The statistic cited utilizes defective logic. The dismissals are not determinations on the merits. They are usually cases where there was a late filing, and a large number such as here usually indicates that the ALJ was tasked with reviewing a large number of such files. For cases on the merits, there were 93+69=162. 93 of 162 were approved. Ergo, 54% approval rate. If this site is going to present data, it should not be presented in a misleading manner, such it is indeed here. Get your facts straight. By, an experienced advocate who has appeared in front of scores of ALJs for decades.
