Court date: Dec 19th, 2019 Decision received: Feb 13, 2020 Decision- unfavorable Judges attitude: negative Nancy (first class A******) F - I'm 37 years old and suffer from severe migraines, Achilles tendon pain, passing out, and some other things. Before we started my attorney asked the if he would turn down the lights because fluorescent lighting is a trigger of my migraines. The judge agreed and kindly did it. The judge and attorney talked for about 5 minutes, than the judge looked at me and said, "I have some questions for you." I raised my right hand as he asked. I was asked 16 questions or so. This judge will FAST TALK you so you don't have time to think. Here are the questions so you can come prepared: 1. What is your name? 2. SS #? 3. Birthday? 4. How old are you? 5. Do you smoke or last time smoked? (they have records) 6. Do you drink? 7. Do you do illegal drugs? 8. How did you get here? 9. Do you have any jobs that are side jobs or off the books? 10. Ever been arrested? 11. What do you do all day? 12. Are you in school? 13. Do you have any training? ( mechanic, hair school, etc) 14. Where do you live? 15. How long have you lived there? 16. Do you currently work? Remember, they will use ANYTHING against you. Example- if you say you took the bus to your hearing they will assume you know how to navigate the public bus system well. Lets say you lie about your birthday they will assume your lying about everything else they ask you. After the questions he talked to my attorney. Than the vocational expert said, "I could be a dishwasher." KARMA catches up to people when they least expect it.

I wrote a completely legal statement about Malcolm Ross on here, because he's a worthless scum sucking lawyer who knows nothing about anything medical or psychological and made a very disgusting decision on my case which is completely wrong. Social Security sent one of their henchmen to my house to shut me up (apparently, you don't really have free speech in America). Now, Social Security has my medical file so they knew exactly what they were doing when said henchman came to my house (with a sign right on the door that says, "do not knock, occupant works nights). I have PPD and a severe case of PTSD. This henchman pounded on my front door very loudly for at least fifteen minutes, went in circles around my house, pounding on my windows, yelling at the windows, pounded on my back door and then disclosed information about my medical situation to a neighbor. Of course when I called the henchman, I was angry, I have PTSD and the slimball triggered me! I stated verbally and in writing that I was no danger to myself or anyone else. Revenge can be legal. I mean I cussed out the henchman (Scott Jones is his name) but made very clear that I did not mean any illegal threats to anyone. I've been triggered for over a week because the dolts at Social Security don't like when you speak your mind (no matter how legal that speak is)! Guess what, I've been banned from entering a Social Security office because I'm too crazy but apparently, I am sane enough to work. How preposterous is it that the very organization that we pay for to turn to when we become disabled, not only deny people even way more sick than I am (which is pretty bad) But they actually make you worse. So, if I were alone in this world (like many people are), I would not only have zero income ever, I'd also be so triggered and sick. Let's think about that before we judge the homeless people you see on the side of the streets. The Social Security Administration and nasty, evil, apathetic creeps like Malcolm Ross create many of those people's situations. Malcolm Ross, I hope your wife gets PTSD and you are no longer able to work for some reason. You and she deserve to feel the suffering you caused my husband and me.

The moron denied my case based on his opinions about something medical which are refuted and proven wrong by any and every piece of literature about what I have. I saw him in November 2016. He is a rude bully! He asked me questions but then he answers them with his assumptions. He denied me, saying he chooses to not believe the 9 different experts, including the 3rd party expert in the court room. I’m not sure why he thinks he knows more than the educated doctors. I think he enjoys playing God over people’s lives. Don’t expect him to approve your disability, no matter how much evidence you have. I can only pray that Karma teaches him a valuable lesson one day...

Extremely prejudiced against people with mental illness. Found multiple public records to prove it. Lawyer even said she was extremely harsh and cruel. Used any little thing she could to deny me. 20 years of mental illness documents were all used against me. Denial is full of lies and misinformation. If you get this judge, request someone else immediately or make an excuse to miss your hearing date to get different judge. She will ruin your life. She did to me. My only hope now is that i die in my sleep.

