Just found out today from my brother's atty, that after 6 months of waiting for a decision, it is unfavorable because he didn't find my brother credible in his testimony of hardly ever leaving the house, because of the onetime shoplifting incident that was later dismissed by the district Court Judge for lacking proof, but the point is that one time and only one time he can say I left my house, well I guess he is so Gung ho that he fails to realize that people with agoraphobia do have medical appointments and they feel somewhat safe with a close family member taking them places that they have to go, and you can't assume anything else, but what is in the evidence, my brother has objectable medical evidence that he has Post tramatic stress syndrome, Anti-social personality disorder, Agoraphobia /Panic attacks, plus physical impairments of chronic high blood pressure avg 150/100 each doctor visit, 1 per month, one office visit his reading was 205/110 with pulse rate of 46 and he also has an MRI that shows severe cervical spine osteoarthritis, lumbar spine ddd, (degenerative disc disease) hepatitis C, 25 yrs, hypothyroid disease, and is prescribed oxycodome, soma, Xanax, Adderall, Phenergan, BP meds, thyroid meds, and a fluid pill called HCTZ. Now you add all the impairments and all the side effects of the medications and can you see my brother being capable of doing any kind of work that exists in the national economy? The VE didn't think so either, but judge Chaykin obviously thinks so, and he has a history of judicial erring in his short career as a ssa alj, and I am gonna appeal to the appeals committee which is in his same building in Falls Church Odar, and will probably decline to review the case and then on to federal district court and Supreme if necessary and I hope they reverse the decision and remand to Mr Chaykin for calculations of payment and if it was up to me I would make Sir Benjamin pay the back pay amount, and then fire his bias a** he is known to cherry pick through the medical records and give weight to the state Dr's, well pal this claim was filed prior to March 17th, 2017. And the treating physician rule apply unless there is substantial evidence of malingering then the credit as true rule comes in, Chaykin needs to be busted down to errand boy for the decision writers at Falls Church Odar, and I hope that he will be.

Had my hearing yesterday. Judge Fuller sets a comfortable tone in her court. I was nervous all morning until the start of the hearing. Judge Fuller was very pleasant & made me feel much more at ease. She listened to everything I had to say. Very professional and courteous. Hearing was over quickly & she was kind enough to tell me immediately that she intends to approve my case instead of making me wait for an official decision letter to come in the mail in 4-6 weeks. After my brothers ssi hearing in Jan , 2018. I got the feeling that this judge was desperately trying to find a reason for a denial , my brother has severe mental health problems but judge Chaykin was more concerned with a shoplifting charge that was dismissed for no evidence because my brother had a panic attack in the store and the manager assumed that he looked afraid because he must have stolen something , his lawyer had it dismissed because the accuser refused to come to court , so after the hearing I decided to research this ALJ and wow ! Did I find dirt ! This judge has erred in 4 ssi/ssdi hearings giving the states non examining doctors all the weight and ignoring treating physicians findings of serious health problems , this seems to be a pattern with this guy , and he has had his decisions remanded atleast 4Times on these same errors , he doesn't even know the medical definition of "stable" which means not getting worse but not getting better , wow ! An ALJ judge cherry picking through the medical evidence just so he can justify his erroneous decision and the commissioner backing him up on each decision that was remanded by the 6th circuit of appeals , I think they should have a rule that if any judge makes the same error 3 times in 7 years they should be reduced in salary and the 4 th time the same error is commited to terminate the judge based on cherry picking, and the same for the commissioner for backing his "golf buddy" instead of doing his duty.

