mgr or CSR but I can be a Housekeeper or clean eyeglasses. Annos is heartless, period!!!!!!!!

Judge Kyle C Alexander, You gave me a few off the wall jobs that your Specialist said I could do. I'm asking you to help me find one of them, mind you one that I don't have to talk too much, because as I stated in my previous message I sent and as you well know, I lose my voice because of a partially paralyzed vocal chord. You said in your Denial I refused to get surgery to correct it, but what you didn't ask is why I didn't want to get the surgery. If I had the surgery there were risks not worth taking....I need you to show me the job, where I don't have to worry about my Back, knees, or feet hurting and burning from just daily living.... I want you to please remember that I am Human. I didn't ask for all the health issues I have, that when compacted together cause more pain that I Pray you or a Loved one ever has to face. If you can find me one of those jobs I can do with all of the daily obstacles I face, then please let me know what it is.

Judge Colon was fair and impartial to my wife’s disability case. Talking with many attorneys who appear in front of Judge Colon, she is fair but not one to approve unless the facts meet the criteria....if you do not quantitatively meet criteria listed in the blue book and/or can not prove that you do she will likely not approve you. We just got a fully favorable decision after a 2.5 year battle with SSD, my wife has a rare auto-immune condition and subsequently developed metastatic cancer. Judge Colon approved us in under 60 days which is more than fair and showed compassion. I think many of the Colon haters who write could not really prove their cases in a way SSD requires, so do this if you apply: 1. Study the blue book. 2. Get a good SSD attorney, it’s a max of $6,000 in FL + attorney expenses and worth every penny 100x over. 3. Have good quantitative medical evidence that aligns with the blue book requirements. 4. You need to manage your attorneys, doctors, and getting information to the judge. We were very actively involved in managing this process, relying on no one but ourselves to get not expert tasks done. Have these things and you will get a fair chance to get approved. We want to thank Judge Colon, she did right by us as we need the SSD to save my wife’s life. Thank you Judge Colon.

Judge Alexander saw me & immediately made the comment that he read what the Doctors said, but I was too young to be having all the problems I was. He then sent me to his Dr. who even said that I would not be able to lift over 20lbs, stand too much, squat, bend, put my arms above my head, climb stairs, and yet I was still denied. He had the date of my Disability incur switched to when I filed, even though I only was working because SS said I needed to work another year in order to even file, because I was short credits. I have General Anxiety Disorder, Hypothyroidism, Hypoglycemia, Hypertension, MVP, a partially paralyzed vocal chord, Tendonitis in both Wrist & Elbows, Tarsal tunnel in both Ankles, Arthritis in both knees, Scoliosis with Herrington rods, Degenerative disc Disease in my lower n upper Back & Cervical Lordosis, Bulging disc in my lower spine. I can not talk for more than 20 minutes or I will lose my voice. I can't walk for more than 30 minutes without hurting, I have to sit in a lounge position and even then my bottom falls asleep & hurts. I take medicine for my Pain, stay fatigued, trouble with my Memory & Hair loss, constipation, weight gain, mood swings. According to the Judge & the Vocational Rehabilitation rep. that called into my 2nd Appeal I can work certain jobs, mind you I have a High School education and my job experience is in Child care & retail, 2 jobs I can't do again. All I can say for certain is that I am a Christian and I know that God has me facing All of this for a reason. The Judge had a Chance to be fair, but he wasn't, but I am not going to hold it against him. I forgive him, after all he will have to stand before the Lord one day & will have to answer for the Judging he does.

She was nice but she seemed passive aggressive. She did not seem to understand the extent of my issues and kinda joked around too much when I mentioned that I needed assistance with my children at times. It was hard to read her but it was also off putting when she did not let me mention my medications either. She said that alot of people are on medications and work...so lets not go there. I heard she was detailed and through...however in looking at her decision write up she was extremely judgmental and provided very humiliating reasons why she did not find me disabled. She found every one of my doctors not credible because they were military doctors and did not fill out paperwork to deem me unfit for a civilian job. She mentioned that a military job is harder than a civilian so I can adjust to a civilian job just fine. Military doctors and Veterans Affairs Providers are not in the business of telling you that you are unfit for any job whatsoever. They write their assessments and notes. I was stunned at her incompleteness and her lack of knowledge on my medical records. She even said that I never had a back X-ray but claimed back issues...I had an X-ray that was provided as evidence that diagnosed me with scoliosis. She was horrible. She said in her write-up that i was clean and wore accessories. Does that mean that I am devoid of any issues bc I am clean and wanted to wear my beads. I am stunned. Not that she disagreed with me...but that she was extremely judgmental and partially reviewed my records. She even wrote that i barely cried in any of my appointments. Really Judge? Really? It was disgusting. As a matter of fact it was noted many times that I was often tearful at my appointments. I am disappointing in this system and even more frustrated that it as been 5 years and I have already been to Federal Courts. Looks Like I will be going again. Thanks alot Judge Maley.