Very, VERY disappointed. Was lied to and told I was going to be accepted, all I needed was an updated psych eval. Being someone with severe agoraphobia with panic disorder, debilitating anxiety, ptsd, and major depression, it was not only extremely difficult for me to even get to the hearing (having pulled over multiple times due to me getting sick) but also getting to this psych eval. I finally made it in to my psychiatrist and got the added diagnosis requested, to no avail, I was STILL DENIED. (even having MULTIPLE diagnosis that are qualifying disabling conditions) Receiving a 12 page letter on my birthday telling me I've been lying about everything, just about pushed me over the edge. Making a desicion based on 6 different therapists' NOTES, which I may add were completely misleading and full of false misinterpreted information. I feel completely failed by the system.. I have pushed myself so hard to meet these requirements and show how horribly I am surviving, how badly I need the help to get back on my feet. I needed that help more than you'll ever realize. I now haven't left my house for a year again, since receiving that denial. So thank you for completing ignoring my heartfelt nervously presented self explanation of misery and making your desicion based on someone else's words that only saw me briefly before moving to a new job. Now my DSHS cash benefits are being taken from me, the measly $190 I have been living on,because you denied my case even though it's clear as day to anyone else, that I am disabled. I can't do side jobs. I can't work from home with no internet connection. Thank you judge.. I am not strong enough to start all over just to jump through hoops that almost defeated me, only to be called a liar and be cut off from the only income I have to even try to help myself. My testimony doesn't match my records because my records were WRONG. Currently fighting my insurance to cover my telemental health therapy visits I was blessed to discover, paying out of pocket from that state money that is about to get taken from me. I guess 5 years stuck in a house isn't long enough for you. It's no wonder so many people choose to quit fighting. I will be filing civil action

I cannot adhere to any schedule due to the fact that none of the 6 chronic illnesses I have can be cured nor do any of the illnesses call me up ahead of time to let me know I can't function that day. This judge is an *****. I am 59 years old, 80 percent disabled by the VA and I have a service dog. This Judge would not allow me to have my service dog in the courtroom. My anxiety was at an all time high and he did not give a rip. He glared at me and I knew once my service dog was not allowed in the courtroom he already made his judgement. In addition in the unfavorable decision letter he used that against me and said I do fine without a service dog. This guy is a first class *******. He should retire.

This judge made a horrible mistake in judging my case she just keeped going on about my tattoos and I was just thinking to myself we are not here to talk about tattoos I thought were here to talk about a disability and the reasons why I can’t work but she was really just hung up about the tattoo situation again I was thinking to my self yes lady I know I got tattoos get over it already she was also judgmental on my Personal appearance my age ect so all in all I took her Decision to federal court and was in my favor for an appeal 18 months later here I go again back to court again all over her Mistake she made and For wasting my time at the end of the day she didn’t do her job right if you get this judge for your case be careful on your appearance and also be very careful on what you say she is very Judgmental and well deny your case for any little reason she feels like in my Experience is the worst judge to have.

I am the single case approved by the Albuquerque Odar ALJ. Mariam C Fernandez Rice in the year of our Lord 2017. The processing office is forcing me to appeal the decision without my consent. In processing the protected application date of the approved title 16 before the approved title 2 is being denied by the processing office. And forcing me to blame the ALJ as being in error. When P.O.M.S. D.I.27515.020 new title 2 D.I.B. claim- title16 disability previously established. Clearly refers the processing office as the responsible entity in favoring the claimant in detail. My hearing went before ALJ Blanton one week ago and I found him to be very kind. As I was getting settled, he even made a couple of witty jokes that helped me calm down and see him as a man instead of a prosecutor. It also seemed apparent the Judge Blanton reviewed my file ahead of time, based on the questions he asked me and what he asked the employment expert. Overall, my experience was good. ALJ Blanton showed everyone in the room kindness and respect. Most importantly, he demonstrated what and why the bailiff calls out, "The HONORABLE judge...".

Judge Gary Elliott should be depended, disbarred and thrown in jail. On my social security denial he decided that the testimony of my licensed Psychiatrist carried "little weight" because my Psychiatrist agreed with me. He totally disregarded the fact that I was having panic attacks, vomiting and getting diarrhea on the way to work because my anxiety was so bad. He implied that somehow I just made up the arthritis in my back, but x-rays don't lie. He does not believe that people with anxiety and depression can get substantially worse over the years. I used to be able to function somewhat at work but with much difficulty but stopped working because of panic attacks, crying, difficulty breathing, talking too fast, getting in trouble for behavior bring socially inappropriate

I understand that this could be taken as "this person got turned down and is upset". I am indeed upset, but it is because I was turned down for completely false reasons. So beware of this Judge. She will use anything she can against you. I thought my rep and I had everything in order. My T's crossed and I's dotted. I was wrong! This judge acted as if my PCP's RFC paperwork didn't exist because one minor thing was not in my medical history. My PCP supports the fact that I am disabled. I also have two other doctors that stated I had MDI's that met the SSA guidelines for disability. She uses things in your medical report that are autofill parts from specialists. Like my wrist Ortho's ROS form that I now know he doesn't fill out except for the reason HE is seeing you. That being my wrist. So he didn't fill out that I have fibromyalgia, severe headaches, back pain, weakness, etc. And that was used against me in the decision letter. Even though it was never asked about at the hearing. This judge seems to discriminate based on your age and medical condition(Still a lot of judges that refuse to see the conditions I have as real). Even though my MDI's are listed in the SSA guidelines she chose to not consider them. There are so many errors in her decision letter that my rep said it will take a while to list them all. So I guess that's a good thing. Problem is that I have been trying to get the disability I deserve for 4 1/2 years now. My family and I are financially ruined. The appeals council will take 14-18 more months per my rep and then if Federal suit is needed, another year or more. My family will be on the streets by then. The SSA system drains everything you have worked hard for in your life and drags the process out over way too many years. Just to be turned down by someone who doesn't follow guidelines and makes wild assumptions with no facts.

