His approval rating will fall into the 30s soon. Having practiced SSD law for over 30 years, I knew when I first appeared in front of him my claims were heading toward Appeals Council. He takes over the hearing and asks leading questions of your claimant that are calculated to provide the answers he wants to find against him or her. Now that the law allows judges like him to apply great weight to the opinions of the consultants, he will and already has utilized that rule to increase your client's RFC to a level that conveniently results in an unfavorable or partially favorable decision with no back pay. He will ignore additional limitations when he constructs his RFC and frames his hypothetical questions. Be ready to respond to this by crossing the vocational expert and point to specific exhibit numbers as the basis for additional limitations. You have to get your file ready for Federal Court as his denials are often no based on substantial evidence.

He comes across as a "nice guy" and knowledgeable, as a Judge. Then...you look at his Decision and wonder whether he was even in the same Courtroom as you and whether he has ANY knowledge of the medical Cases he presides over, at the Disability level. You'll note(As of this writing.), that he has ONLY approved 37% of Disability Cases. It ISN'T due to much in false Disability claims, as he is an Appeals Judge. In order to go to Appeal, it must first be approved and THEN you must learn how to survive for anywhere from 12 months to 2 years to have your Case heard. In my situation, I have a wife and she(With Parkinson's Disease, Lupus and Fibromyalgia.) has been supporting our family since my disabilities prevented me from work. This is my 2nd time "through the ringer" with Disability Judges and this has been ongoing for almost FIVE YEARS(Almost 2, of which have been wasted, waiting on this "Judge" to write a 15 page, "clown car" Decision that had little to no reliance on the FACTS of the Case.). I wouldn't recommend this Judge, nor do I fid him as competent to do the job that was assigned "By the People", as he is all about preventing proper care, for those who aren't in need of ambulatory care on a daily basis. I have 2 diseases that are 1 in a million people, a "rash" that is "contained" under low physical stress(perspiration takes it to covering my body.), ongoing Hydradenitis(I get boils/infections that lead me to being hospitalized if I sit in one place too long, perspire too much.), spinal degeneration in my neck, upper, lower and middle of my spine and a myriad of other illnesses that combine with these things to make work...unattainable. Does it matter to him, sitting upon his "pulpit" of "Law"? Not at all. Back to the drawing board? No. On to the Judge Panel in a follow up Appeal. If they approve the medical problems, based on my experience over the past 5 years...not much in faith with this clown of a "system". Now for the biggest problem, with him: As if it isn't bad enough that one had to document anything and everything medically for Disability; this guy actually LIES about "Findings". A flippin' "Judge". SMH Even as you read through his Decision, you find him countering his OWN arguments, WITHIN the Decision. A quick, easy example would be me stating that I have a slight hearing problem(Not part of the Disability Case.) and needing the speakers adjusted for our Video Conference of which I set up nothing. I stated that I can/do go on the Web play a game, talk on rare occasion and have the comfort of my cushioned couch(Can't sit in any office chairs for extended periods, as they further deteriorate my spine and hurt within 10 minutes.) to be able to adjust as often necessary. From his Decision..I can sit in a office chair for a full day of work(No evidence ever presented to show this.), I can Video Conference Chat and am familiar with it(Never stated that, nor do I do it or know how to get beyond clicking on my video system, hitting record and having a short video.) and...I had to get them to move the speaker during our Conference, as I couldn't hear what he was saying. But...I must be an expert. RME Want the truth about Kawalek and the other Judges/Magistrates that do the Disability Hearings? They AREN'T required to have a Degree in ANYTHING medically related! I learned that from one of my old Primary Doctors, who had been part of Disability and was told/required that his OWN medical knowledge/opinion was NOT to be stated on Legal Documents, stating that a person is "Handicapped"(And similar wording.) as the ONLY person that could state it is...a Judge(No knowledge of medical required, nor needed.). The "system" is fictional and, in this Case, Judge Matthew C. Kawalek is one of the LEad Writers for the Fiction. Anyone wonder why "seemingly normal" people "turn to crime"? It's because the "System" forces them into that lifestyle, when it fails them at the Disability level. Fortunately, as stated prior, I have a wife who cares and provides just enough to scrape by. Anything less....I'd probably be being educated in some prison, FREE, and be receiving the PROPER medical care that most/all Inmates receive. When I came out...I'd HAVE Disability. What a joke of a "System" and "Judge", when a Disabled person can be "better off" by GOING to prison, over going to a Government Office. SMH@Both. P.S. IF this guy is your "Judge"...request a new Judge by yourself or through your attorney, as this guy is a flippin' joke.