I felt the judge was more interested in my drug abuse history more then my disabilitys he asked me more questions about drugs then about my work abilities and i was warned before i went into the hearing that he was anti drugs and to try and rush by the question and move onto health questions but it was impossible i almost got up and walked out of the hearing from crying so hard and yes i was denied and in his denial letter it Contradicts its self so i really pray the appeals bored listens to the recorded hearing and reviews his reason for denial letter because non of it makes sense i knew i would be denied just by the way he treated me if i could rate this judge -stars i sure would

I've had real good experiences with ALJ Onderack. Appeared in front of him 2 times and both clients had severe mental issues and anxiety. ALJ Onderakc was very professional and patient with the claimants. I will say this ALJ asks more questions and takes control of the hearing more than many other ALJs

I represented a claimant before this ALJ recently who suffered from a mental illness. Onderak was dismissive and demeaning to the client and attorney throughout the hearing. I spoke with the representative who immediately preceded me and he had a similar experience. The ALJ spent a considerable amount of time questioning irrelevant drug history, some of which was non-existent in the medical records. He gave one hypo during direct of the VE that in no way corresponded to the magnitude or severity of the symptoms the claimant suffered from. He also made an effort to control cross-examination of the VE by refusing to let the VE answer some questions. Onderak was completely dismissive of the claimant and the attorney despite medical records and opinion statements (corroborated by the records) that more than demonstrated a medical listing was met. I cannot understate the lack of professionalism that this ALJ exhibited from the bench. Onderack demonstrated a severe lack of judicial temperament and professionalism throughout the hearing.

Hi, I would like to say that I consider Judge Alexander to be a fair Judge. He asked detailed questions and actually listened to what I had to say. I thank him for approving my case. My only problem is that now that I'm approved, why is it taking so long to get the process started. I have been waiting over 2 1/2 years. My lawyer, Deborah Grossman, has expedited my case and we still have no results. I have lost everything I have waiting. I am single and have no one to help me. My mom has been doing her best but she only gets 969.00 a month in SS. She can no longer help. I can't afford to go see my doctor or the specialists. I can't afford to get my medication. I am in so much pain. I need to see my ENT because I'm afraid the cancer is back in my mouth , I have been suspecting it for about 6 months.

I have spent the whole weekend crying.... Of course I was denied, my judge was Colon. I don't know what to do, it's disgusting to know there are so many out there claiming and abusing the system Totally disregarded my Drs info and gave heavy weight to the state dr I saw for all of 10 minutes, furthermore she threw in some total bs for good measure. Can someone explain how the woman still has a job and why with so many complaints she is not being investigated? She needs to be disbarred.

I was very surprised with the judge, after reading these comments I'll admit I was worried about nothing. I found Judge Alexander to be very nice and seemed to really listen to what I had to say. He was pressed for time, but allowed my attorney to present the particulars about my case. After testifying and answering the questions he had, I was approved. Part of my case was not even presented due to missing doctor notes! I can only say to be prepared to testify. It's not just about a diagnosis but how the diagnosis affects you and your ability to work. A vocational expert will be there to testify about any work you may be able to do despite your disability. Make sure you have proper documentation also. You need to be under a doctors care, and not just go in with an opinion from a doctor.

I had my hearing with Bennett. Watch out for this judge, he picks and chooses things you say and dissects the parts that are out of context that he uses for his reasons to decline your case. He even added in his decision that I consistently smoke cigarettes and I DONT SMOKE, so he added FALSE information on my case. He took more weight on the Social Security doctor who saw me for 20 minutes, one time, 2 years ago and disregarded my doctor who I have been with for over 11 years.