This is my personal opinion of Cynthia D. Rosa Administrative Law Judge at the Tacoma ODAR. She is not honest, is not fair or impartial and needs to be bared from practicing law. It is my opinion she will change the facts in a case for the purpose of her ALJ decision. This is not fair to the other hard working ALJ's working at the Tacoma office that are fair, honest and do a very good job. Everyone that has had or believes that she has acted improper or biased need to report her for investigation.Claimants and their advocates or representatives may file a complaint against an ALJ if they believe the ALJ was biased or engaged in improper conduct.Individuals may submit written complaints to the Office of the Chief ALJ as well as regional offices RO) and hearing offices.ODAR receives complaints through a variety of other means, including the Appeals Council(AC),the Social Security administration’s(SSA) National 800 Telephone Number Network, the Office of the Inspector General’s(OIG) Hotline, and members of Congress on behalf of their constituents. According to SSA policy, ODAR will review, investigate, and respond to each public complaint against an ALJ. The Division of Quality Service DQS),within ODAR’s Office of Executive Operations and Human Resources reviews and resolves these complaints with the assistance of ODAR’s RO staff, as appropriate. Only state the facts and list how the judge was impartial or biiased. It does not good to complain unless you take the effort to report the conduct. It will be tracked and may help other claimants.

COMPLETE NIGHTMARE OF A JUDGE. Did NOT take into account much if any of the testimony of myself and my attorney. She conveniently overlooked over TWO DOZENS documented issues and statements. She even went so far as to dismiss the occupational expert's final testimony that I am NOT able to hold ANY job in the US job market. I was medically retired from the Army and the VA rated me 100% disabled for PTSD and I'm considered housebound, which basically means I can't leave the house without having panic attacks. What does it take to get approved?

Judges are supposed to be impartial but clearly this word does not exist in her vocabulary. She should be removed from being a judge. My experience with Judge Erickson was very similar to Eric B.'s comments dated 3/9/2015. He was understanding, sarcastic, and intimidating, all in one hearing. In the unfavorable decision, he places more weight on the less significant details of your medical records, and less weight on the proof that SHOULD get you approved. A lawyer recently said to me, 'he denies just about everything.' The SSA needs to revamp its process for case reviews, because it is a violation of due process to allow judges such an extreme amount of discretion in their decisions. Our lives should not depend on the 'luck of the draw' in being assigned to a judge. There are laws and guidelines that should be followed.

Another thing about this incompetent judge: She asked me about my PTSD. I said, "Well, it's fear and --" she CUT ME OFF. I told her I do better in therapy with a Christian pastor or therapist,and she twisted my words. She badgered me. She put me down. This woman has NO compassion. Again, I was told by Disability that I was get an "impartial" judge. I was even going to ask for just "supplemental" disability, but she wants me to go AGAIN to "their" psychs. just to be told "nothing's wrong with her." They are PAID to say nothing is wrong with me! I have cut my arms when I get depressed She saw PICTURES of my bloody arms! I even TOLD her at the end of the hearing that I "don't want to be like this. I WISH I could go put on my nice suits and kick butt and work, but I can't!" She just tsked her tongue and walked away. There is something wrong with this woman!! When I was working and an attorney would get verbally abusive, I had panic attacks,and one time the ambulance and cops had to come to the deposition! She accused me of not taking my meds, which is a flat-out lie! I even talked to the doctor who's treating me after the hearing and he said he didn't say that. Whatever! She's so nasty and just doesn't give a crap!

This judge is full of crap and will deny you. In my wifes meeting with him, the vocational expert and the Judge himself said there was no type of work my wife had done in the past that she could perform now. But when the "official" report the judge wrote came back it states they both said she could. They say things in the meeting that make you feel good and that you will win, but that is not the case. The judge even put things in like asthma that my wife has ever said anything about in the report. He also basically called my wife a drug seeker and an addict.

