My son just got his decision and was denied SSI. He has been fighting for 4 years. We don't know what went wrong, but, trust me, I will find out. My son has Bi-Polar Disorder, PTSD, Sever Depression, a fractured spine, Spondylosis, arthritis, and arthritis in his spine. He is in pain 24/7 and has not been able to work much at all in his adult life due to all his issues. The work specialist at the hearing stated to the judge that there was no job he would be able to do due to the type of disabilities that he has. I know for a 100% fact that several things on his list of disabilities qualifies him for disability along with the statement from the work specialist. I have not received the letter of explanation as to why he was denied, but, I guarantee that he either made a mistake or he just ignored the medical evidence that was presented to him. If this is not resolved then my son, with my help, will file a grievance against this judge. We will have his attorney file an appeal first, but, like I said if this is not resolved with an approval for disability we will not hesitate for one minute to file a grievance!!!

Being 208 days out from my hearing and 37 1/2 months from my death, I'd love to review King Timothy I. This man is a disgrace to the people who have earned the position to be called 'Your Honor'. I personally feel he isnt qualified to be a legal secretary. Not accountable to ANYONE. I've called both my federal Senators and my Rep. They are powerless! Supposedly he's the head ****** in charge. I wouldnt allow him to umpire a little league baseball game. I dont know how someone so unethical, and uncaring can sleep at night. Biggest mistake I ever ,ade in my life was to allow the corrupt *** SSA in my paycheck. Nohing but theives. He acts like he's giving out his own money, as charity.

Just another judge who apparently loves to see people who worked hard and ended up with back surgery and hip surgery suffer. If anyone should have gotten their disability, it should have been my wife. This guy is a joke for a judge in my book and everyone who knows my wife. Has no idea when someone is really hurt. It's either that or he's being paid off to turn down disability by the government.

Judge Crocker denied my husbands disability. My husband cant walk, sit, sleep and he is in pain most every waking hour! He has reports from 2 doctors that give him a maximum of lifting 10 pounds! My husband has ALWAYS been a hard working man and all his hard work proved was showing that he is a fighter and it got him denied! He has had numerous surgeries and has spondylolisthesis, carpal tunnel in both hands, diverticulitis, crohn's disease, he has to walk on a cane due to sudden weakness in his legs and at times I even have to wipe his behind ! Yet he was denied! What the heck is wrong with these judges! I'm willing to bet if he had gone before the judge and NEVER worked he would have been approved! I don't know how we are expected to survive, we have paid into the system from the time we were 18 and now he is 49 and I am 50, and the stress from worrying about the bills have taken their toll. I work full time but we all know it takes 2 incomes! He isn't asking for a handout he is has worked his entire life and paid into the system! I know this judge is new but good grief show some compassion! During the hearing you guys couldn't even find a job that he could do!

Decision was definitely made prior to my hearing as it was listed as made the day after my hearing. All medical evidence provided, without a doubt proved my claim. Vocational expert essentially said I was unemployable. Questioned notes in my medical records several times and twisted the answer around to make it seem I was a liar. Unfavorable decision listed a myriad of reasons for the denial including dates, physical statements, and other such information seemingly made up out of thin air. Causing intense friction between myself and medical providers as I believed what he said was true. Now I am an unemployed disabled mother without benefits or the ability to care for my child or take care of myself.

Lies out his wazoo to "support his findings." I have been diagnosed for the past 5 years with PTSD, major depression, severe anxiety, short term memory loss and sleep disorder and 11 years with seizures and 3 lesions back right side of my brain (3 different doctors in 3 different states multiple MRIs). Meade claimed that there was no record of sleep disorder or medication in my file, yet I've been on Ambien 10mg for 5 years along with other nerve medications and no evidence of "claimant's supposed lesions." He claimed that my mental reports showed "easy communication and relaxed mood" but conveniently left out the multiple times I've been admitted to psych wards and crisis units.

