Every claimant deserves to be treated with respect and given a fair hearing. Judge Munday's behavior assures they have neither.

This judge should be impeached. She made a disparaging comment about my disability before the hearing started. She made up facts, told me she would not answer any questions, told me she didn't have time to listen to my case. I asked her how long I had and she refused to answer. Additionally, there were 20 missing exhibits. I told her and she ignored it. I copied my appeal to my congressman, the IG for investigation, the general council as well as the Commissioner of the Agency. The hearing was a mockery of due process and the judge's behavior unconscionable.

This ALJ, Nancy Berryhill (acting as head of SSA) and R Trent McCotter, US Asst Atty crossed the judicial immunity threshold. These public servants decided, on their own, that the State of Virginia would not recognize an out of State Common Law marriage. To add insult to the injury that barred a Constitutional right, they say it is repugnant to society and compared it to bigotry. The Eastern District Court disagreed with the nonsense, Virginia WILL recognize an out of State common law marriage. This needs to be addressed within the Social Security Administration, they knew or should have known. The physical and psychological impact of discrimination is well documented.

I had Judge Annos twice and he found me unfavorable both times, the last time 2/14/18 and I just rcvd my decision last wk....Judge Annos does not have a heart and he is not fair. If you have him as a judge, you are doomed!!!! I have bipolar I, PTSD, agoraphobia , and take 5 meds for my mental disorder. I have been fighting for my disability for over 4 yrs and I will never get it with these judges as I am called a liar and they feel my testimony does not match my dr notes bc they say I am considerate and polite. I dont go to the drs office punching walls or barking like a dog. Also they say I can no longer be a Case Mgr or CSR but I can be a Housekeeper or clean eyeglasses. Annos is heartless, period!!!!!!!!

The man is a liar and/or he has attention problem. He lied about not presenting evidence when the evidence was there. Lied about not needing assistance to stand up. Doesn't notice that sitting slightly sideways relieves pressure off my coccyx. Doesn't notice using arm rest to get up. Doesn't notice a woble in gait. He disregards medical evidence in the record. Thinks he's more ecperienced than the medical doctor. He came short of calling one of my GP incompetent when he's the incompetent one for not noticing physicians can share the same last name and work in the same office but licensed for different specialities. He adds information to his review not reviewed with the applicant and without giving the applicant the opportunity to deny or explain his allegations against the applicant. He thinks someone needs to have the same level of pain on a daily basis- which some ppl alledge and may very well be true. To be honest, Chambers needs to be disbarred. The list of LIES he made up and the number of evidence he willfully disregarded can only lead to the following conclusion, Judge Chambers is impartial and a ******.

My mom had her hearing on June 28th. She has all new records and she requested a supplemental hearing in which we got a date for November. We faxed in the documentation that states we will appear. My mom's PCP and her neurologist wrote very detailed statements. My moms condition has declined and she meets the social security blue book official guidelines and the criteria for those guidelines. I am very confused we got a letter today that was sent to Joe Pitts pa state Rep n all it says is unfavorable decision and my mom has not even had her supplemental hearing yet. I'm calling the adjudicators office on Monday my mom has cognitive impairment she cannot remember things it's written in stone plus records going back to 2013 for very severe mental health and ongoing treatment plus cops and degenerative disc disease scoliosis spondylosis I have no idea what is going on it makes absolutely no sense

This ALJ is purely psychotic. She is rude, aggressive, disrespectful, insensitive, and plainly behaves like someone with a profound mental disorder. From her early approval rates, it appears she was sent off for retraining by the SSA and post retraining her approval rate fell sharply. Given her start in WV and subsequent move to VA, it is also possible she was transferred from WV, due to her psychotic behavior, and placed in Charlottesville. Often, the SSA will not dismiss problematic ALJs but transfer them to a different ODAR. All SSA claimants who are treated rude and disrespectfully by ALJ Munday should be encouraged to file a complaint with Appeal's Counsel, the Office of General Council, and their local representative.

