I have taken over 100 claims to hearing, and many to the Appeals Council. I was naturally apprehensive about Judge Eason based on his stats but I found him to be one of the best ALJs that I have appeared before in my entire career. He is sharp, efficient, read my brief and commented on its degree of detail. He permitted witnesses, followed the regulations to a T, and I am confident that he will decide the claim correctly. He is the best that SSA has to offer.

Mr. Gutierrez is a crook and a first class LIAR! He denied my case and the appeal, despite having over 20 active medical issues, many of which are severe and/or potentially fatal. He copied and pasted numerous sentences from various parts of my medical; and, when he made reference to my records in the denial letter, he distorted the fact of the matter. So really, the multiple times that he perjured himself in manner, he threw the standard Straw Man garbage into a poorly concocted report which made no sense at all. A grade schooler could have done better, as even GUTierrez's grammar was abysmally poor. I have been told this guy is extremely racist against White males, makes his decision before the hearing even starts. Though having access to your medical records, he does not read them. This rogue judge needs to be removed from his position.

Even though The U.S. Constitution is the supreme law of the land – meaning no state, federal law or [t]ax code can violate its terms… Supremacy Clause Article VI, Clause 2… - on August 21, 2015, The Honorable R. N. Burdette dismissed my case under 20 CFR 404.957(c)(2) [missing determination] w/o reviewing the totality of the circumstances [18 USC § 1341 - Frauds and swindles/18 U.S. Code Chapter 25 U.S. Code › Title 18 › Part I › Chapter 63 › § 1341; 18 U.S. Code § 1341… [Mail fraud (18 USC § 1341) and forgery (Chapter 41 - section 3575 of Title 42 § , violating the Due Process clause of the Constitution. 4101)] Judge Burdette ignored IRS & SSA Embezzlement of $ 5,807.07 deducted [Amounts illegally exacted on a Discharged Erroneous Assessment] from the beneficiary' by Criminal Conversion w/o Notice or Court Order - “warrant of distraint” - Amounts illegally exacted on a Discharged Erroneous Assessment. My ssdi claim was ON COURSE. Was even offered a possible OTR by a person at ODAR. Then after firing my 1st attorny at reconsideration as it occurred to me, it’s to Attorney’s ADVANTAGE by the protocol in place for 25% back pay. TO STRING IT ON. Now. ALJ EASEMAN I LIKED. I unfortunately 5-6 weeks before my SCHEDULED LONG AWAITED HEARING, began getting calls from a odar employee! Mind u, intentionally pushing and pushing and pushing me to hire a certain ATTOREY or risk LOSING. This is at the least, unethical. Oig special agent got involved and then it took 9 months of me using my seantor to GET SOME THINGS DONE. I’m not privy to the OIG findings. I’m looking into sueing tort and stress and pain and suffering for being intimidated into hiring A CERTAIN ATTORNY 4 weeks before my claim. I did not initially but gave in KNOWING AND FEELING I MAY LOSE, not on the merits of my CASE, but by not PLAYING ALONG WITH THE GAME. They gave 6k my yes MY MONEY AWAY. I’ll be appealing then looking into all my rights as a citizen against such craziness. I won on bench decision into the record. I appreciate THE ALJ EASMAN FOR SEEING THE TRUTH IN MY DISABLITY. But, beginning to look at the WHOLE PICTURE OF WHAT I STRONGLY BELIEVE IS GOING ON AND PREHAPS SYSTEMIC. If so? Well, I’ll find out. But only 1 way, and it’s a legal process. Before 6k was given away after this attorney LIED. Well, my theopist says; RIGHT THE WRONGS, if any...... We will see. Before the fee petition farce, I rated this ALJ AS 5 stars. Not because he APPROVED ME. Docs made that possible, but his attention to MY DETAILS, not attorneys is where he lost me.

She was thrown out of the office that I used to work in if that tells you anything and they’ve never done that to anyone ever!!! God bless anyone that comes in contact with her! I went to see this Judge who denied my case even though others have been approved having only one of the many (about 8)conditions that I have with no cure. Something is just not right, if justice was truly blind then the judge should not be able to see your color, know your gender or where you are from.

How long after the hearing do you find out?

Judge: William Sharp
12/26/2017 11:26:31 AM

Judge Sharpe seems to be unfair in most of his denials of disability, see above. Case in point: I am a 100% disabled veteran and suffer from two major problems (not listed for privacy) accompanied by several complications from the two. The judge failed to follow several SSR rulings, Hallex directives, as well as Fifth Circuit legal precedent such as the Stone Decision (Stone, 752 F.2d at 1101) as required. Being Judge Sharpe's approval rating is only 38% I would say it suggests a bias in many cases. Especially when he fails to follow the rules! Because of my disability determination from the VA the SSA is supposed to expedite its determination when a veteran rated at 100% total and permanent applies for disability. My case has been pending since May 2012; 5 1/2 years. It is now Dec. 26, 2017.