Administrative Law Judge, Paul E. Yerin: You, sir, ordered BACK an Overpayment back in December of 2014-15 in the amount of $2,985.00. That money was sent to me by a check when I had already received by mail and activated a new DIRECT EXPRESS CARD. Ms. Farrell and 200 N. High Street, Columbus, Ohio 43215 set me up for another Overpayment and I was barred out of the building and all other branches when I had just got back in good faith to enter and conduct my affairs prior to the Franklin County Jail. The OIG on it's website has in a link ( TOP SSA MANAGEMENT ISSUES). See SSA.gov (Report Fraud,Waste, or Abuse), link- Audits and Investigations. Out of seven topics two stand out. The first being safeguarding Social Security Numbers and the second being Overpayments. Ms. Farrell "disclosed" over the phone of Homeland Security Inspector, Jeremy Gumringer employee phone my SSA diagnosis and stated, "I should have a payee" on the 4th floor of the Appeals and Adjudication's Office after I got out of the Franklin County Jail. This SSA branch of 200 N. High Street in Columbus, Ohio receives daily reports of individuals incarcerated and the day that a person was sentenced with the particular Judge. Ms. Vandivier employed at this branch stated by phone to me that I need to prove to this office I was incarcerated and that I tried to Contact this branch. This Office receives daily and monthly reports generated to them automaticly or mechanicly. I received two (2) monthly checks in the amount of $733.00 for the month of January and Febuary of 2015 while incarcerated and I am entiled to the January check because I was NOT sentenced until January 8, 2015 with seventeen (17) days Jail Time Credit or (JTC). I spoke to a Captain; Beverly Huff; and Kelly with the Franklin County Sheriff's Department and received the slated dates and disposition - which this Office already had aquired. (See ssa.gov The 200 N. High Street SSA branch took $73.40 from June of 2015 to June of 2016, plus the remaining ORDERED BACK amount of $785.00 - which added to $2,199.00 equals the $2,984.00 that sir you ordered back. I am also entiled to the remaining amount of $785.00 - which sir, you Ordered back do to an Overpayment issue from the beginning that I never received. Judge Paul E. Yerin: my name is Timothy J. Hoepf and you sir decided an appeal in December of 2014 concerning an 'overpayment dispute' I had with the 200 N. High Street's SSA branch. You found in favor of me and ordered back the $2,984.00. I was sent only $2,199.00 of that Order and the same office put me back into Overpayment before I even got released out of the Franklin County Jail. I recently found out through a Captain from the Franklin County Sheriff's Office that there office generates an inmate count of everyone incarcerated. This sir would mean that all Social Security Offices' in Columbus, Ohio had prior knowledge of a beneficiaries incarceration date, but may still have put that individual's benefits in Overpayment status while they were in the Franklin County Jail. The women in the SSA office at N. High Street, Columbus, Ohio 43215 DO NOT IDENTIFY recipients of SSI benefits; even managers.