I sincerely feel bad for the other reviewer and hope that he/she has been approved or better yet, healed, I had a different experience. I am a 38 year old male with MRI's that show bad arthritis in multiple places, tile table was positive for severe orthostatic hypotension. BUT, the rest of my illness is an "invisible illness". I did not exaggerate anything, if anything I under-played my illness (stupid pride). Judge Wexler listened to everything I had to say and appeared attentive to my complex issues. I'm not yet sure if she ruled fully or partially favorable, I just received notice from my local SSA, not yet from ODAR. No matter what her decision, I believe she ruled fairly in my case at least. Now, I need to work on getting more tests and trying to find treatment that works so I can get OFF disability! I take off a star on the assumption that the previous commenter was indeed denied based SOLELY on ability to drive.

The judge started out in a negative mood that shadowed the hearing. While I was approved, he removed 2 years off of my disability claim. The two years removed were the years that my Bipolar visor made it impossible for me to function. 2-4 days I could not get out of bed, days my husband stayed home from work because he was worried I would kill myself. The only conclusion I have is that This judge does not consider mental illness to be a real disease that can affect people's lives. From my work as an ER nurse, From working the Thurston Shooting, To raising a son diagnosed with Bipolar disorder at 13, and having to have him taken to the ER in police restraints because his violent outburst broke his father's nose and sprained my arm, I think I am very qualified to say that Bipolar disorder is a disease that is just as debilitating if not more that all of the blown out disc's in my back. And in fact was a little intimidating to talk to and by the book!I can say he is probably one of the best judges in Portland even with a somewhat high denial rate!He is smart and Listens......and I was scared to death even though my attorney said things went great:)until I got the letter I was on pins and needles.........But the truth always prevails! The more "desirable" comments left below were obviously fabricated, most likely by Judge Gilbert himself. I've worked in close proximity to Mr. Gilbert on many occasions, and can attest to the fact that he is no longer competent enough to perform his duties. I feel bad for him but he is currently a danger to the community and should be evaluated immediately. If you're certain you've enough evidence for a favorable decision, I recommend contacting the Appeals Council directly upon receiving a denial from Judge Gilbert. They are aware of his conduct.

Hi, I want to say that the judge my mother had on 8/1/2014 was a blessing. Finally someone listened, and heard the cries of my mothers pain of all that has happened to her in life. Her anxiety,depression,PTSD,Abuse,and other health issues. My NANA went with her that day, and they just prayed for farines, being on the negative that was being said about judges not caring. Well my mother said the judge, and the staff treated them well, and that was a shock for her. My mother told me the judge listened to her, and showed he was a human being with care. My mother just prayed,and gave it to God. She said the lord knows the truth, and will be on her side. Her verse Psalms 7 she just kept saying it. My sister, and I feel a little better going off to college know. My mother wants to thank Judge Gary Elliott and staff for letting her speak, and her approval. She will never be the same, but a least this part of the system showed her they care about mental illness. The lord is watching over her, and my NaNa and PaPa. Helping my mother with paper work. We needed location for address. She came across of some scary reviews that people wrote. They wasn't treated fairly, and was judge by them not caring. We came across one that said that one of the judges did care. To see her go in to anxiety attack again scared me. She has been a fighter all her life, and worked hard. My mom is not the same. We lost her years ago. She always kept putting the strong face on. My sister, and grandparents would hear her cry at night, and break down. I'm praying that the Judge is honest, and fair. My mother has been through a lot with sickness, and other health issues for years. This VA scandal with high ups not protecting people, and helping is sad. They end up hurting people, and they die. Mental illness is serious, anxiety, PTSD, Depression, being abuse, and other chronic medical issues. My mother worked hard in life, and did everything right. What happened to her in life still hunts her. People deserve their disability. Nobody understands until you have the issues. Mental issues is serious. My mom covered hers up for years when bad was being doing to her for us. Until you have a panic attack, anxiety, depression or see it happens to your love one. It's hard. Just wanted to say that after reading all the negative stuff about judge Hyatt, I was terrified to go to hearing. Anyway, the first hearing, my lawyer got us kicked of within five minutes, so the judge rescheduled me. My second hearing we had a snow storm and i was having a bad panic attack so i was late. Judge Hyatt could have easily dismissed my case for that but he didn't, he rescheduled me yet again. I went to this hearing and everything went well. He apologized for everything taking so long and was a very nice person. So i just want anyone who has a hearing with Judge Hyatt to please dont pay to much attention to the negative comments. He was very proffessional and helpful. If all those comments were true i dont't think he would be allowed to be a judge. Thank you Judge Hyatt for being patient with me and giving me the chance to have you hear my case.