I had a hearing with Him and he was extremely caring and really put my anxiety at ease to where I was able to explain myself and go into great detail of how bad my physical and psychological disabilities are. I was so scared for months before my hearing. I was mentally and physically exhausted. He took the time to listen to me and was so sweet to me. I was recently denied with all the health problems I have such as congestive heart failure what's a pacemaker /defibrillator, kidney failure, diabetes which I have to take three shots per day, asthma, shoulder replacement which I can't lift 10 pounds ever, arthritis, gout, plum sized hernia in my testicles, walnut sized hernia in my stomach, lungs constantly filled with fluid I mean making it difficult for me to breathe. I had to go back to work doing a different occupation because I was denied Social Security 5 times before that so I had to work to pay my bills and was hospitalized three times in 10 months of working at the new job, also I'm on 13 different medications which makes me dizzy and sleepy, by my working I had to skip dosage which made my conditions worse, the judge did not take that into consideration she pretty much denied me for going back to work. Very unfair judge I guess she get big bonuses for denying people.

I had this same judge. I thought it unusual she would ask through which employer I collected unemployment, what I like to read, why I cancelled my appointments with Vocational Rehabilitation and who scheduled my mental health appointments. Those questions, in my opinion, had nothing to do with my disabilities...maybe she rationalized if I was able to do those things, I could work. There's a huge difference between being able to function at home and in the outside world. I don't work well with others. Haven't received my decision yet but was told by my attorney it could take up to 6 months to receive, which is due to the slow processing of the staff, not the judge. So, I just have to wait it out...by the time I receive a decision, I will be homeless. And, BTW...who cares if the Judges see the posts on this website?

This judge is not a fair judge. He needs to step down. He has no compassion. Sits on his perch gives you the "mean eye" thats when all your positive goes out the window. I got denied and now are having to go thru an appeal and also was just diagnosed with hemiplegia and i am now in a wheelchair. Thank god for Medicaid because i would not be getting the medical help for my condition. He forced my hand to go on welfare.

My attorney sent Neuhoff 120 pages of med records the day before my hearing. I show up and sit for nearly two hours then the judge decides she won't hear my case at this time. So now I have to wait again. She could have told the attorney she wasn't hearing it asp we didn't waste our time. Idk if I should be pissed at the judge or more at my attorney

We were very unhappy with Judge Colon. Besides waiting 6 1/2 months after the hearing for a decision, that was nothing. We were told afterward by my husbands attorney that she only goes for mentally ill claimants. My husband has been sick for a long time but did not apply for SSD right away because he was trying to get better but only got much worse. He has severe depression and anxiety, neck and back injuries, neuropthy throughout his body, vision problems, can't stand or sit for long without a lot of pain and very bad swelling in his feet and ankles up his legs with his legs getting bright red, early stage 4 kidney disease, heart disease, chronic kidney stones, passes out for unknown reasons and trouble breathing, he has oxygen. He was denied, even after the VE said he could not perform any of the job duties and would be fired. He said this on every job that was brought up. He has like 5 different specialists that he sees aside from his primary doctor. I am to the point that I don't know how sick someone has to be to get approved. She is being discriminating against the people that are not mentally ill. For the one person that is for her, yes people would be happy if they won, but there are plenty of people out there including my husband that are truly sick & would love to work and can't due to his illnesses. He has the documentation of everything and all his doctors don't understand why he has not been approved. That he should absolutely be on it. Something needs to be done about Judge's doing this to people.

This judge is often cold, and disconnected from the claimants. She will interrupt you, she will cut you off, she will ask about miniscule things in your clients' records and use them against you in your denial. She has misapplied the law/facts in several of my cases, and has been appealed.

I was turned down as well. I have told this story so many times it makes me want to vomit. I would like to know how to contact the persons on this site. I feel for all of you as well as myself. I was represented by an attorney and they dropped me after she turned me down. I appealed myself to the council in Falls Church, VA on 7/11/14. I still have not heard from them. Yes, Feeling Forsaken, she did the same thing to me as well. The vocational expert said I was not able to perform my past work and she managed to find some loop hole... there isn't one. She is the most feared Judge in the area. If anyone wants to contact me feel free... I am beside myself! We need to do something!