Update: faith has nothing to do with your decision when it comes to this judge; It's bad when your representative tells you before you go to your hearing that your chances with this judge isn't good, Sad after you have waited 4 years to get a hearing disability said you were disabled as of 2014 but you were trying to get your work credets amended to 2013 because you were disabled then and needed the one work credet to get your monthly check... sad world we live in you work your life and when you are unable to work at 53...ptsd depression 2 knee replacements L5disc bulge fibromyalgia and other health issues... was found disabled by social security but he wouldn't amend one work credet...that was just to much for someone who worked and earned it to ask for....judge kilbane God provided he always has... and I don't have faith in the system but I do have faith in God.... I will appeal....

I feel that judge Chambers took the time to listen to My Testimony he was very respectful. I'm praying that my medical evidence along with my attorney and my testimony will render a favorable decision. I was told to look for a decision between four to six weeks possibly three months in the mail.

I don't pre judge anyone. That's a gift my parents taught me as a child. I get nervous reading the reviews but I always have faith. I can only hope that he sees what I feel and my daily struggles through his eyes and if he does that's than that's all I can a honest hearing is on the 31st of this month. Bipolar Anxiety Ptsd 2 knee replacements on my( L ) leg herniated disk in my back due to a bad knee replacement that only last 2 years and had to be taken back out. Broke my leg when they removed it now have plate and screws... constant pain leg hip and back.... walk with a can... I have faith..... Betty Fuller

This judge is a thorough and dispassionate lady. She expects representatives to know the file and to have all evidence in the record in advance of a hearing unless you have a very good reason why there is a delay. If you believe a consultative exam should be scheduled, move for same a few months before a hearing. This judge is conservative.

This judge is a very dispassionate yet thorough lady. She is conservative. She expects representatives to have all medical and other evidence in the record before a hearing unless you have very good cause why the evidence is not already in the record. If you think a consultative exam is in order, make a motion a couple months before a hearing for same. Don't wait.

i went in front of judge pace in 2011 and he proceeded to berate me in the hearing ... i wish i could get a copy of the audio recording from that hearing, he denied me even though i had a letter from my doctors stating i am not capable of any gainful employment. i was hit with a mack truck in 2005 and have severe spinal cord injuries and if you go to this ssa site you can see what you have that qualifies you i have several listings from the musculoskeletal system and Neurological sections including multiple herniated disks and syringomyelia.

If you read the appeal cases on his denials you see that sometimes at say step 3 he is found to have properly applied SSA rules in a case and the plaintiff is wrong, so from this you gather he knows how to apply SSA rules. But in other cases say at step 3 it is found that he has not properly applied SSA rules according to the appeals council. Why does he properly apply SSA rules in some cases but not in others? He obviously knows how to because the appeals process says he has done it properly. Why does he properly apply SSA rules in some cases but not others? Is he allowed to pick and choose?

Outliers are investigated by SSA at 25%. He is just above outlier status at 28% approvals. He also has enough cases overturned on appeal to make his credibility questionable in my opinion.

Judge Timothy C. Pace: I had my hearing in November of 2013, and like so many people its a very long journey just to get to this court date. My disability and filing started in 2009 and there was some mistakes made within the SSD that put me way behind for me getting my trail date. After, a second filing in early 2012 and now with an attorney I got my date set in the middle of November. I advise anyone who is thinking about getting a attorney, Make sure they are local and NOT a national firm with lawyers scattered all over the country. I spoke to my attorney over the phone 3 times, twice within days of my hiring and never met him until I walked into the court room. My biggest mistake in my life. I did 99% percent of the talking and the lawyer made mistake right from the start, so I took control quickly and finished up the hiring. I even request that his fees be lowered if I won, right there at the time of the meeting. This action was granted by Judge Pace. Why did I gave Judge Pace a FIVE STAR review? Its simple and its based on two things and nothing more. 1) I had to deliver over 500 pages of medical records to the court before my court date because of my attorneys law firms poor handling of my case. So, I had a few calls and face to face meeting with the office staff. The staff was super helpful and truly cared about me as a person and my case. So, the staff shares in this review and the 5 stars. 2) Judge Timothy C. Pace got his five star rating for simply listening to my store. He just listened and you could tell he cared about my journey to disability status. Again, he listened and in the end that's all you can ask of any person: Judge, Doctor, Husband/Wife or partner. I walked out of the hearing knowing that I had my day and what ever happens next happens good or bad. But, I know in my heart and mind that I was heard!