I thank God for Judge Gibbs! In 2006 a close neighbor friend told me that she thought with everything I had going on I'd be eligible for Soc. Sec. Disab. I filed, turned down, filed again, turned down again, filed with a Lawyer, turned down, then he retired, turned me over to another Atty. who had been a former Soc. Sec. Judge himself and we came before Judge Gibbs, I went through the medical/psych exams and after all of my newer updated medical info. came back, she was livid. She instantly made Soc. Sec. pay me ALL of my backpay for having been denied and put me instantly on full Soc. Sec. / Medicare disab. in 11/1/09 and I've been on it ever since. She is my angel! I have since divorced after 33 years from a very abusive marriage, he did everything except physical abuse and mentally abused me, our two children and my Mother who lived with us, conned her out of all of her retirement then lied to the Mediator for our divorce that "I paid her all that back!" Uh, she says no he didn't. And now I fully qualify at 62 to draw my entitled 1/2 of his SS but they informed me "He will have to be drawing it in order for you to get it so you'll have to wait until he draws it at 65!" That is wrong and I know it is wrong. Plus I should not lose my Disability which is on MY OWN RECORD of my 40 quarters. Don't give up, We The People do have the power to make changes to corruption in our government. Many don't know that as a US citizen you have the right to have “ANY” US employee investigated for miss use of power by your Congressman. I am opening a Congressional CASE investigation into how I have been mistreated and discriminated against by the SSDI and Judge Michael Carr, I am also naming Carolyn W. Colvin Social Security Administration “ACTING” Commissioner of SSI for the entire country. All you have to do is look up who your Congressman is and ask for the form to file a Congressional investigation into your case. They are required by law to investigate your case and determine if your were treated unfairly. If we can get enough people to file and name the unfair Judges, we can get them removed from office, as well as the “ACTING” director who is not doing her job by getting rid of the bad apples on her own. In my case, I have a M.D, that has me listed as permanently disabled and my medical records state several conditions that qualify me for my benefits, as well and a PhD that filled out all the required SSDI forms needed to qualify me for my benefits and I am over the 55 year old age requirement for the lowest level of requirements for my benefits, yet Michael Carr took half a year after my hearing to let me know he knows more then the MD's and PhD's about my conditions. He also knew that my only hope for fair treatment would be to appeal to SSDI for a review. Well guess what, ALL appeals are sent back to Michael Carr's office in Falls Church, VA to just be turned down by Judge Carr and his friends in his own office! When this is brought to light by enough of us requesting Congressional investigations into this clearly corruptible practice, We The People can get these unfair Judges and the Carolyn W. Colvin the“ACTING” commissioner of SSI, removed form ever abusing their power at any government job again! I appealed to Her office when I learned of the corrupt policy of sending my case back to Michael Carr's own office just to be turned down and what I got instead of help from her office, was a immediate refusal to even review my case from Michael Carr's own office. ARE YOU WITH ME, it's WE THE PEOPLE TIME!! Please contact your Congressman TODAY! I worked for 40 years and paid my government over a million dollars in taxes. I could no longer work due to my disability's and ask for my benefits that I paid for over those 40 years so I could take care of my 80 year old mother, the widow of a Veteran and policeman. We were hungry and needed food, we were thirsty and needed to drink, so we came to Michael Carr and pleaded for help and he said depart from me. Now he and his family will face the same treatment he gave to us, as it is written in God's word: Mathew 25 / 31-46 “Then He will say to those on His left, Depart from me, you cursed, into the eternal fire prepared for the devil and his angels. For I was hungry and you gave me no food, I was thirsty and you gave me no drink, I was a stranger and you did not welcome me, Then they (Michael Carr and his) also will answer, saying, ‘Lord, when did we see you hungry or thirsty or a stranger or naked or sick or in prison, and did not minister to you?’ Then He will answer them, saying, ‘Truly, I say to you, as you did not do it to one of the least of these, you did not do it to me. 4am another sleepless night keeping my wife awake before her shift so I decided to get this out. I'm not sure how this man sleeps at night or lives with himself. I'm in Florida and got this judge from va. He begins by stating I'm extra on his already beyond case load. I'm 40 and he makes a point to state that as well. My case was decided exactly as the ones written here. He even said that the facts of the case Dr reports etc.show my disability without doubt but my testimony went against that. His questioning made my testimony seem that way. He asked if I take my children to Dr appointments or ever have been to one of their school necessities and made it out like I did on a daily basis. I haven't even to this day worked since 2009 date of injury and my wife is supporting me and 3 children and already left once out of dispair due to money problems and she still thinks about and talks about it. I have metal plates and screws in both legs. Fusions in my neck sustained working at a mattress warehouse with no help carrying California king mattress by myself. I have worked my whole life until now started bussing tables at age 15. I have a failed lumbar surgery probably because physical therapy popped my stitches doing things I'm sure I shouldn't have. I barely sleep at night if at all and have no way to support my children I am sick all of the time physically and I did appeal good luck with that. I hope this man enjoys his nice home and warm meals while my family suffers because I couldn't get the services I worked my whole life and when I could no longer do so could not get. You would think with attorneys present they would see these things and maybe do something about it but these judges are those bread and butter so another good luck. Its a shame when our system is ran this way and abused. Gregory Hamel you are a perfect example of what's wrong in the system.