I recently had a hearing with "Judge Scurry". I do feel that he does try to take in all of the information that is being presented before him. A different poster made the comment that no one was allowed other than the AlJ judge, reporter, lawyer & VE(Vocational Expert). Not even for moral support. To that poster. If you do any research at all it will tell you that you will not be allowed in the room as well. Most ALJ's just do not allow that. Even if you have a witness they will be called in & then asked to leave after their testimony is complete. Also it could be made that that poster did not receive a favorable decision as well. Now back to Judge Scurry. I do feel he was very polite, well spoken & thoroughly reads the case file & asks appropriate questions needed to make a decision. I did not receive a "Bench Decision" but am very hopeful for a positive outcome. I do wish all the best who go in front of this judge & just a word of advice. Have an updated medicine list, dates of employment, address & common need to know list with you. He does ask these questions to you, not your lawyer. He is very, very thorough!

I thought the coldness I felt during my hearing was just me, overreacting! I had notes from Doctors stating Iam disabled, I have multiple conditions i will have for the rest of my life. I was given an unfavorable decision and it hurt! Judge Colons notes even stated just because someone seems sincere, wow so I am faking 4 years of pain and mental issues. The biggest problem I have with this is how can a Judge override what a Doctor or ARNP has written and say it isn't so! Who has hurt this woman? I sat there and just shook my head, even as she sighed and rolled her eyes I kept my cool. I am so disheartened in this system, I have lost faith in this process. I have always treated others with respect and kindness and worked my butt off, now I cant get the help I deserve? Please pray for me and my family as I appeal this decision again. The twisting of the medical records and ignoring recent records and advice of Physicians is just unbelievable. How has she gotten away with this for so long? No judge is above the law. Based on everything I have read, researched and personally experienced concerning Arlene Colon, it is very concerning that she is demonstrating a bias toward SSD applicants. The link I have copied and pasted below will provide everyone with the information they need on how to handle any Bias or misconduct they have undergone by this judge. The Division of Quality Services in Falls Church Virginia has the authortiy to investigate and take the necessary action concerning bias or misconduct by any Administrative Law Judge. We have all seen what one person can do with the recent events that surrounded the mistreatement of our Veterans by the VA and it is becoming obvious that the SSA and many Adimistrative law Judges are refusing to abide by the guidlines that the judges are bound to adhere to when making a decision. Judge Colon's approval rating of 21% is nearly 30% below those of her fellow judges at the St. Pete ALJ and 23% below the national average. This in itself is a cause for concern. Statistics do not lie and we can clearly see that based on these statistics along with the voluminous testimonies concerning Judge Colon, it is now time that we become pro-active and take a stand. Many people are afraid to report the actions of a judge or believe that there is no overseeing authority. The link below will show all of you that this is not the case. Let us also not forget the power of the media and what it did for our hero veterans who also suffered injustices which regrettably resulted in several of our heroes dying.

I do not believe that Judge BaileySmith makes fair decisions regarding social security disability. In my decision she stated that she gave NO weight to the governments doctor that evaluated me and stated I should not work around people. She stated she gave NO or no weight to my treating doctor who said I did not need to work. She did give weight to a doctor that I saw for 8 weeks & that I told constantly I was still in pain, but he told me to wait a month and see if I was still hurting... She stated I could sit for 30 min/then stand for 30 min all day and work like that. But my medical records state I am in pain if I sit or stand. They also state my medication makes me drowsy, as I've fallen asleep twise on the interstate already trying to do the right thing & work and not ask for help. But since Judge Bailysmith wants me to work if I hurt myself, or someone else because she chose not to believe factual statements from medical professionals and the patient then it will be her that has to live with that decision because I have not driven more than 5 miles I since it got so scared from falling asleep at the wheel after being kept up all night in severe pain. I didn't want to stop working, I had to quit working. I do understand that there are people that don't deserve it, but this is something I actually needed. I've never ask anyone for help before, and I've worked since I was 15 years old. I didn't ask for this pain. It's hard to understand unless you live in my shoes.

I have just received my "answer" to my case which I have been fighting for 8 years this April. Unfavorable! My last hearing was in December of 2009 when I was denied by her "mentor" (now retired), Phyllis Pierce. Ms. Pierce denied my claim in a mere 3 days. Judge Colon LIED about the facts of my case (just as Peirce did). Twisted the evidence set before her to suit her "decision." And in fact, I was not even afforded a hearing this time. Just an "unfavorable" after waiting over 2 years from last "decision." Her reasoning, no point in it as I already had one. My case (and the evidence that supports my disability) are so strong, I have won in Federal court twice. Second time the Federal judge was LIVID that the SSA did not do their jobs and ORDERED that the evidence be considered. It was not. Five doctors have all agreed that I am disabled, yet Judge Colon seems to fancy herself an expert above them all. I want to know who is policing these judges who are not doing their jobs. Playing fast and loose with people's lives and the EVIDENCE that supports valid claims for disability benefits. She should be fired! it is just that simple! If you cannot do your job without preconceived ideas and be unbiased, you have NO business doing this at all!