Its really sad that these judges don't take more time to see just how bad a persons health really is. I had my hearing last October and just now got a letter. I've been trying to get on SSI disability for 4 years now. With letters from my doctors for the last 2 years. I have peripheral neuropathy from my nees down and in my wrists and hands. Copd, Asthma, sincopes, and type 2 diabetes uncontrollable. I take 22 pills a day ( 16 for pain alone ) 3 inhalors, 112 to 120 units of insulin a day. I can't sit or stand for very long without a lot of pain. Its hard to breath around a lot of things, I'm on oxygen at night for sleep apnea. First thing out of the judges mouth was I know your health is very bad that's why we don't have a doctor here with us today. But I'm sure there is some kind of job out there for you !! Well he kept me there for 2 hours trying to find a job for me with no luck. And now once again kicked aside from another worthless person ! I mean come on, if there is a job out there that will let me sit down and rest evry hour or two, pop my vicodin evry 4 hours, use my cane on bad days, Take your cape off, get your butt from behind that desk, and find me that job ! I worked my butt off all my life and my government took money from my pay check just in case I was to get sick like this to help me. So now I have to fight to pay my bills and put food on my table for my wife and me because YOU don't feel I'm to sick not to work now. Well its to bad I can't put your feet in my shoe's for a day to really see how I feel. I honestly feel that some one like you should not have the power you have to be able to abuse it the way you do. Good luck down the road because I'm a firm its going to come back to bite you in the butt !!!

Reading through these comments it is very apparent that The Judge's page has been "spammed" with negative comments. This is probably the action of one Daniel A Bernath, a shady "attorney" who was denied clearance to practice state law by the Oregon Bar due to "low moral Character" while an attorney while a member of the California State Bar, due to failure to support his children, forging and cashing his clients checks without their knowledge and destroying his legal files. This same Bernath crashed his private plane due to him not putting gas in it, and is now trying to sue several companies for millions of dollars because " he wasn't informed" that the plane could have problems with little or no fuel. He has published a long boring list of accomplishments that are emblellished or unverifible. He claims to be a 90% disabled PTSD from Vietnam, while his service consisted of being a photographer aboard a ship. He photo shopped his face on the picture of a Navy Chief Petty Officer and says he was made an "honorary CPO" when that title can only be given by the US Navy. In summarizing I am posting this to simply ask that the people who want a review of Judge Hyatt disregard the negative posts by Bernath and his sock-puppets. A simple google search will link you to news articles that give a balanced account of the interaction between Bernath and Judge Hyatt. As a side note I am also a retired veteran who draws a 100% VA pension and SSDI, so I understand the concerns of anyone going through the process.

Before my hearing last month, I made the mistake of coming on here and reading these reviews. My panic attacks started increasing the closer it got to my hearing date. After a childhood and life of being abused, I thought, I can't take one more person being cruel to me. I had a vision of a horrible person in my head. I was expecting the worse. I was shaking, scared of what I was about to have to talk about, and scared to death of this judge. But yet he was kind to me. I felt like he was genuinely interested in what I had experienced as a kid, and what it has left me dealing with on a day to day basis. Not one time did he make me feel bad, belittle me or do anything that is stated here. The first words he said to me where, "I can see you are really nervous, and I want you to know it's going to be okay." I won't ever forget that he said that to me. He did dig into my life big time, but I felt like he needed to, not only to understand me, but to understand what I have experienced and how it affects me each day. I honestly felt compassion from him, and maybe that's because I was horribly abused as a child, and he could connect with that somehow. I obviously don't know him personally, so I can only guess. But I had to come on here and say my piece, because I appreciated that he was kind to me. At one point, I broke down sobbing, and they even got me some water to drink. My honest opinion/feeling is that Judge Gilbert's no nonsense approach may be misinterpreted as meanness. All I can say is that my personal experience with him, I did not see this mean person that everyone has talked about here. I experienced a judge who had taken the time to read my case, and find out who I was and what had happened to me as a kid. I appreciated that in itself. I have not received my decision yet, and no matter what it is, I still stand by what my experience was. I also have a rule that I don't write bad reviews online about anyone. There's enough meanness in the world without me adding to it.

I waited from 1999 to 2011 to have my story finally heard, & when I received my paperwork I cried for over a week straight. She not only turned info about me into bold face lies, but also based my entire 12yr struggle on a Drs opinion that I saw one time! I've had to live in poverty, since my disease makes having kids a huge problem, but if I would have had them if be able to receive benefits. Me attending college & being misdiagnosed for 5yrs cost me everything. I think she's extremely unkind, uncaring, & doesn't take each case into consideration. She saw a young woman, who doesn't look disabled, & wrote up a denial letter that only the most heartless person could ever write. She's the reason I will remain w/out finances to even purchase my 8 meds monthly.