This judge failed to take actual doctors notes and letters of support into consideration. He was very uninterested in our case and made us wait 6 months for a denial. I wish we would have had someone with the knowledge about mental disabilities and a fir judge that actually read our case. It took the judge 5 months to issue his unfavorable decision. His 28% pay rate tells you everything you need to know. In our case the record was uncontradicted and I had 2 solid "less than sedentary" RFCs from the treating physician to support our allegations of disability. The ALJ totally disregarded the treating physician RFCs, and relied on the outdated opinions of the non-examining State Agency reviewing physicians to support his denial. With no other contradictory opinions from any other examining source, the denial was a clear case of the ALJ substituting his opinions for those of the treating physician, and I will definitely be appealing the decision to the Appeals Council. If you have the unfortunate luck to appear in front of this judge, develop your record for the appeal. No stars because he had no evidence to support his denial, just his slanted opinion.

I don't understand the decision. I have very limited use of my dominant hand. I've been through two previous surgeries, I need another surgery and my hand will still be of limited or no use. I've been and still am dealing with extreme depression, and insomnia. I have torn ligaments in my spine. All being supported by medical evidence. I never stated I was mentally challenged or crazy, but that I suffer from chronic depression and anxiety, which is controlled by medication. Sitting for long hours and/or standing for long hours sends my back into spasms and excruciating sharp pains. I cannot even lift a gallon of milk without experiencing severe pains in my hand and wrist, let alone maintain a beneficial job. I hope an appeal will be successful. I am very hurt, saddened, heart broken and torn.

Her numbers speak for this judge as she has the highest denial rate on this office. She likes to play doctor and recommend treatment plans speaking as though her background isn't in law but rather medicine. She gives little to no weight to all VA doctors, treating and evaluating, and doctors outside the VA healthcare system despite case law see McCarty verses Massanari. She also likes to cherry pick through the hypos the vocational expert uses instead of the factual comments the VE states when there is no work available due to your real life disability, not some hypothetical scenario. This judge works extra hard to deny disabled veterans with one hundred percent VA ratings. She clearly doesn't like veterans or respects the VA health care system.

I had a hearing with him in October 2014 and as of today-- I am still waiting on a decision. Every time I call his office some rude guy named Reggie answers. All he tells me is that the Judge is still deciding my case and that he works at "his own pace." Really?! In the meantime, I'm sick and on the verge of losing everything. ALJ Gibbs seems to come to her final "disabled" or "not disabled" decision first, and then work backwards to build an RFC which can justify the decision. Had several cases with her in a row, the first claimant was young and had very few physical complaints at all but she assigned a light RFC. The second case was with a 55+ year old man with significant spinal and weight bearing joint impairments and an RFC for medium... god forbid that she grid him out.

I think he was a hones, but its been a while and I still haven't heard anything. I am happy he taking time out to think about it because I am really one of the ones who need the help. I see people who dnt need to get it fast when mothers like me with a ,4 &7 year old. I tried my hardest to live without my medicine so I can try to work and I can't. Now its so hard to get this disability but everything is a process. They judge based on facts not personal thoughts because theses judges dnt know us. Stop bashing them and pick up a book. Hello. My wife had a hearing before an ALJ last week. She was told it would be 30-90 days or longer before a decision is made. This is a huge problem because she suffers from severe depression which is well documented by her treating doctor for over 2 years, a evaluation done by a psychologist working for the Dept. of Education here and a IME which she paid for. All of them say she has a variety of problems and cannot handle a work environment. She is 57. Now all she does is lie in bed and falls asleep while watching TV, wakes up again and goes back to sleep. This goes on 24 hours a day. She does not get out of bed except to go to the bathroom. She hardly eats anything. I am worried that she is going to get physically ill from this potentially very very long wait for a decision. She told me if she does not get SSDI she will kill herself because she cant work and wont have any money. She hasnt worked in 4 years after getting fired from job after job due to her inability to remember things and lack of concentration among other things. She finally sought help through our County health clinic and has been going there for 2 years. I make a little above minimum wage and it has been very difficult for us to live. Is there any way on earth to find out if she is going to be approved or disapproved in a short time? Any answers to this?