I had my hearing on February 17th for SSI in front of Judge Mcmillion. It is now been over 1 month and I have still not received a decision either way and as I'm sure all of you out there are very familiar with, this has been 4 LONG financially, emotionally, and psychologically traumatizing experience. While I was very scared and nervous judge McMillion was extremely easy to talk to, he asked fair questions and listened to not only my answers but my attorneys as well. I do feel that he was very fair and he made the hearing process far less intimidating and scary than I thought it would be. Can't rate him as far as his decision goes because I don't know what it is yet. I do know that by the time you have waited a minimum of 1 year and from the looks of it a maximum of maybe 6 or7 years, that once you get to the hearing stage you should receive your decision in a quick and timely manner, as there is nothing worse then waiting for a decision after you have already been waiting years to even get to this point. I'm quite sure they count on most of us to give up or drop this at some point in time due to the financial hardships and burdens it puts on the claimants because of the lengthy amount of wait time for a hearing. Filing for benefits has been the most frustrating, bureaucratic, time consuming, nerve wracking, financially draining thing I've ever gone through and that's saying something!! Best of luck to all of you who have filed and are awaiting decisions my heart goes out to you and I pray for favorable decisions. All in all I found judge McMillion to be compassionate, fair and very thorough.

I am yet another person who was turned down for disability. I have and took to the court a stack od medical files 6 inches think. I have neuropathy in both feet from 4 foot surgeries,fibromayalga, auto-immune hepatitis that I will have for the rest of my life,and have to take medication for it.I have been depressed for a few years now since I was diagnosed with the auto immune this disease has bitterly stolen my life.I have oseoarthrits in both feet and in both knees I have to have 2 knee replacement in april. I have Chronic liver disease for the rest of my life through no fault of my own. I don't drink or smoke.Yhis judge was very unsympathetic to my disability I looked at the numbers of cases that he approves/disaproves and they are higher in huntington wv than any where else the minute he asked me if I went to church,and I said no ,I had a gut feeling he would deny it and I told my lawyer when we walked out of the hearing. I am an american citizen. I have worked all my life raised 3 children on my own, Each of my children are college graduates and contributors to society. I f this was your money that you paid to SS all your life and you become disabled through no fault of your own,and you had a passel of Drs. reports to back you up how would you feel,someone need to check on HIM.

I am 60 years old. From 2014 until 2016 I I was disabled with a non-union fracture of the femur. I also had medical history of soft tissue sarcoma. First occurrence was in 2000 and a second occurrence in 2002, and advanced degenerative disc disease. Even by the rigid DDS standards, I have a disabling condition, and should have been allowed SSDI. but that did not seem to occur to the "judge." My doctor generated a letter indicating I was not able to work full time, even at a DOT sedentary level, but this was also disregarded.

I had a hearing before her in July of 2016. Yes, she did ask a lot of questions, very specific ones, and I tried to answer as honestly and truthfully as I could. Yet despite the massive evidence placed before her, she denied me and it has caused disastrous consequences for myself and my husband. My husband is totally disabled, too, and we are living on 475.00 (his SSI) per month now that I cannot work. I have re-filed for help, but am in fear of losing our home before something gives, or before I even get a decision.I have a personal diagnosed history of 2 heart attacks, 3 coronary stents due to coronary artery disease, degenerative disk disease and one past back surgery, arthritis, fibromyalgia, carpal tunnel syndrome, PTSD, generalized anxiety disorder and major bouts of recurrent major depression. In May of this year I fell, resulting in a fractured clavicle and torn tendon of my right rotator cup. Yet after 5 days hospitalization, I returned to work, in great pain, as it was a hot, hard job with heavy lifting, not knowing at the time that my collar bone was fractured. I was summarily dismissed 2 weeks later, and was replaced by a 19-year-old. Of course they did not tell me it was due to my health, but I knew, as hard as I tried, I simply was not able to keep up with the work pace anymore. I explained all of this to her. I also went to Vocational Rehabilitation, but my counselor closed my case, stating she wishes she could help me find placement, but she simply felt that by my medical record, there was no job or training into which she felt she could safely place me. Now, I know that judges are required to follow stringent laws and rules, but I wish I were able to ask Her Honor is she ever truly takes into consideration what kind of havoc her decisions wreak on the lives of those who truly want to be able to work, but who simply cannot do it anymore. I am scared, and I feel there is no place left to turn. I just want to be able to stay in my home, and to pay my bills.