This judge made a terrible mistake in judging me incorrectly. She had numerous errors throughout the lengthy denial letter I received, regarding her supposed review of my medical records. She claimed I didn't have proof of several diagnosis' in my records when there was clear cut proof in these records. My third party who was supposed to testify at my hearing was not allowed to do so, and She made allegations in her letter about me that are downright descriminatory and false. She didn't ask me about several things during the hearing but then made statements in her letter accusing me of things she never gave me a chance to confirm or deny. She claims I am still able to work despite the fact I have become so ill that I can't keep up with my own personal hygiene let alone work. I haven't even been able to keep most of my appointments with several of my specialists because I have been too sick to drive myself to them. I have several diagnosis' on the adult list of disabling conditions, and I hope she sees this and knows that she was cruel and wrong about me, and my life has been completely destroyed because of her. I will most likely have to live on the street soon because she denied me benefits I have desperately needed. God help you if you have to have this judge in charge of your hearing. She is irresponsible and descriminatory and shouldn't be allowed to judge with her own personal opinions on a person. She is mean and will destroy your character if she doesn't like the look of you. That is what happened to me. She will destroy your life if she doesn't like you. This judge ruined my life that was already in the toilet from years of suffering from a rare illness.

I have not yet had the privilege of meeting Judge Erickson, but I am scheduled for my hearing tomorrow morning. Since I didn't see any comments on here, I decided to post and comment that my attorney's office has told me that Judge Erickson is extremely fair and knowledgeable. He apparently has a reputation for taking time to listen to and read all the evidence. I'm not worried so much about the hearing as I trust that he will be fair, what I'm concerned about is making the one hour drive to the courthouse and struggling with using medical supplies in front of people.(I just pray I won't have to!) When I stumble in front of people it's very embarrassing, so I just have to remind myself that the people in the courtroom will know why I'm struggling and it'll be okay. I will most definitely come back and post a follow-up comment tomorrow, since I believe that if I came in here wanting to see feedback, I'm sure others will as well. Note: I'm giving the 5 stars based on what I have heard, since I won't meet him myself until tomorrow. Thanks for understanding.

Judge April M. Wexler is a Judge who is definitely not aware of the fact that many people who are applying for disability are actual people who have serious pre existing and continued long term medical issues and medical problems. I believe she looks at the actual person instead of the combined medical evidence, which includes narratives MRI's, and x-rays provided by the Medical Doctors. Furthermore I believe that Judge Wexler is biased with many of her rulings and decisions. In my case her words to me directly were " If you can drive then you are not DISABLE period regardless of your medical conditions"

The representative who my law firm hired from my city was a waste, in my opinion. Mr. Gandy gave me the curtesy of less than 15 minutes to meet with me right before the hearing and I can say that the way he asked me questions that morning, I knew he did not read my file that was forwared to him from the actual law firm I had employed to represent me. I was very fortunate to have Judge Rauenzahn reside over my disability hearing. Walking in, I felt like I had already lost, but the Judge was warm and human by the way she introduced herself to me and how she related to the Recorder and Statistic Case worker. It amazed me all through the hearing how much she knew about my past health to present. Unlike the representitive I had been appointed, the Judge's thorough knowledge of me actually gave me a sense of validation. Thank you Judge Rauenzahn.

My Hearing was on 12/21/2012. The Court completely ignored medical records submitted after the Hearing (by extension of time) from a major stroke incident which would prove that the claim was within the time limits required and ignored extensive medical records from the Veterans Administration claiming that they did not receive them even though my attorney provided me with proof that not only were they sent, but also received by the office. The VA records show that the claimant has: Aortic Valve Disease, chronic PTSD (from the Vietnam war and from another source), Tachycardia, Sinus Nerve, Injury to the peroneal nerve, uncontrollable Hypertension, Inververtebral Disk Desease, Depressive Disorder, and is partially paralysed. Any one of these would result in a disability award except the Judge decided that he wanted to dwell of the Claimants recently deceased life partner of 32 years with questions about homosexual issues such as what illnesses my partner had. A detailed appeal was made to the Office of Disability Adjudication and Review and the claimant has requested a copy of the audio transcript however thus far they seem to be avoiding providing that to me. This tranascript is needed for a future Federal Lawsuit against the Social Security Administration as this current appeal is the last required stop before being permitted to file in the Court. Is there a personal Judge bias here or just how disabled do you need to be to claim?

Well, the good news about losing a case is that you have one more appeal then you get to cost the U.S. Government big money as you take your case to Federal Court. I would recomend that those doing so carefully review the transcript and also get an audio copy. If you can prove malice, you can get the sky's the limit money when you sue. I have known that some of these Judges disregard medical reports and statements without providing an opposing professional opinion. Nice kangeroo court tactic.