This woman does not understand the most basic aspects of disability law. Her 10% approval rate is so far outside the national bell curve that SSA needs to investigate why she is so far outside the national average - to be approving no more than 10% of cases assigned to her when the national average for approvals is a bit over 50% should make it clear that something is terribly wrong with the way this woman adjudicates cases. Recently, she demanded that a dead claimant (died in 2014 and it took SSA until March 2016 to hold the hearing) amend his alleged onset date to the following year simply because the claimant had earned SGA prior to his alleged onset date! She seems to be under the impression that if a person earns more than the SGA threshold amount in a given year then that person cannot be found disabled at any time in that year! It is inexcusable that SSA would allow someone who lacks understanding of one of the most fundamental aspects of disability law to work as a judge and pay them over $160K a year to improperly deny meritorious cases up to 90% of the time. If your case is assigned to this judge, you need to move into another jurisdiction so you can transfer your file out from under this judge before your hearing takes place.

I just completed my hearing today and I have to say, whatever the decision is, Judge Flynn truly comes across as a fair and compassionate judge. This entire process has been so nerve wracking, but I felt at ease and, most importantly, listened to. I understand that in this day and time there is abuse to the system. I'm all for fairness and people not abusing the system. But Judge Bivins is ALL ABOUT the numbers so she can look good. She is the most uncompassionate person. She should take time to dive into people's lives and situations because she wants to deny on anything even if you can wash your own hair. She has no idea about mental concerns when a person has worked their whole life and they had a severe traumatic event happen to them that has left them barely surviving. The VA would not submit the letter that would have granted me my disability, stating that it was a 'conflict of interest'. Only after I had a meeting with the VAMC administrator did they send the letter to this judge. There was no regulation or conflict of interest that prevented them from sending the letter. However, the judge made his decision 5 days prior to the release of this letter. Thanks VA! Now I lose my house, my car, and my child will be homeless while in her senior year of high school. She is an AP honors student and will be homeless. I worked for 35 years. Served my country. SSA's own doctor said I was disabled, the vocational expert said there were no jobs in the economy for me, yet the VA and this judge made a horrible decision. Time for the media and the VA OIG to get involved.

I was belittled by This judge. My hearing was done via video because I was in Kentucky. I can honestly say that Within the first few minutes of the hearing I felt I had no chance of winning. He was just going through the motions, but clearly had his mind made up even before I answered the the first few questions. This was not the worst part. During the disability and disclosure process you have to answer (honestly) all questions put to by your attorney. He asked if I did any drugs. I had back in my 20's but not since. This judge actually said this question has nothing to do with your case, but I see here you did drugs at one time. He said the name of the drug and literally snickered and asked me why I did it and what it was like. I was in shock and felt like he used his POWER to make me reveal information that was clearly something he did not need for me admit on record. It's bad enough to feel guilty about some decisions you made 30 years ago, but to have it brought out and put on record and feeling it was done clearly for his enjoyment was nothing short of horrendous for me. I walked out feeling humiliated and started crying immediately after as I walked out of the door. I received my judgement one week after the hearing. I am appealing his decision. It is my right to decline a video hearing, so I will never have to face John Prince again.

This judge is a joke, and I haven't even been in front of her yet. A "Peggy" in her office just called and told me that I had to come downtown, taking a day unpaid off work, bring my daughter (who has Down Syndrome) to show them that my daughter is disabled. As if the doctors letter showing her as having Down Syndrome wasn't enough! What does this judge think? She lost her extra chromosome since we filed the paperwork? Not only that but my wife has to take an unpaid day off work as well because someone needs to be there to take care of our daughter during the remainder of the session. All of this after 15 months of waiting for this judge to hear the appeal, and cancelling once, within 7 days of the initial appointment. It's no wonder people hate the government so much, if all government employees are as incompetent as this I now know why.

Judge Bivins is not a fair Judge, she picks one line out of the full medical report from 13 doctors that says you are disabled and denies your case saying that there has to be a job that you are able to do out there that will allow to to take breaks every thirty minutes to lay down for thirty minutes. I stood before Judge Smith. I was one of the average 57 to 58 percent denied every year. Two of my personal Doctors found me disabled. She gave them, "No weight" in her words. She did give the paid SSA paid Doctor who never examined me "full weight". That has been several years ago. I still can not work and have not worked for every one of those years. I made 50 thousand a year. Now I make nothing, with no disability. Judge Smith let me down. The comments of "honest and fair" of the previous post are the only reason I left this. If the Judge reads this, I wish she could know what I have suffered because of her judgement. I have not worked in ten years now and everything is on the shoulders of my wife. I hope it was just a poor judgement and not meeting denial numbers.