Judge Richard P. Gartner presided on 12-19-16 @ 11:am during my Disability Hearing via Video Teleconference. I, with God as my lawyer, was in the Miami, Florida (I have been a Miami resident for 57 years) ODAR office and the Judge was in St. Petersburg, Florida. My wait time for this hearing started on October 31st, 2014 until my receipt of the Notice of Hearing on November 21st, 2016 (2 years and 21 days plus the one year before the hearing starting on October 21st, 2013 when I applied). An excruciating, stress-filled three year period of my now 60 year old life, which I cannot wish on my worst enemy. The honorable Judge Gartner is truly HONORABLE in the full extension and meaning of the word. He and his staff ( Roxana, and the others I spoke with were Diana, Tania and Chad) are considerate, respectful and thoughtfully attentive. He asked many specific questions and explained many proceedings, rights and laws in detail. In addition, I had the extraordinary good fortune of having the presence of Ms. Cynthia Stephens (appointed by ODAR), from Professional Evaluations Plus, who gave her professional opinion as to my disabilities when asked by Judge Gartner. I am grateful to all mentioned. May good health, laughter and sincerity be theirs always! It is a very real pity that the exact OPPOSITE of my compliments and experience with the St. Petersburg, ODAR is true of the Miami Fl. ODAR receptionist, Duroy, and a man named, Claudio De Leon x 28315 listed as the Miami, Fl. ODAR contact for any questions on the SSA website regarding any questions about the upcoming court hearing. De Leon, answered as if angry that his slumber had been disturbed. He hung up on me after asking where I got his extension; I called him back and his excuse for being rude was that he was the Miami ODAR Operations System Administrator!!! He is an employee of SSA and he was listed as the contact by SSA on their website. SSA is HIS employer. There are no words other than just awful, but a MUST mention as part of my overall experience. I hope this helps others as to what to expect and have the good luck of having Judge Gartner preside at their hearing.

Started stating that I said certain things which I never said ... Twisted things I said in court to his favor to were it made it seem I wasn't disable. I serve my country I get fucked up and this is how he treats wounded veterans .. I can speak English well.. Oh he's not disable .. He has hearing loss but rt he has hearing aids he's not disable. I get migraines take medication everyday but yet don't see doctor everyday. Oh his problem has dissminish in his words. Wait till it happens to one of his kids or grand kids then they will really know how unfair the system is

Judge Griggs started very friendly and well mannered. He seemed to care about my concerns an health but towards the end I felt rushed. I understood time was limited but if I only get an hour for you to get to know my problems I think it's your job to listen. Of course he denied me after I waited three years to get that court date, he twisted my words, he granted little weight to what my doctors said, he basically called us all liars. I'm sorry your a judge not a doctor nor do you live in my body so how would you know anything. Those who do know me and worked with me wrote letters, not people I just met but people known for many years even decades but he granted little weight to them too. Was written that some of the letters were made up, although numbers and addresses were provided so he could have contacted anyone at anytime for verification. He judged me not on my medical conditions but by his own judgements. Everything I said I did he shot me down, well, how do disable people drive, cook, shop for groceries, get their kids to school, help with homework, pay bills, take a shower? Because these were the reasons my disability was denied.

If you get your notice for a hearing, and this judge is listed, don't go, protest, check whatever laws are on the books, you could have terminal cancer, and she would think you could still work the remaining 6 months of your life. At 18%, that basically means no one wins, surprisingly, when this judge was in West Virginia she approved 7%.