The standard you have to meet is that there are no jobs within the NATIONAL (not regional/ state/ local) economy. If such jobs exist in great numbers within the National economy and either you or representative are not able ot present evidence refuting the ability to perform said jobs than you are (per SSA guidelines) not disabled.

Because of continuing symptoms of chest pain, he should have repeat catheterization” Liar Gregory M. Hamel writes “there is no indication the medications are not working” yet the SSDI doctor wrote “His BP is poorly controlled and he becomes very fatigued easily” It's interesting how LIAR Hamel can read the parts of the doctors report that he uses to deny but for some reason cannot comprehend the parts of the report that support my disability. The entire denial is like that, one lie after the next.

Thanks for nothing judge. I have been suffering 53 years and thought maybe I'll finally get some relief for my ailments and a diagnosis for my neurological issues and perhaps for once have a life or at least less uncertainty and misery as I continue to get worse. I've been borrowing money since my heart attack for medications and to keep my appointments with the cardiologist hoping to pay it back when I'm approved for disability as everyone said I would be. You set out to find discrepancies that do not exist and you rewrote the doctors reports to support your denial while ignoring my doctor. Even the doctors reports SSA sent me to for function report support severe disability yet you think you know better. You aren't fooling me with the way you turned the time line around to read different than the way it was. Apparently peoples lives are a game with you. You think everyone is lying. You should have to go through all the slammed doors we do and be made to see what it's like. What goes so far wrong in a person who is supposed to work for the people and calls themselves judges when in reality they are looking for excuses to sign your death warrant? You judge Hamel have no credibility or reason to be respected by anyone. You blatantly lied on my report. Do you sleep at night knowing you have denied people the very minimal care they deserve and qualify for? Do you even realize how wrong you are or are you so narcissistic you actually believe you're god?

Apparently known as “Death Panel Hamel” I can tell from reading these reviews of various “judges” the real problem in the system is no punitive damages or at least legal rate of interest to be paid if eventually approved. Without punishment for denying legitimate claims and twisting the evidence to fit the way you want, if you are approved eventually all they pay is what you were owed to begin with. I suppose most quit or die before then and SSA think they come out ahead but if the numbers of hours were added up in manpower I doubt they save anything. It's obvious they have a budget of dollars and figure out how many they can approve then wipe the slate clean after they hit that number regardless of legitimacy.

Continued from previous post..... Reading the opinion from judge Gregory M. Hamel he claims my physical examination was normal and the treadmill stress test was inconclusive. He then goes on to make it look like it was a separate visit where my blood pressure was noted as high and then I was given medication. He is either wrong or lying because the stress test is what caused the blood pressure rise, it was at the same visit, but judge Hamel tries to make it sound as if the blood pressure issue was just discovered. I was diagnosed much earlier in the hospital ER with high blood pressure and was on blood pressure medication at the time of the stress test, which proves the medication was not working and/or I still had restrictions in my arteries. Yet again, judge Hamel further in on the report writes there is no indication the medications I’m on are not being effective. He also said I “claim” to have pain but take nothing for it, yet in my many filings with SS I mention several times what I take for pain and that it does little good. The entire opinion goes on like that and many other items just as twisted. If anyone at Social Security reads these posts I hope you look into this. I’m in serious need. I assume you want me to die and go away, while I very well could die from lack of medical care, I WILL NOT GO AWAY.