I found out my judge the day I had court and looked at the list and was very disappointed in who I had, based on reviews and ratings I didn't think I had a chance. In court he was nice and focused on my medical records and my job service papers and voc rehab reports (from multiple counselor's). My lawyer helped me a lot dealing with explaining things as I was VERY nervous. About 3 months later I got fully favorable and was in complete shock. I was happy cause he addressed my issues and noted how I had really tried to work and was unable to sustain gainful employment. I have to say he was very fair with me and I think as long as you show serious attempts at working he will respect you and give you a lot more "weight" on you being disabled. Again this was my personal experience.

Judge Scurry was very polite when my husband had his trial. However, he does not allow witnesses to testify (or at least did not in our situation) or even come in the room and simply be moral support for the person who is before him. He seemed as though he was genuinely listening to the testimony given but when the decision was made hardly any of the testimony or evidence from the attorney, doctors, etc. was mentioned. I feel like his decision was made before we ever entered the courtroom. Some information in the decision was incorrect and truthfully made no sense. We feel like that we could have gone in the courtroom and said the abc's or spoke in a different language and it wouldn't have mattered because he seemed to imply that the statements made in court were untruthful. I don't know how others who have had cases in front of him feel, but considering his denial rate is 10 points higher than the national average, I feel as though we did not have a fair trial and, as I stated before, the decision was made before we ever entered the courtroom. We are very displeased with Judge Scurry and would be fearful and worried if any friend or family member were to be going in front of him for their disability hearing. I do not know Mr. Scurry on a personal level and my opinion of him as an ALJ is solely based on our experience with him in that capacity.

The chances of getting a fair hearing before this Judge are not good. It almost appears he has a bias toward injured claimants. Any adverse medical opinion will be adopted in his decision. As a representative who practiced in front of Judge Colon for over a year, I can only say this line "Some of those who are taking this so personally may not have been well-served by their representatives" is off-base. Judge Colon's denials were poorly and dishonestly written. At many points in her Unfavorables, she quoted half a sentence, out of context, while deliberately ignoring other evidence. In one denial, she claimed my client was not credible because she has filed for disability three times. Of course, the record showed those three times were 1997, 1999, and 2008, with almost a decade of work after the second. Of the six denials I received from Judge Colon, Federal judges over-turned five of those decisions. The problem is with Arline, who is an embarrassment to SSA, and not with the representatives who practice in front of her

If I get denied there is no way I could be angered at this Judge. He and his reporter and also the vocational expert done all they could to make me comfortable. I'm deaf so it couldn't have been easy for them to communicate with me without sign language. Had my hearing 3 weeks ago, I hope I get approved but if I don't, it will certainly be because of something I didn't do right or that was necessary. He is the absolute worst!!! If you get assigned to him, try your hardest to get another judge to rule on your case. He make me think I was approved & then a few days later, I received the denial in the mail. It was all a big joke to him. Apparently once you get a judge, you will get him again on any appeals. Even with all the medical proof I have of my injuries, as well as doctors notes, it won't matter. I feel doomed all because of this man. It is so unfair. For this reason, I'm leaving this state. I had my hearing on Sept. 20,2012 with Judge Craig. He was very professional and caring at the same time . Made me feel at ease immediately , as did the reporter. I was impressed at the kindness that the Judge and reporter showed. The reporter (would love to know her name!) came to me prior to the hearing and made sure how to pronounce my name correctly. My attorney advised me to arrive 45 minutes early as this Judge did not waste time. The hearing was scheduled for 10:15. To my surprise my attorney and I were called into the conference room and it began at 9:40. Lasted about 25 minutes. The VE was on a phone line and testified via teleconference. As nervous as I was before the hearing, I was delighted at how comfortable they made me feel . Judge Craig then advised me that I would be notified by mail as to his decision. Very satisfied with the entire process.

I think it is more sad that someone believes an ALJ can't show bias in spite of her giving fake smiles or not yelling. I think most people could really careless whether an AlJ will play nice to get you to talk and then deny you or just go by the book. However, if an ALJ is only paying 23% of the cases he or she is adjudicating then they are not applying the law. Yes, the grids are beneficial for people over 50 but that does not mean people under 50 aren't disabled. Further, each case should be reviewed on an individual basis and if she is not paying people are under 50 strictly because of age then she is bias, no matter how nice she is to you.