Dan R Hyatt, admin law judge attacks helpless lawyer on crutches. Sworn declaration for Restraining Order issued against Dan R Hyatt. During my hearing on March 31, 2010 the administrative law judge wore a black robe and sat elevated from me. The judge was Riley Atkins and he had curly black hair. 2. He said to my lawyer “this is a case only about whether or not the time period is up and extension. I rule that she is past that time and therefore I will rule against her. As that is the only thing we are here for I will not take evidence about her disability.” 3. My lawyer said, “Wait, let’s not go so fast. Let me see the Notice. I didn’t get a copy” 4. Atkins said, “You had the chance to look at it before. Did you make an appointment to come and see the file?” 5. My lawyer said, “No, let me look at it now.” 6. Atkins then handed it to my lawyer (by handing it first to the vocational expert). 7. After my lawyer read of the file and his long discussion with the judge my lawyer turned to me and said, “claimant…” 8. The judge interrupted my lawyer and said, “Show some decorum. Her name is Mrs. Johnston.” My lawyer said that he was making the record clear after the long discussion with the judge so the record would know that he has stopped talking to the judge and was now talking to me, the Claimant. 9. My lawyer read to himself, the Notice and my Request for Hearing before an ALJ. He then asked me some questions and then the ALJ interrupted him again to stop him before my lawyer could complete what he was doing. 10. My lawyer said that he was not “going to close any doors” and that he believed that because of my mental condition that there was “good cause” to extend any deadlines and to deem the Request for Hearing to be a new application at the very least. (That was what I believed I had been doing when I wrote the Request for a Hearing-requesting a new application). 11. My lawyer refused to give up any of my rights and demanded that I be approved to be back on disability today. 12. The judge said the case wasn’t “worked up” and some other things. 13. The judge then said to me, “madam you have to go to the field office and file a new application.” 14. My lawyer said, “She should take advice from her lawyer and not from the guy who is throwing her out of court.” 15. Atkins then said, “Ma’am you should file a new application in Beaverton…” 16. My lawyer then said “Don’t give my client legal advise. I’ve already instructed you on that once. It isn’t your role.” 17. At all times my lawyer acted calm, professional and civil. If he didn’t act that way then I would have had to flee him (because of my severe mental illness). My lawyer acted calm, quiet, professional and civil at all times and that was how I could attend the stressful hearing. 18. My lawyer was not loud or argumentative. He made his objection heard and then made it again as I expect a lawyer to do in a courtroom setting. 19. My lawyer at no time was threatening or intimidating. 20. I then went into the lobby of ODAR with my lawyer where my husband was sitting. My lawyer Daniel A. Bernath looked at my husband and I and said, “let’s get out of here and we’ll talk outside.” 21. Dan then led the way, holding his black cane/crutch in his right hand, pulling his big box of books with wheels with his right hand and wearing a homburg hat. He was looking very dashing. 22. Dan was leading. My husband was following him and I was following my husband when we turned the corner to the elevator lobby of the 4th floor. 23. I saw an old short man wearing a brown colored outfit in blue jeans with silver hair already inside an elevator. Except for him the elevator was empty. 24. When we approached the elevator to get in, the old man quickly ran forward from the back of the elevator and stood at the front of the elevator and shouted “No” “You’re not riding on that elevator” “No”! 25. The old man alone in the elevator was very belligerent and confrontational. 26. My lawyer did not enter the elevator because the old man blocked him. 27. My lawyer never said a word to the old man. 28. The man then bumped my lawyer with his chest. 29. I saw my lawyer kind-of step back from the force of the blow but my lawyer couldn’t back up because the wheels of the box stopped him and there was me and about 4 people trying to get on the elevator and they were right behind him. 30. The man then hit my lawyer a second time but this time with much more power and with his chest and his stomach this time. 31. My lawyer had to work to get his balance after being knocked off his feet. 32. The man then said “call the police. I want him arrested for assault. He just bumped me.” 33. My husband Roman Johnston said in a quiet voice, “no he didn’t. You bumped him.” 34. The man then got a very wild look on his face and was very aggressive and said to Roman, “what’s your name!” 35. The man alone in the elevator became even more aggressive and offensive. He had a very wild look in his eyes. 36. That was the only time my lawyer spoke and he gave legal advice to his client Roman and said, “Don’t answer that.” 37. The security guards came. 38. That man was taken around the corner away from us. I later found out that the old man’s name is Dan R. Hyatt. 39. At no time did my lawyer’s hands leave the box handle or his cane/crutch. At no time did his cane/crutch or box leave the floor. At no time did my lawyer come in contact with that man except when that man hit my lawyer with first his chest and then with his stomach and his chest to knock my lawyer on the floor or back. No part of my lawyer’s body entered the elevator. Dan R. Hyatt used his chest and stomach to repeatedly batter my lawyer who stood out in the hallway. 40. Hyatt didn’t want my lawyer in that elevator at all even though it was completely empty and even though there were 3 to 4 elevators on one side and 3 to 4 elevators on the other side of the hallway. 41. The security guards came and blocked us from leaving and my lawyer asked “am I under arrest” and they said “no but you can’t leave.” He said “then I’m leaving now” and tried to push the button for an elevator but they blocked him from leaving. 42. The federal police came and they roughly grabbed my lawyer’s hands behind him and put handcuffs on him. As they were leading him back to the Social Security Court with his hands tightly cuffed behind him I heard my lawyer say to them “on advice of counsel I have nothing to say.” 43. The federal police asked me if I saw what happened. They took my license information but didn’t write down what I was saying. There was a second policeman and when they confirmed that I had made a statement then said I could leave (but could not talk to my lawyer). 44. I haven’t left my house since that traumatic event in watching my lawyer get assaulted and battered and arrested nearly a week ago. 45. Seeing your lawyer get arrested is like seeing your Father get arrested and hauled away. I trust my lawyer and it was all extremely traumatic to me to see my lawyer get beaten and then get arrested and handcuffed and taken away to who-knows-where. 46. I have been before Judge Michael Gilbert 2 times. I found he I believe purposely went outside the guidelines of Law several times with regards to the scope of his questions. I don't know whether to believe the statistics. however my experience has not conformed to the numbers be represented. the time it took to get my case before this judge was extreme. my case was even delayed further because judge Gilbert stated he had a conflict in his scheduling. I am a disabled veteran on state pension. I have to tumors in my liver and blindness in my left eye as well as degenerative disc disease in all but 1 disc in my neck I was sole provider for my 3 girls when I was injured on the job in nursing. that was March of 2005. I have yet to receive my hearing information. the last of the hearings was held September 18th 2012. it is now the last day of January 2013. I had to sue the last judge I sure hope this time is different. this is the worst system I have ever been exposed to in government