I really feel as if this Judge should be investigated. There is no way a ALJ should have statistics that read 1,842 cases, 1,550 decesions, 1,116 denials, and 434 approved. For the Fisical year as of 05/19/16, this judge has a 20% approval rating, and 63% Denied, 17% dismissed. Numbers don't lie. Due to incurable illness and you are in a wheelchair, receiving home health 3- 5 days a week, a service dog for PTSD, can't grip or hold items well anymore, but I was given unfavorable decision..especially when there is more than enough evidence to support it. Not being able to work for almost 3 yrs, and yet you still are given an Unfavorable Decision..Seriously?? Than your lawyer calls to ask if you want to appeal or start over...You should not have to fight so hard to get disabiltiy if you truly are deserving of it, and especially when you worked the last 25 yrs previous to your diagnosis. This is ridiculous!!

Kelley is the worst woman ive ever had the displeasure of meeting. I was scheduled a hearing October 27th, she postponed 2 days before my hearing, 8 months later I finally got my case heard, wich by then I waited 2 years 8 months. she gave us ( by us I mean my lawyer and I ) 50 minutes to present our case, of those 50 minutes she took up most of it herself. by the time we tried to present my case she wouldn't listen to my lawyer she kept cutting him off!! he finally got up to leave and she yelled at him and told him to sit down. even the v.o.c rep wouldn't look up not even once. it was the most horrible excperence ive ever been in. my lawyer said out of the thousands of cases hes done mine was best to receive disability. he said I should consider moving out of state because I had no chance with her. my advice to anyone that gets her as a judge don't even waste your time you will lose. someone should have her investigated and removed from the bench. what a poor exscuse for a judge and a woman.....

Oh, and to the person who posted 11/20/2012 and said that the vocational expert found you excluded from gainful employment - I think perhaps there's a misunderstanding there as well. Vocational experts typically respond to hypothetical questions about persons with the claimant's age, education and work experience, but with various types of limitations. Normally at least three different hypothetical questions are asked and, yes, the goal is to find a hypothetical individual who most closely matches the claimant's work-related restrictions. The vocational expert never gives testimony about whether or not YOU, the claimant, can or cannot engage in "substantial gainful activity" work. However, it is not uncommon for the expert to identify at least one of the hypothetical people as having no work available to him or her in the national economy. My guess is, the hypothetical individual the ALJ found closest to your situation was NOT identified by the vocational expert as having no work available to him/her, which may have been the basis for your denial.

I've been a member of the bar for over 30 years, and one who has represented claimants in Social Security cases. First of all, to the law student who posted 3/22/14 - by now, you may be practicing law, and no doubt are a bit more seasoned. To speak so disrespectfully about a judge you don't know, and to suggest she should be disbarred, is not appropriate - especially since you apparently are not familiar with the Social Security law's definition of disability. To the rest of you, I am sympathetic, honestly, but I hope that none of you had attorneys or other representatives - if you did, they may not have explained the applicable law to you as carefully as they should have. While your treating physician's opinion is entitled to great weight IF he/she points to objective medical evidence (tests, etc.) and limits his/her opinion to how long you can sit/walk/stand, how much you can lift, and other points of work-related function, other than simply saying you are 'disabled,' it is not entitled to weight if all your doctor says is "my patient is disabled" and there is no indication that he/she has even reviewed Social Security's definition. The law's definition of disability is not the one you find in the dictionary, or what you think of as disability as an average citizen. In reality, the Social Security law is slanted in favor of the claimant, believe it or not. BTW - my experience with Judge Hodges is that she is fair, courteous, and knows the law. I suspect those who are displeased with her here are those who disagreed with her decisions. If so, appeal them - don't complain about her just because you don't agree with her outcome.