It is disappointing to read the wildly uncharitable comments made below about Judge Colon. In my experience, she is an extremely knowledgeable and hard-working person who seeks to apply the facts to the law in an unbiased fashion. I understand that people are going to be quite naturally displeased when they do not get what they want. Some of those who are taking this so personally may not have been well-served by their representatives, who should have explained to them that just because you know in your heart with all sincerity that you have a certain problem does not always mean that you have presented sufficient evidence to prove it. Everyone loves the judges who unscrupulously give away the store to nearly every claimant, whether it is justified or not. However, that is the easy way out. All of the incentives in this system go in this direction. Judges who do not give in to this relentless pressure do so because they feel an obligation to call "balls and strikes" as they see them, knowing full well that at least one side very often wont like the call. Judge Colon may adjudicate cases conservatively, but she shows no signs of the bias she is unfairly accused of here. Does she berate the claimants, make sharp comments toward them or abuse them in any way? Does she behave at all in an unpleasant way toward them? Anyone who has dealt with her can tell you that she does no such thing. I might not agree with her every decision, but I know she is calling them as she sincerely sees them and without an ounce of malice or bias against anyone. As for the alleged bias against younger claimants, that's not Judge Colon, that's the way the rules are written. The "grids" heavily favor older claimants. Finally, to the rep who suggested that you are better off the more evidentiary support you have for the claim: Well, yes, that is the way this is supposed to work. This just proves my point. The better your evidence is, the better your chances are. I would be far more concerned about a judge for whom this was not the case.

We were told by our attorneys prior to the hearing for my aunt to hope that the assigned judge wouldn't be Arline Colon due to her reputation for fixating on any scraps of testimony to hang the "denied" hat on. Unfortunately bad luck came our way and my aunt got her. Not surprisingly, her subsequent verdict was to deny any benefits despite doctor statements supporting such. Quite the android. Perhaps justice will be served if Colon suffers the misfortune of a genuine injury and goes before a judge like herself who thinks she's faking it. Maybe she'll also get to endure the ignominious recommendation to become a file clerk (even though she can't sit in one place for more than 10 minutes).

I broke down often during the hearing, as the whole ordeal of the past several years has taken a toll on me. I do not WANT to be disabled, but I am. I think she understood that I wasn't just someone looking to avoid work, or trying to get it for an equally undeserving claim. I may get denied, but I do feel that she will be fair. She's evil. She may appear nice during the hearing, but don't be fooled: when your decision comes out and it's unfavorable- it's character assasination. She doesn't like young people, she doesn't like overweight folks. Even older people who served our country who walk with walkers can sometimes not get granted. A LOT of her unfavorable decisions are being upheld at AC and going to Federal Court, so she's probably not getting enough remands to know what she's doing wrong. She also dismisses a lot- and unfortunately, her dismissals are usually appropriate. But again- evil. Wish I could give you better advice on how to win a claim with her, but I only know for sure what she won't pay (above) and I can't figure out what she WILL pay (ex: she paid an younger individual, SSI only, smoker, with back/heart problems, on oxygen- not compassionate claimant at all- fully expected denial). I think the more support you have (RFCs AND narrative reports) the better you are.

Please do not trust this ALJ. He appears to be nice but this is his avenue to try and trip up Claimant's. He is blind but yet routinely has video hearings which is a joke. A Claimant's appearance at a hearing and use of assisted devices should be something an ALJ should be able to see. He has developed a bias towards Claimant's as a result of his blidness. Very unfair judge! Don't expect even a "slightly fair" hearing, even if you have multiple long-term, progressive/degenerative conditions. She does not consider numerous obvious & pertinent FACTS, which are provided to her...clearly and detailed, in black & white. Her main focus is a person's age and whether or not they have been able to work while going through the SSDI process. She DOES NOT take into consideration that some people push themselves way beyond their mental & physical limits, to the point of having NO personal life whatsoever due to severe chronic pain and major depression, just so they can keep a roof over their head and not end up on the streets. People like Judge Colon should NOT be employed by S.S.D., where they are required to make "FAIR" decisions for the U.S. Government. She gives the entire process and that division of the government a VERY bad name.