Judge Gilbert is a hacket man; he does not follow the law. He is rude and insensitve. He acts as an advocate not as a judge. He is a prosecutor of anyone who believes he or she is disabled. He will tear you apart as a prosecutor and minimized any problem you may have. Every person appearing before him should contact their congressman and complain about his confusion. He prosecutes you for your impairments and highlights anything to destroy your credibility.

Judge Hyatt is the kindest ALJ I have ever met. He is truly a compassionate Judge who takes a wholistic approach when holding his hearings. He doesn't just deny or allow benefits he tries to make sure claimants needs are met emotionally, physically, medically, and mental health care! The hog wash others spread about Judge Hyatt is just lies spread by terrible attorneys who don't like his rulings!!

Judge Gilbert was not a "good Judge." and I am using the politically correct terms in order to keep my temper. He was very unethical in terms about asking in the beginning of the proceedings about my marriage falling apart and if that had anything to do with my mental state, who was getting custody of my daughter in which there was complications that obviously he was aware of that not I nor my attorney was aware that he knew of, and a CPS investigation concerning my now ex-husband that was involving my divorce that was completely separate from my medical portion of my procedings. I am a disabled veteran. I felt attacked in every way, shape, and form. I suffer from PTSD, brain lesions, asthma, a pseduotumor that has made me 80% disabled with individual unemployability through the VA. He asked about my "stressors" and when it was told to him about my events overseas, his comments were less than favorable - "Is that it???" I have been in school before getting diagnosed with my psuedotumor and because of a misdiagnosis of migraines in which are now combined with the pseudotumor to date. He over-analysed everything and even asked for extra things such as letters from my instructors concerning the provisions that they had given me in order to stay in school to graduate so I wouldn't incur a debt to the VA and be successfull in graduating. According to his extenuating notes, he stated that I appeared, "normal" as if that I am supposed to be in some sort of state when I have made provisions to get better when my sight was going to go and much worse, being a single parent with two children to care for. He questioned my integrity as a parent, a female and a veteran. After all of this, I was not surprised that he denied my social security benefits for being honest and putting me through the worst 90 minutes that no one should have to endure. If my opinion, Judge Gilbert is a sniper when it comes to compassion and I have every right to file a formal complaint for the injustice that he had put upon me. Not for just his findings, but for how his process is. And hopefully, with my complaint on record, no matter what, it may help towards not having someone else go through this for them or their family.

I must disagree with the prior poster. Judge Dantonio's opinions are well thought out and well reasoned. I rarely appeal her decisions as a result. Although I may not always agree with her decisions, the clients are treated fairly and I know that she will consider all of the evidence in an impartial manner.