Bad Judge- seems nice on the surface but has now denied two legitimate claims of mine for no good reason, that no other rational judge would have denied. Be prepared even on strong claim for a denial- strongly recommend not doing a video hearing if you can avoid it because both denials were video hearings.

he is without question the most insulting least engaged judge there is anywhere. i have had dozens of cases with him and he almost always ASKS NO QUESTIONS AND BARELY LOOKS UP at the claimant. this is on top of his ultra conservative views (remember this is a government employee doing this who has everything paid for by uncle sam). I have had about 30 hearing with this poor excuse for not only a (chief?)judge but a human being. i have had at least 2 heatings where he completely-i mean totally.. distorted the evidence and ignored long repeated periods of mental confinement to put forth a hypothetical that denied a seriously mentally ill client of mine. another case 55 yr old 35 yr worker at one plant with fusions on neck back and multiple repetitive surgeries for running jackhammer for years. on top of this, he has a breakdown when he lost his teenage son. the file complete with attempts to place him and do the best he could. not one question from this jerk. not one. summary denial..astonishing..... i dont know ** he got to be chief judge but his propensity not not only to deny every possible case but to distort the evidence to try to erase facts from the record makes this guy the jerk of all jerks. one day when he lays down he will have to face how he treated everyone in his life..and just on my cases alone, this guy will need all the luck he can get. this is but an example of many cases i have had with him. if you want to know whats wrong with this country, look at his face. there is absolutely no excuse for this guy. i have been doing this practice for over 20 yrs...if you want to be tight, ok..but dont distort the record...i can honestly say this about only one judge in my 25+ yr career but its true: I have no respect for this guy as a human being, nor do i wish to live on the same street as this jerk.

How interesting that Judge S should opine about non-attorneys representing disability clients. What about Judge S pretending to be a judge, when in fact, he is not? Yet, he demands that title be used. What about Judge S pretending to be a medical expert, when he is not even close? He says the people who deny claims at the initial and reconsideration levels are highly trained professionals, and should not be overturned. Then why have judges in the first place? This fat little fattie should stick to what he knows - chinese buffets and Krispy Kreme.

Drew Swank ruined my life. He is no judge at all, at least not a fair one. I pity him the day he has to stand before God and be judged himself. This man thinks I should work while having severe, near daily migraines and while taking nearly daily pain medication that I can't even legally drive while taking. The fact is, I can't work and no one will hire me or keep me in their employ in my condition, yet he has made me inelligeable for Social Security. He's a real piece of work and I hope the hammer falls on him one day. I do know that what goes around, comes around and paybacks are nasty when God gets vengence.

Before you file a complaint or appeal search 'Richmond-BristowBeat' It has an article March 19 2012 'Disability claimants see injustice in judges denials'. Read it & you will see Swank defend his actions by saying "the policy originates with the chief judges office in Faifax VA" and "there is a 'much bigger' story than you realize but he "can't elaborate" First of all what "policy" is he referring to?? Then realize that when you file a complaint agaist him it goes to guess who? the same Chief judges office in Fairfax that started whatever "policy" he is talking about. There is no way to get a fair shake at this scandal. I personally think the 'bigger story policy' is that the SSA has hired so many lazy illiterate (call SSA & see how you are treated on the phone)people that the backlog is so bad that they HAVE to turn down a lot of people because if they paid all the backpay the SSA really would be broke.