This judge is a joke! She threw out or had a negative response to everything in my file. I couldn't believe the untrue or negative responses in my denial letter. Someone isn't doing their job properly. Threw out both of my doctors responses, said I was a liar, my daughter and sister. I am very sick have been for a long time now and no one will help me. I am about to loose my house and anything I have. I have worked my entire life very hard and to be treated like this is a insult. This judge needs replaced. They need to take in to account their responses. I would be interested in knowing how many suicides occur from judges and doctors that seem like their only goal is to kick you when your down. Be a professional like you are supposed to be!!!! I am very angry how good people are treated from judges and doctors, people we are suppose to respect.

This guy doesn't have a clue. That he has been appointed to this type of position without having any background in Social Security law is a testament of all that's wrong with the federal judiciary. Unfortunately, the bottom line here is that he simply isn't very smart. His decisions repeatedly ignore the issues critical to just resolution of the claimants' respective claims and typically go off on irrational and bizarre tangents. He has no idea how to conduct a hearing in a timely manner and is incapable of focusing in on questions that bear some materiality to the issues at hand. God help you if you draw this moron as your judge because you will need all the hope He can provide you.

Her numbers say it, 25% you are going in just to make a record to appeal. She will interrupt you often. She pulls a lot of negatives out of the file so be prepared for drug/alochol and yes prison time even though it is outside the time frame of an AOD or PFD. She will also have the VE classify work as PRW although it doesnt fit SS definitions of PRW. If your client worked doing anything at all for any length of time it is PRW.

She is the new CJ in Indy. VERY NICE!!! But she specifically asked me to let the other attorneys know that she expects you and the claimant to be at hearing and ready to go 30 minutes prior to the hearing time. The notice says that, and she EXPECTS that! She asks most questions, then turns it over to attorney. AND she told me she does not want me to get testimony regarding what doctors have told them, or what she could read in the medical evidence.

I had Judge LaPolt as my disability judge and thought that she ignored my medical records and letters from employers about my disabilities.I am a diabetic and have denegenitive disc disease the lower 3 discs in my back are black on xrays and MRI's.She ignored these findings in all of my evidence presented to her.Her letter to me in my denial letter were very upsetting and I have lost my house and wife for her unprofessionable findings.I hope she gets into another type of law before she ruins more lives like mine.

Dear Judge Daniel Dadabo, I wanted to thank you for given me the chance to take back and regain control of my life. You and Nash Disability Law and North River mental Health, Illinois Masonic and Old Irving Park Medical have helped me under stand a part of my life that I didn't not believe. My life long struggles with mental illines and bullying and abuse have not been easy and I suspect that with continued therapy and help from the SSA I can become a productive and postive individual again. I didn't want to admit there was anything wrong, bipolar disorder and schizophrenia and autisim are not thing that you want to tell people there is such a stgma around that poeple either shun you or attack you and abuse you, which I have experienced my whole life til this day. Every day is a struggle just to be able to put close to clean myself properly, even being able to talk to some are accept a simple hug or hand shake any time some seems out of order I can become enraged or scared like a child. It makes it impossible to have any sort of relationships or to go to school or hold on to a job or go shopping! Comes from somewhere in Kentucky (I think)- has the cutest Southern accent and he's sweet as pie. Don't be fooled: he'll deny for reasons completely foreign to me. He almost always send claimant to pre-hearing consultative exams, or send for medical interrogs. Sometimes he uses them; sometimes he doesn't. I have not seen any particular M.O. with him. Just watch out....