Personally, I don't think she follows the procedure she is supposed to. I have been seeing my doctor every 30 days for 18 years, yet she said in her decision that she placed no credibility in my treating physicians. I was well into a six-figure salary, and I'm not so stupid that I would rather have $2000/mo than $10000/mo. I had a major heart attack in which I had a 95% blockage in the left coronary, and a 90% blockage in my right coronary. The only reason I survived, and this was said by 2 cardiologists, was just so happened that I lived next door to the local ambulance service and stumbled in there before I lost consciousness. If I had waited 10 to 15 minutes for paramedics I would have never survived. Judge Hodges said in her decision that the stenting was successful, and therefore there were no remaining issues with my heart. After showing my cardiologist that, he said "that is the most ludicrous statement I have ever seen!" I still have a 65% blockage that can only be reached by open heart surgery, and all doctors said that my best course of action was to treat the remaining blockage with medication, and to "hang it up". However, she stated that I could do a job as long as I could sit and stand at will, takes breaks as often as I needed one, and as long as my employer placed no pressure to perform at a pace that I could not tolerate. I am over 55, and even the courts VE said I was limited to sedentary work. Even going by the "grid rules" I am considered disabled.

If you ever get judge Kelley, you may as well start your appeals council report, this judge is by far the worst in the United States. The sad thing about it, nobody seems to care. My advice to anyone, before you apply for social security disability, move to another state, you will not win in Montana. She has to be writing her decisions before the hearing. What happened in Queens, New York has to be coming to Montana, what's going on here is too obvious. Judge Kelley is a hired gun from West Virginia, her approval rating there was a whopping 7%, and she keeps her job, only in America.

I personally have sat in front of her to here my case. I found that she was very polite and formal. She knows exactly what she is doing. She was very engaged and interested in hearing my testimony. She asked lots of questions and gave me her undivided attention. I did have a lawyer with me just because I wanted to make sure I was treated fairly after reading horror stories about these hearings. I have not had a decision yet from my hearing but I have no doubt she puts a lot of consideration of the medical facts, testimony, and overall assessment of one's character in her decisions. Regardless Of a favorable decision, if I am given one, I thought she was very professional and fair.

I pity people that have to go before this judge. In general he seemed like a nice guy. But when you leave he's a different person. It took me 2 years to get this far. Only to have a letter show up at my home with countless errors in it. I filled because of my severe knee problems and my speech problems. In the letter all these specialists that the state of Kansas sent me to "Carried Little to no" consideration. He conveniently wrote off 8 years of MRI reports, and dozens of state and private doctor/specialist recommendations. He also conveniently didn't even mention some of my other problems with my knees that are well documented. Instead I receive a letter with an entire page telling me "Acne" isn't considered a disability? Well no "censored". I never filed because of acne. What kind of person would hire an attorney and wait 2 years and ask to be disabled because of acne? How that ended up in my file is beyond me. Then somehow Dyslexia ended up in my file too. And he went on and on stating there is no evidence of Dyslexia. Well gosh maybe that's because I do not have Dyslexia. I didn't even know what that was until I googled it. There are countless errors in this judges decision to ultimately turn me down. Bottom line is if this is your judge you have no hope. You like me wasted 2 plus years for nothing. All so you could get a letter with an entire page dedicated to acne. You can also expect countless errors in his decision. Along with facts that would have greatly helped you be conveniently left out.

Judge Dunlap is one of, if not the, very best ALJ's. Her knowledge of Social Security Disability law is amazing, and she is patient, kind, professional, and willing to provide extra time to complete the record--even to order a post-hearing consultative examination. When my clients are fortunate enough to be assigned to her, I tell them they have the best. I've even gone so far as to say that I probably will not appeal her decision, because it probably will be right. I'm shocked to read that anyone would think negatively of her.

My lawyer told me that Judge Gartner was a new judge so our attention was on high and we were hoping for the best but prepared for the worst. I'm in the hospital now as we speak and was unable to attend my hearing due to hospitalization and some haunting health impairments. I was able to get a letter from doctor by the skin of my teeth so that Judge Gartner wouldnt dismiss my case due to me being unable to physically appear. We sat by the phone waiting to see if he was going to postpone or dismiss. Surprisingly he approved my case without even speaking or seeing me. I was floored and excited!! My lawyer and I were amazed because I was told that something like this was rare and highly unlikely. I want to thank him for looking and observerving the evidence and realizing that I am in a position of health decline. I am honored to to be the first person from what I see to write a honorable report on Judge Gartner. This will be a huge burden taken off of my family and myself. I now can pay for my own medications and can pay out my tab at a few of my health appointment locations. I've read only a few reviews and I must say I believe I was assigned to the most favorable guy in the building!! Thank you Judge Gartner for everything and it would have been my honor and a pleasure if I was able to meet you in person.