I am a disabled veteran 100% unemployable status rated by the US Army & Veterans Affairs... took me close to 3 years to get approved for SSDI in November 2014, the VA social worker I had, was looking over my papers & told me to question their decision for onset dates, the US Army & Veterans Affairs had me down for February 2009, I was MED BOARDED while on active duty, so my completion/release date from active duty was September 2010. My social worker noticed their on set dates given were set for February 2014, she had advised me to question my local office as to why. That same day I did go question my SSDI case worker, she also thought it was odd, right month, wrong year... she stated could be a simple mistake, & she assisted me with an 'appeal for on set dates' it was processed in January 2015. I was already approved & collecting benefits at this time. I ended up moving to Florida to Oregon, in early April 2015. I did addr as changes & all. I was told by case manger Lisa on Oregon it should be any day, as they only take I believe she said 90 days. Still. Never heard anything prior to move. Then in June 2015 I received a denial letter for my appeal, I panicked & called local office in Port Saint Lucie, Florida. The lady on phone at local office pulled up a copy of denial letter sent to me. She told me to calm down, it's only a denial for your "appeal for onset dates", that if I go to 2nd page it states any benefits previously established would continue/remain the same, she said it was just for my onset dates appeal, that it can take a few times when I have time come down & she will help me re-file the appeal again. She confirmed my payments were all set with no interruptions. In October 2015 my payment never hit bank, I again called questioning, figuring maybe a holiday or something? I was told I'd have to come in to find out why, so I did, that same day. They had 2 people come & explain why. They stated it's due to earned income, I asked what's that mean? They said you are working... I explained no way I'm 100% unemployable, I can't work... they said yes you are for a company called DFAS... I then explained what DFAS is, it's the main payroll office for any & all military pay... active duty, reserves, retiree, & VA disability benefits, for all branches of the military... the guy then admitted was an error, he told me we can't just flip a switch to reinstate, so I'd have to file for a "hearing request" so he helped me fill it out, with full explaination of what was going on, an error, I don't worked & what DFAS is, he said it would be expedited since I'm a disabled veteran, & I should hopefully be reinstated within a month or 2, he doesn't see why they'd waste time for a hearing for something so simple to fix, being an error & wrongful, he asked me why I hadn't come in sooner when I got letter explaining I was going to be being cut, I told him I didn't get a letter, he looked up in computer & said it was sent out, "oh wait" it's scheduled to go out Friday, the Friday after I was cut/missing payment, I then asked so now how do I come in prior to clear up, if your letter is post dated to go out Friday, 2 days after you guys cut my benefits on a Wednesday... for another "oh crap look from both guys... I never heard anything, till January 2016, received a letter stating I had a video hearing date in February 2016. So I attended this hearing alone, no attorney, under impression I was going to clear a simple error showing I am not working & what DFAS is. At this hearing Judge Wendy Hunn never ever once asked about DFAS or earned income, instead it's like they were avoiding the reason they had cut me off, & now trying to run it as a reconsideration case, they had teleconference in a mental health doctor who when Judge asked his opinion stated, his disability dates are February 2009 by the army & Va, you only sent me records from 2009 & back... so based off these I couldn't tell you, she asked him again I didn't ask that all I asked is based off what you reviewed what's your thoughts, he then again stated based off these medical records 2009 & back, they report his mental health at moderate at the time so I guess no... she then said thank you & hung up... she then questioned me on ADL's & issues I have... I explained all, she kept mentioning my "wife" I eventually cut her off & corrected her, "my husband you mean?" My husband is listed on my claim as a dependent... so how they got "wife" to start boggles me, obviously people don't actually review files prior to attending hearings... anyways, after I corrected her, got a dumbfounded look & nothing but sarcasm & attitude there after... I guess she's not much of a LGBTQ 🏳️‍🌈 advocate... whatever.... she then had her occupational/vocational specialist that works for social security run scinarios of what type of work I could do, based off my disabilities & limitations, her own specialist stated, there are no jobs your honor that will hire this man on full time with benefits & keep him on with his disabilities & limitations... she was about to then end the hearing... she noticed I had a stack of