I had this Judge as well and I feel all of your pain. My Lawyer knew we had won our case. He discredited all the Doctors I saw saying I was telling them what to say. Also he approved me for everything even gave me an offset date but denied me saying out of all of my jobs I could go back and work in Childcare. How? I walk with a cane and a Rollator chair. My left leg I drag and fall down a lot due to a back surgery that left me worser off. Yes he is a joke an dhe didnt have a Vocational Specialist at all in the room cliaming he has read my file over 7 times so he knows it by heart. Well no he didn't he lied and used statements from a closed case back in 2007 and put statements in from a closed case I had two years before I was appealing the 2009 case. My Lawyer was so upset after he read over my Denial Letter we both couldn't believe it. He lied on almost everything and put in there Doctor's I had never seen before. I have lost everything me and my 3 kids. I pray for this man everyday because I have went to two more doctors for an opinion and they all say the same. I have severe nerve damage and no surgery would help me and I will be in pain for the rest of my LIFE. Thanks Judge for saying I can go back to work with take over 200mg of pain pills.........................

Swank is not a judge at all because a judges uses evidence to make a decision. This jerk does whatever he wants & dis-credits doctors because he can get away with it. I think he used to be a military lawyer so then & now he doesn't mind taking a check from the government but thinks nobody else deserves what they have worked years for. He did this to me and now I can't even find a lawyer who wants to 'waste their time' because they don't want to deal with Swank. We all need to find somebody smart enough to start a lawsuit or whatever possible to re-hear our cases. I lost over $40,000 in backpay because of this clown and my house,etc. I also heard that he has been moved to the Charlottesville region from Richmond--Anybody know for sure??

Nice article recently written by ALJ Swank which documents his bias towards non-attorneys. I'm sure SSA will turn a blind eye. He pretends in this article to be concerned about the Claimant's. i went before Judge Swank yesterday, and was warned before hand by my attorney that he was a pompase ***, sarcastic and has a god complex. I have been fighting for my disability now for almost 4 years, and my lawyer said my case was a slam dunk, until we found out what judge was assined to my case. They are already working on the appeal even before we left the hearing. Sad how many people wait so long for a hearing only to draw this judge. I am praying that my disability is approved, but knowing his stats, I wont get my hopes up. Problem is my attorney tells me it could take up to a year and a half to get the appeal, then I have to go in front of him AGAIN! if he denies it again, then another year or so wait then I can get another judge, but in the meantime my family is really suffering financially, and I am helpless to do anything about it.

Swank wrote an article in volume 36 of the Southern Illinois University Law Journal titled "Non-Attorney Social Security Disability Representatives And The Unauthorized Practice of Law." This article is completely biased and disrespectful to non-attorney representatives. Swank is truly generalizing. I am surprised that any legitimate journal would allow such rubbish to be posted. He makes comments about non-attorney representatives that can just as easily be applied to attorney representatives. Swank's approval rating is offensive to the system, which shows he likely needs to get a psychiatric evaluation himself. I feel for the unlucky people that must go before him.

Judge Swank is a JOKE. He should not be on the bench. In my case based on his opening remarks, he was clearly was prejudice. I was instructed how to respond to his questions, i.e. yes or no. Then he denied access to a vocational specialist, which would have help my case. SOME ONE NEEDS TOP THROW HIM OFF THE BENCH. I wish he would have to apply for SSA Disability benefits. This ALJ is far from fair as his approval rating and denial rating suggests. He will cherry pick his decisions to support his ill advised residual functional capacity assessment and purposely takes testimony out of context. He spends most of his time questioning the vocational expert in regard to an individual's past relevant work to set up his denial. He routinely dismisses the opinion of the treating physicians even when they are supported by the record and accepts the opinions of the state agency even when they are clearly outdated and not supported by the record. Social Security has taken steps in reference to ALJ's who they believe pay to much but I wish they take the time to investigate ALJ's like the above who have no intention of paying cases that are supported by the record. Unfortunately, there have been and will likely continue to be people who will not receive benefits because of this ALJ's bias.