I have to say when I read previous comments about Judge Meade it increased my anxiety before my hearing. I am a nurse of 30 years and was forced out of my profession due to my health issues. i need help my step sister o.d. 8 or 10 years ago in and my mother and ex brother in law used my name instead of hers because she was on parole afraid she would get in trouble. well she was in i c u on kidney dailass's bad shape i told the icu nurse who she was and who i was when i got there, well kings daughters did sign her up on ssi then but she didn't get it. but when she gets out of the hospital they made her a kidney doctor appointment, well now i get sick and signed up 2 years ago social security is investigating me for faude saying i went to the kidney doctor for my step sister to help her get her ssi i have nothing or never had any thing wrong with my kidneys so how would that help her i don't know i did not do any of this and they are investigating me when her ex husband works every day in the hills timbering for his brother and draws ssi but they are investigating me i did the right thing and told the icu nurse who she was who i was. why would i risk myself for my step sister we didn't get along well either theres no way i would i didn't even talk to her much when she was released like all ways but i need help i don't want to go to jail for something i am innocent of. and the ex brother in law has been turned in but still gets away and still draws his check and works every day.

The reason why is because he said I exaggerated about my disability which is Aspergers Syndrome a form of Autism. Agree with the previous comments. He is biased. ALJ routinely goes against treating source opinions even when they are consistent with the evidence as a whole. When multiple treating physicians and even consultating physicians are in agreement on limitations and the AlJ still goes against these opinions then you know something is up. why do certain ALJ's believe they can play medical doctor and God.

In my case DLJ Jerry Meade erred no less than 23 times. He also commited two cases of reversable error in my case. When my legal counsel filed a notice of appeal and a lengthy legal brief, I began to notice that there were spy cars watching me. They would follow me to appointments with treating professionals. On one occasion they were going through my garbage and became agitated when confronted. They flashed an unusual badge. The US Marshall's office confirmed that they were FBI. I suppose that when the collage of mistakes made by ALJ Jerry Meade hit his superiors in Falls Church, VA he became upset. I have asked for the appeal to be dismissed. I hope that this will end the lengthy harrasment from the henchmen of ALJ JErry Meade.

Nice smiley-puss who is pleasant in the hearing room and a nasty creep in his opinions. I really do not know how he sleeps at night. He has condemned many legitemately disabled people to lives of abject poverty. He has adopted a definition of disability different from the standard that is contained in the social security statutes and regulations. The protection we all pay for with our social security taxes is not available in his hearing room. He denies claims by ignoring treating opinion evidence and just making facts up out of whole cloth. And there is nothing we can do about it. Northern Arizona no longer has the benefit of the social security system that they paid into because of this creep and the others in this ****-hole of an office. My advice; if you are disabled and live in Northern Arizona: move. There is no fair hearing in this office, much less before this "judge."

I can't say nothing bad about him cause he gave me and unfavorable decision.. but I do want to ask a question... how can one man look at so called paperwork and see a client for a few minutes and then make a decision that will affect the rest of their lives... I will pray for these people cause I see that they do have a hard job in front of them but it just awes me to see how the system is so messed up when some you know get approved and some have been fighting for years. so I guess I will wait and see what goes.. as for me GOD will provide and I pray he has his hand upon these men that makes decisions.. cause one day they will have to stand before someone mightier than then...

He completely ignored my claims and statements from the doctors and such. He thought I was exadurating my claims and did not believe me. I had good solid evidence and the vocational expert said I was not competitive to work.