papers with me, she asked what it was, I explained it's the copies of my MED board from army & VA, and a copy of my medical records I was given when I was released on September 2010, along with a few pages here & there as hospitals & clinics have me over the years till now as well, she stated, well I don't have even 1/4th that, I said well I guess you don't have much then... I said I can make copies of what I have, I don't have "everything" from 2010-present just a few pages here & there... as I saidF what they give me copies of. She then replied with, if get your copies, come across just 1 duplicate (period) I am immediately going to push everything off my desk into trash no questions. I said I don't know what you do or don't have... she asked if all my care was done at VA hospitals... I told her well yes most of it, other then a few referrals where va sent me to specialty clinics... she told me to leave a list with the lady ok my end of screen who was in charge of setting up & connecting the video hearing for me & collecting signatures... this lady had me write all down & leave with security guard, stated she had more cases to conduct, Couldn't sit and wait... so I did, I left with security guard along with a detailed timeframe break down of my entire process from 2009 till present... I never heard back till June/July 2016, I received a denial letter, stating because I am single father now, I can go work, & I can work in catering/banquet server/or fastfood... mind you I walk with a cane & walker, and am in a wheelchair for a few weeks here & there thru year because my pains are that bad I can't stand or walk... so not only did their own paid & appointment doctors back in 2014 prior to my original approval state I was disabled, this judge went against what her own vocational specialist told her of work I can perform, decided my case 100% knowing she had not a full set of medical records, forced a mental health doctor to make a decision off partial records dated prior to my onset dates, have himts of discrimination of sexual orientation & marital status... being a single parent does not make any of my disabiliea dealing with easier; only harder, I struggle every single day, due to my disabilities & lack of what I can do... my daughter is behind, she is in therapy for speech, occupational, & developmental skills... because of me... because I can't carry her all day, I have issues picking her up, I can't get down in floor & play wth her, I can't go to parks with her, believe me I tried & ended up in ER next day severely bruised coxxyx, I can't afford day cares, my own anxieties I don't have any friends here... I don't speak to anyone, there for my daughter now has social anxieties as well... she claws her own face, pulls her own hair out, & scratches/pinches her own arms & legs till they bleed if people try to talk to her or get too close Now... so this judge who did not fully review anything, half ***** my case, went against everything & everyone... & I'm almost for sure she discriminated against me once I corrected her of my marital status of being married to another guy/husband... & because I am now a single parent because my husband took off & abandoned my daughter & I when she was 4 months old because he couldn't deal with my disabilities & limitations... that I was in pain all day, everyday, & limited what & when we could do things, he decided to take off with another guys he met & knew for 2 weeks over our 7 years, marriage, & having a child... I'm Biological father through surrogacy, so it's my blood child... regardless of my pains I do what I have to to make sure she is taken care best that I can... I am in tears caring for her at times, trying hardest to hide it, so she doesn't see... it's not easy being disabled, & having a daughter who is now almost 3 years old who is behind, & being treated because of disabilities brought in due to my own disabilities & life issues from injuries while serving this country in the US Army, in deployment to Iraq... shame on this judge... now I'm having to appeal in federal courts which is hell, Florida has limited attorneys for federal cases & I have yet to find one... supposedly only around 28 through entire state... they it only screwed memes stated above, but they also made sure to tile it perfectly to where my LID (Last Insured Date) expired a few weeks after hearing date, but almost 4 months prior to a decision letter... so I couldn't even restart process with a new claim & attorney now, was told to have them manually adjust LID date, something about because I was approved and collecting date should have been frozen anyways, they need to manually adjust it so I can hire an attorney & restart a new claim... went into my local office was told to leave... they can't speak To me because since I'm in process of a federal appeal in court, it's basically a lawsuit against social security, aontjey wouldng speak to me or Assist me in anything now. Great system we have, rule all set up to favor them... & screw citizen over... I bet they never have issues getting approved in life when needed...