I received an unfavorable opinion from judge Hamel as well with similar wording to others, despite two severe impairments even Hamel agrees with (there are others as well). Social Security had sent me to their doctor for evaluation and I told them I would be unsteady and unable to walk a treadmill due to muscle fatigue and muscular skeletal problems along with documented severely restricted arteries. I would be placing myself in danger by attempting it. I also had a pinched nerve in my leg where they had entered my artery for catheterization and I knew this would cause great pain. I was forced and coerced into getting on the treadmill and as soon as it started I told the Dr. I cannot walk this fast and he ignored me, within seconds I was gasping for air, fatigued and was about to fall off at which time the doctor stopped the treadmill. They checked my blood pressure and it was dangerously high, they allowed me to rest and checked again at intervals after and my BP took a long time to come down. The doctor acknowledged my BP rise was severe and said he would note it but call the entire visit inconclusive.

I was born with severe neurological muscular problems and have suffered physically my entire life and that has progressed and gotten worse with time. I've been humiliated and called names my entire life because of my weakness, I fight my bodies every move. I grew up very poor and had so little medical attention my problems were never diagnosed and those few medical records are now purged. After reading a pamphlet upon discharge from the hospital for heart attack, I discover I may be eligible for Social Security Disability. All my life I've been discriminated against because of my disability and now I'm told I am not disabled according to some statute. These people don't care if you are disabled or receive help, it's all about how can we hide behind some statute and make the circumstances appear to support denial when the exact opposite is true. There were so many untruths, fabrications, and ignoring of statements its as if the opinion was written without consideration of anything presented. The callous disregard for the truth makes one feel raped. I find Judge Hamel's opinion to be such an outrageous contempt for truth and human decency, I cannot imagine how he dare take money from our government as pay for such blatant disregard for people who are legitimately long suffering as myself.

Do they teach these judges how to make pained facial expressions as if to express they don't believe you? Hamel was doing that constantly and I found it totally repulsive. I find it amazing he gave my doctor, a Harvard grad who interned at Mass General, a limited weighting because he 'claims' it was not a function by function report and then gives great weight to the State agency (they paid for) who did nothing but ask a few questions and said my blood pressure spiked sky high when I tried to walk on a treadmill. There could be no complete report from the state doctor because basically nothing was done.

Agree with the previous reviews of judge Gregory Hamel. It's obvious he decides a case outside the facts. He finds more credible any evidence that supports his finding and ignores or misconstrues evidence that does not support his view. When there is nothing to support his view, he makes it up. If one Google's past law suits brought upon the Social Security Administration based on judge Hamel's opinions, you'll see almost "cut and paste" opinions repeated. It's as if judge Gregory Hamel is just going through the numbers game and rubber stamping decisions to not approve a claim. Judge Gregory M. Hamel is exactly why the public fears Obamacare, death sentences handed out by self impressed mediocrity putting in their time and being paid taxpayer money to deny people in need what is theirs to begin with. I had a slightly complicated case because of the processing and the fact that prior counsel had executed the notice of representation two months prior to the client's actually filing the application, so it misled the judge into thinking there was a prior application. There wasn't. We wrote a brief, the ALJ got it right, all is well. Good judge, listens to the testimony, and willing to correct himself it he is started down the wrong path to misunderstanding a point.

I've been in front of MANY ALJs that were MUCH worse than Judge Miranda. She can get tempramental at times, but for the most part she is very reasonable. She asks the rep if they want to give an opening, then asks the claimant about PRW, asks the VE to be ready to categorize the work when the time comes, asks the rep to go ahead with questioning, she will follow up with questions, will ask if the rep has any other follow up questions, then goes to the VE. She is very hard to read, though. She presents a hypo that results in jobs, then 3 or 4 that result in no jobs, so it's hard to know if she's thinking of paying or not except for the fact that she rarely pays! Very unfavorable.

She made her decision with speed, and did exactly what she said. In fact, my notice of decision came 5 days after the hearing. Hearing was on a Thursday, and I knew on Tuesday. Judge Miranda is probably one of the worst ALJs I have been in front of. If there is any errors in your file she will blame you and call you out on it in front of your client. She claims that Social Security never makes any mistakes and that evidence placed in your exhibit file had to be put there by you. She will tell you that Social Security has no plausible way to make a mistake about exhibiting your file. What a crock of total BS. She is hateful, rude, and lacks any sort of judicial tact. How she got on the bench is beyond me. She should be removed.