This is Sandra Thompson 335-62-0969. you saw my case back around January 2017. I had been approved an all. But social security is giving me a real terrible time and will not take the time to explain which spend down they need. I have given them nearly everything and I feel they are playing games. I emailed my attorney also because I feel like they are playing games and not wanting to pay me anything. What is they want. We had estate funds and now that money is gone but what reciepts. The reciepts of each amount that was sent or what? No one is talking and I am about to loose my rental home. I should have already had this done and over. I will be in the streets again and this time right after I have surgery done. This Mrs. Villarreal is mean and all the others on that Aldine Mail Route office are. They keep saying no we need reciepts but will not ever take the time to tell me which sets of reciepts. Is there form of some kind the executor of the estate needs to fill out and have me turn in or what. I do not know. I total frustrated and very upset right now. I am being treated very unfair and it needs to stop. To let you know that Aldine Mail Route is mostly all blacks and I am white and I sense some discrimination going on here. I hope not but I have attempted suicide several times to no success because I cannot just do it. But these people are giving me the total run around and state they over power everything and anything the judge grants. That office is corrupt probably like almost all of them. Some please explain to me what I need. Thanks.

Extremely discriminatory against invisible diseases. Actually had the nerve to say he "didn't believe" my specialist/surgeon OR psychiatrist, even though there was medical documentation, X-rays, scans, etc, to back up my diagnoses. Very rude, sarcastic, condescending. Stared at computer screen entire time & would not even look me in eyes. Also obviously didn't look at all of my medical documentation, because a lot of his reasons for denial, were simply untrue; and he would have known that had he actually looked at all of my records. Left me feeling like just a lazy loser or something. Shame on him for his treatment of those coming in & completely at his mercy, for dishing out denial after denial without thorough review and/or education on the disabilities in question and for his complete lack of empathy for those of us hurting and already embarrassed to have to be at a court's mercy in the first place!

I was just denied by Judge Williams. He took account from my Tri-County rep, Which never talked to my family. It was my family that told me to seek help, because I was so angry at the world. Then because I have slight COPD and he noticed a pack of cigarettes in my pocket but never said anything about my electronic cigarette that was next to my real cigarettes. and he states that because I can drive I am not disabled, but It is hard for me to drive very far. I only put 50,000 miles on my truck in 4 years. I wish someone would listen to my 90 year old grandma or my aunt who wanted me to get help. Then maybe Tri - County would think twice about saying I am Malingering.

My husband just went to court with Judge Gutierrez. I am very unhappy with the outcome. Mr. Gutierrez (Judge) denied my husband on a questionnaire that we filled out 4 years ago. We were honest on the questionnaire as of today my husband cannot do what he did back then. Letters from all his Doctors say that. If we didn't deserve back pay that is fine but my husband should have never been denied completely. We are so close to loosing our home we can't even put a full meal on the table for dinner. I work 2 jobs just to try to make it. My husband can't work. I am so upset with this outcome, I can't believe this happened.

I just received my denial letter, I saw Judge Patricia Henry, every paragraph was lies, she twisted and contorted my records and testimony to fit her denial. She basically committed perjury! She contradicts herself in different paragraphs in regards to my disabilities and abilities, she needs to get off the bench STAT! I will be filing all sorts of complaints and even taking this to our legislature. We presented her with evidence, she twisted factual evidence to being non-existent! If you get this judge, kiss your case good-bye!

When I was sworn in to tell the truth, the whole truth and nothing but the truth, they should of did the same thing with this judge. No wonder the social security system is total failure. It's based on one big scam and that's truly shameful. So many people have worked hard all their lives literally breaking their bodies and paying into a system that promises at your time of need the assistance will be there. But, when the time comes, they make you wait so long that you lose your home, your car,etc..... You have a nervous break down from the anxiety of waiting and mounting medical bills. These government monkey judges don't care. They all have at least a six figure income and probably the best health insurance money can buy. And bonuses from the government for every claim they deny. So why should they have compassion for their fellow man when their living so well. People wonder why it takes at least two years for the social security disability claim process. It's not because of the case load, there are hundreds, if not thousands of judges out there. The delay comes from the fact that judge will look at a case and study it ever so slowly to come up with as many illegal loop holes and lies as he or she possibly can just to stall the case. It's these lies and deceit that have caused the social security system to crash and burn.

This judge kept a smile on his face the whole time I was giving testimony and 39 days later(total wait time two years) denied my claim. Multiple disc herniations with stenosis, multiple discs already fused and cauda equina. How many more spinal surgeries do I need and how much more nerve damage do I have to endure before I'm finally approved for disabilty. This is one piece of crap.

This judge is fair and is unintimidating. He allows the claimant to fully outline his argument. I don't put much stock in these percentages; being prepared is the key. It makes the job of everyone concerned much easier.

I had my hearing this week. I was late because of heavy rain. This judge waited for me. I was nervous at first but not at the end. He knew the record and was polite. Had two experts by telephone. This guy let me stand for part of the hearing because of back pain. My attorney said he is one of the better judges and knows the law. Don't know how he will rule.

How can his awards be shown for 2013 and today is only 1/7/13 my hearing date unless the decisions are already made before we get in court, Judge whitney is a hard judge to figure out and beware of the VE they must be trained to say that everyone can be a surveillanc monitor tech, this is the job they say you can do when they can't find anything else for you to do,in reality This job does not exist!

Make sure you are very prepared and fully review every aspect of the record before going before this ALJ. Also make sure you have a brief/memo prepared for him to review prior to the hearing.

Very unprofessional and biased. Sarcastic, rude, and used ridiculous reasoning to deny me. He actually holds it against you and says it's proof you're not disabled if you manage to get yourself to a specialist. He could care less about the rules or ethics. Pray you don't get this guy.
